DECLARATION
of 18 May 2015
amending Decree No. 262 / 2000 Coll., which ensures the uniformity and correctness of measuring and measuring instruments, as amended, and repealing certain regulations of the Ministry of Industry and Trade
The Ministry of Industry and Trade provides pursuant to § 27 of Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll., Act No. 137 / 2002 Coll. and Act No. 85 / 2015 Coll., for implementation of § 8 (2), § 9 (2), § 11a (2) Act:
Amendment of the Order ensuring consistency and accuracy of measuring instruments and measurements
Decree of the Ministry of Industry and Trade No. 262 / 2000 Coll., which ensures uniformity and correctness of measuring and measuring instruments, as amended by Decree No. 344 / 2002 Coll. and Decree No. 229 / 2010 Coll., is amended as follows:
1. In Article 6 (2), after the third sentence, the sentence "For official brands of the Institute carried out as self-adhesive labels, the identification code of the official mark may be attached instead of the number of the Institute's organisational unit."
2. in Article 7 (2) (f):
"(f) even in the case of intact verification, the place of use of the specified measuring instrument shall be changed where the type-approval certificate of the measuring instrument or measures of a general nature so provides.";
3. After Paragraph 14, the following Section 14a is inserted:
Details of the certificate of examination of the specified measuring instrument and of the test report
(K § 11a (2))
(1) The certificate of examination of a specified gauge shall include:
(a) the title "Certificate of examination of a specified gauge,"
(b) identification details of the Institute or body which issued the certificate;
(c) the certificate number,
(d) the number of pages of the certificate and its annexes;
(e) the date of issue;
(f) identification details of the applicant for the examination of a specified gauge;
(g) the identification details of the designated measuring instrument, the name (type), the manufacturer, the type of measuring instrument, the serial number, or any other identification marking;
(h) the statement on the result of the examination of a specified measuring instrument, including the opinion on compliance with the requirements laid down and the identification of the criteria used;
(i) a statement on the validity or invalidity of the verification of a specified measuring instrument, in the event of invalidity of the verification, the reason for the invalidity;
(j) the date and place of the examination;
(k) identification number of the test report;
(l) a declaration that the certificate of examination and the test report must not be reproduced in any manner other than the whole without the written consent of the issuing person; and
(m) the signature of the staff member responsible and the stamp of the Institute or body which issued the certificate.
(2) The annex to the certificate of examination shall be a test report which shall include the following particulars:
(a) the name "Test report,"
(b) identification details of the Institute or body which issued the test report;
(c) number of test report;
(d) the total number of pages of the test report;
(e) the date of issue of the test report;
(f) identification details of the specified measuring instrument, the name (type), the manufacturer, the type, the serial number and, where applicable, other data (e.g. the measurement range);
(g) the identification data of the document which has been applied as a regulation setting out the metrological and technical requirements for the measuring instrument and the test method for checking and, where appropriate, the identification data of the working procedure used for checking;
(h) the results of the external inspection, including assessments of the designated markings to be placed on the designated gauge, and an assessment of whether the specified gauge is fit for technical testing; if not eligible, the reasons for the non-competence of the measuring instrument;
(i) the date and place of the examination;
(j) a statement that the test report must not be reproduced otherwise than in its entirety without the written consent of the person issuing it; and
(k) the name and signature of the person who carried out the test, the stamp of the Institute or the body which issued the test report.
(3) If the gauge is fit for technical testing, the test report shall include the following information:
(a) details of the conditions under which the examination was carried out;
(b) the identification of the etalones used and their valid metrological link (calibration sheet number);
(c) the results of the check of the specified meter, including an overview of the measured values and an evaluation of the errors of the tested meter;
(d) an indication of the initial and final state of the measured value of the tested measuring instrument, if the measuring instrument allows. ';
4. In Annex 3, point 5.2, including the title:
"5.2. Official mark with attached identification code and last two digits of the year for the Institute (execution as self-adhesive label)
2. Alternative

Official marks may have the following dimensions: (14 x 10) mm or (18 x 11,5) mm or (34 x 17,5) mm. '
5. in Annex 4 (g):
"(g) the official stamp of the Institute or the authorised metrology centre, or, where appropriate, the stamp of the accredited manufacturer of the certified reference material;"
Transitional provision
Official marks of the Czech Metrology Institute placed on the meter in the design of self-adhesive label model 5.2 according to Decree No. 262 / 2000 Coll., as effective before the date of entry into force of this decree, remain valid until the validity of the verification of the meter according to § 7 of Decree No. 262 / 2000 Coll., as amended.
Repeal of certain Regulations of the Ministry of Industry and Trade
The following shall be deleted:
1. Decree of the Ministry of Industry and Trade No. 334 / 2000 Coll., laying down requirements for cold water meters marked by EEC mark, as amended by Decree No. 260 / 2003 Coll. 1).
2. Decree of the Ministry of Industry and Trade No. 337 / 2000 Coll., laying down requirements for meters marked with EEC mark used for measuring air pressure in road vehicle tyres, as amended by Decree No. 260 / 2003 Coll.).
3. Decree of the Ministry of Industry and Trade No. 29 / 2002 Coll., laying down requirements for measuring instruments for measuring the volume weight of cereals marked by EEC mark, as amended by Decree No. 260 / 2003 Coll.).
4. Decree of the Ministry of Industry and Trade No. 31 / 2002 Coll., laying down requirements for alcohol meters and density meters for alcohol, marked by EEC mark, as amended by Decree No. 260 / 2003 Coll.).
5. Decree of the Ministry of Industry and Trade No. 32 / 2002 Coll., laying down requirements for weights of higher accuracy classes from 1 mg to 50 kg, marked by EEC mark, as amended by Decree No. 260 / 2003 Coll.).
6. Decree of the Ministry of Industry and Trade No. 33 / 2002 Coll., laying down requirements for rectangular weights of the middle class of accuracy from 5 kg to 50 kg and cylindrical weights of the middle class of accuracy from 1 g to 10 kg, marked by EEC mark, as amended by Decree No. 260 / 2003 Coll.).
7. Part Three, Sixth, 13th, 15th, 16th and 17th of Decree No. 260 / 2003 Coll., amending certain Regulations of the Ministry of Industry and Trade implementing Act No. 505 / 1990 Coll., on Metrology.
8. Decree of the Ministry of Industry and Trade No. 333 / 2000 Coll., laying down requirements for hot water meters marked by EEC mark, as amended by Decree No. 260 / 2003 Coll. 2).
9. Decree of the Ministry of Industry and Trade No. 335 / 2000 Coll., laying down requirements for taximeters marked by EEC mark, as amended by Decree No. 260 / 2003 Coll. 2).
10. Decree of the Ministry of Industry and Trade No. 336 / 2000 Coll., laying down requirements for gas meters marked with EEC mark, as amended by Decree No. 260 / 2003 Coll. 2).

17. Part Two, Fourth, Fifth, Seventh, Eighth, Ninth, Tenth, 11th and Twelfth of Decree No. 260 / 2003 Coll., amending certain Regulations of the Ministry of Industry and Trade implementing Act No. 505 / 1990 Coll., on Metrology.
Transitional provisions
1. EEC type-approval certificates issued until 30 November 2015 pursuant to Decree No. 334 / 2000 Coll., No. 337 / 2000 Coll., No. 29 / 2002 Coll. and No. 31 / 2002 Coll., remain valid until the end of the type-approval certificates for these measuring instruments. In the case of the Decree of the Ministry of Industry and Trade No. 334 / 2000 Coll., this provision concerns water meters which do not fall within the scope of the Decree of the Government setting out the requirements for measures3). The initial EEC verification shall be carried out in accordance with the requirements applicable at the time of EEC type-approval.
2. Weights complying with the Decree of the Ministry of Industry and Trade No. 32 / 2002 Coll. and the Order of the Ministry of Industry and Trade No. 33 / 2002 Coll. may be subject to EEC initial verification until 30 November 2025 in accordance with the Decree laying down certain procedures for the approval and verification of specified measuring instruments marked by EHS4).
EFFECTIVE
This Decree shall take effect on the 15th day following its publication, except:
(a) points 1 to 7 of Part Two of Article III and Part Two of Article IV, which shall take effect on 1 December 2015; and
(b) points 8 to 17 of Part Two of Article III, which shall take effect on 30 October 2016.
