laying down more detailed provisions to be laid down in respect of certain arrangements for members of national committees and citizens elected to be members of national committees
The Ministry of the Interior shall, in agreement with the Ministry of Finance, the State Planning Commission and the Central Council of Trade Unions in accordance with Section 8 of the Government Decree No. 66 / 1960 Coll., on the modification of certain ratios of members of national committees and of citizens elected to members of national committees' committees:
Working leave
§ 1
(1) Members of the national committee are mainly engaged outside their working hours. Where this is not possible for serious reasons, the Council of the National Committee for which the Member is concerned shall request in advance the economic, budgetary or other organisation concerned, the single agricultural cooperative or, where appropriate, other folk cooperative (hereinafter referred to as "the organisation ') to provide paid leave of work.
(2) The Council of the National Committee shall agree on the way in which the application referred to in paragraph 1 will be submitted with the relevant organisation. As a rule, an invitation to a meeting, a meeting of the National Committee, etc.
(3) Members of national committees who are not in employment or who are domestic workers shall, at their request, be granted adequate compensation for the loss of earnings as demonstrated, otherwise not exceeding a maximum amount of Kčs 4, - 1 hour and Kčs 32, - per day. Compensation for the loss of earnings shall not be granted after 17: 00 p.m., unless the Member of the National Committee has demonstrated in a credible manner that he has missed his earnings.
§ 2
(1) For the performance of the duties of the President, his Deputy and Secretary of the National Committee, and for the performance of the duties of a member of the Board of the National Committee fully released for the performance of his duties (hereinafter referred to as "officials'), the organisation concerned shall provide only unpaid leave of absence of service at the written request of the Board of the National Committee of which the member is a member.
(2) In determining the extent of such release, account must be taken, inter alia, of the circumstances in order to ensure that the remuneration provided to that member is sufficient to cover his or her earnings, which he or she has lost as a result of his or her release from employment.
§ 3
Expenditure required
(1) The reimbursement of the necessary expenses incurred by Members of the national committees in the performance of their duties shall be charged to the national committee's budgetary resources. The provisions applicable to civil servants will be applied mutatis mutandis (Decree No. 480 / 1950 of the Ministry of Finance of Ú. l. I and its amendments).
(2) Reimbursement of the necessary expenses can be determined by the district national committees, municipal national committees in Pilsen, Brno, Ostrava and Bratislava and regional national committees (in Prague, the district national committees and the National Committee of the City of Prague) with an appropriate lump sum. These flat-rates shall be established by the Board of the National Committee of whose Members they are, while maintaining the highest economy.
(3) The officials of the national committees shall be entitled to the removal expenses, if they require the performance of their duties to be relocated to the seat of the competent national committee. Such officials may, where justified, be granted severance grants in accordance with the applicable rules.
§ 4
Salary tax
(1) The remuneration for the performance of the duties and compensation of the loss of earnings (Paragraph 1 (3)) is a functional benefit subject to a basic wage tax (Paragraph 3 (2) (b) of Act No. 76 / 1952 Coll., on the payroll tax).
(2) One fifth (20%) of the remuneration determined in accordance with Paragraph 2 (2) is exempt from payroll tax.
(3) If an official receives a remuneration for the performance of his duties in addition to another payer's salary, the National Committee shall be considered as the second payer (Section 11 (2) of the payroll tax Act).
(4) Remuneration and compensation for loss of earnings shall be paid at regular monthly periods; The payroll tax is therefore deducted according to the monthly tables.
(5) The remuneration and compensation of the loss of earnings not exceeding Kčs 200, - monthly wage tax does not shrink on the recipients who do not receive wages from another payer (Section 11 (1) of the payroll tax Act). *)
§ 5
Recovery leave
(1) The functionaries of the national committees shall be assessed in the light of the rules on leave to be recovered as employees of the national committees. Members who are in employment shall be entitled to leave as in their current employment.
(2) If an official has not chosen a recuperation leave (its proportional part) in his previous employment, he shall be granted a recuperation leave (its proportional part) as the officials of the National Committee. Similarly, the organisation concerned shall grant a recovery leave (its proportional part) unless it has been chosen by a national committee official before the end of the term of office.
Final provisions
§ 6
(1) The performance of the duties shall be assessed for the purposes of this decree as the period actually worked in the current profession.
(2) For the duration of the training, Members of the national committees shall, in accordance with the applicable rules, provide compensation for the loss of earnings by the training authority.
(3) The officials of the national committees shall not be subject to the provisions on staff remuneration for significant work merit.
(4) The exercise of a parliamentary function in the National Committee may not constitute grounds for discontinuing employment.
(5) After their term of office, the National Committee's officials will be assigned to an earlier post or post they held before release. If such inclusion is not possible, they may be included, with the agreement of the race committee of the basic organisation of the ROH, in another post or post, corresponding to their knowledge and competence.
§ 7
The provisions of Articles 1, 3 (1) and (2), 4 (1), (2), (4) and (5) and 6 (1), (2) and (4) shall also apply to citizens elected by the national committee to be members of its commission.
§ 8
The Order of the Ministry of Interior No 189 / 1958 Ú. l, which gives more detailed provisions for Government Regulation No 32 / 1954 Coll., on the modification of certain ratios of members of national committees, as amended by Government Regulation No 39 / 1958 Coll., is hereby repealed.
§ 9
This decree shall take effect from the date of its publication.
