Decree of the President of the Republic on special forced labour units

Decret of the President of the Republic
of 27 October 1945
on special forced labour units.
On the proposal of the Government,
§ 1.
(1) According to the provisions of § 14 (b) of Decree of the President of the Republic of 19 June 1945, No 16 Coll., on the punishment of Nazi criminals, traitors and their helpers and on extraordinary people's courts, special forced labour units are established in prisons of regional courts and criminal institutions (hereinafter referred to as divisions).
(2) The Minister of Justice may also set up special camps for such sections and determine their organisation.
§ 2.
(1) If a part of the sentence is not to exceed five years, or the whole sentence to be served by the sentenced person in the sections of the sentence, it shall be carried out in the sections normally set up in the prison of the county court in the seat of the court which first delivered the judgment; If it exceeds that period, it shall be carried out in sections set up in a penal institution, following a case in a camp designated by a specific regulation.
(2) The border provided for in paragraph 1 may be increased or reduced by the Minister of Justice for serious reasons.
(3) If the court has stated that the sentenced person is only to serve part of the sentence at liberty, this part shall be done first.
§ 3.
The divestments will be used in particular to carry out the necessary work to restore economic life or other work, carried out in the public interest, such as the disposal of war material and debris, the repair and construction of public buildings and other public facilities, in particular transport, agricultural and forestry work, the regulation of rivers and others; if not such work, they may be used for other appropriate purposes. However, this must not happen where wage or economic conditions of the working classes would be jeopardised.
§ 4.
Prisoners have no right to pay for their work in the wards. The payment agreed for their work is for the state. In determining this remuneration, care must be taken to ensure that workers' wages are not undercut.
§ 5.
This decree takes effect on the day of its publication and applies in the Czech and Moravian-Silesian countries; It shall be implemented by the Minister of Justice in agreement with the Ministers involved.
