on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on cooperation in the field of environmental protection
On 17 February 1989, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on environmental cooperation was signed in Moscow. The Agreement entered into force on the date of signature of Article 15 thereof.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on environmental cooperation
The Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics, hereinafter referred to as "the Parties',
building on the principles and objectives of the Treaty of Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics of 6 May 1970,
managing the conclusions of the 1984 Economic Meeting of the Member States of the FMC,
seeking to achieve environmental safety as an integral part of a comprehensive international security system,
Convincing that environmental cooperation will help further develop and strengthen friendly relations between the two states and their peoples,
seeking effective environmental protection carried out in accordance with the multilateral conventions by which both States are bound,
addressing the socio-economic challenges of developing the national economy of the two States in line with the effective protection of the environment and the health of the population,
convinced that environmental problems can only be successfully addressed through joint efforts by States;
agree on the following:
The Parties shall develop mutual cooperation in the protection of the environment and in the rational use of natural resources, to facilitate the further expansion and deepening of economic and scientific and technical contacts in this area.
Cooperation shall aim in particular at:
- protection of air from pollution,
- the rational use and protection of water from pollution,
- soil protection and rational use of the agricultural land fund,
- the protection of flora and fauna, the establishment of national parks, reservations and protected areas,
- exploring the biological and genetic consequences of environmental pollution,
- environmental monitoring,
- the impact of environmental changes on the overall climate,
- improving the environment in cities and municipalities,
- development, exchange and implementation of small and waste-free production technologies,
- cooperation and specialisation in the production of special equipment, apparatus and materials intended to protect the environment,
- regulatory and environmental management issues,
- economic stimulation of rational use and conservation of natural resources,
- environmental education and education system,
- joint design and building of nature conservation objects in the border area,
- preventing the pollution of the food chain by harmful substances,
- coordination of methodological procedures on environmental planning.
Cooperation shall take place in particular through the following forms:
- joint implementation of specific measures aimed at protecting and improving the environment,
- exchange of scientific and technical information, films, video recordings, legislation and directives,
- exchange of scientists and experts for research, study, practice, consultation and exchange of experience,
- exchange of scientific and technical documentation, patents, licences and knowledge "know-how,"
- joint implementation of research, development, experimental work and exchange of results of research and experience,
- the joint use of scientific and technical equipment and equipment,
- organisation and implementation of symposia, conferences, exhibitions and study and training courses.
The Parties shall facilitate the establishment and development of direct relations between the institutions and organisations of both States in the field of environmental cooperation.
The Parties shall consult and coordinate their activities in the field of international cooperation on environmental protection issues.
Coordination of cooperation under this Agreement will take place under the Czechoslovak Socialist Republic of the State Commission for Scientific, Technical and Investment Development and under the Union of Soviet Socialist Republics, the State Committee of the Union of Soviet Socialist Republics for Nature Protection.
In order to implement this Agreement, cooperation programmes will be negotiated for a period of 2 years by the State Commission for the Scientific, Technical and Investment Development of the Czechoslovak Socialist Republic and the State Committee of the Union of Soviet Socialist Republics for Nature Protection.
Cooperation between the institutions and organisations will take place on the basis of agreements, working plans or contracts negotiated in accordance with this Agreement and cooperation programmes.
The Contracting Parties shall immediately inform each other of the emergence of a situation threatening the environment of the other State and of the measures taken to eliminate that threat and shall jointly discuss further necessary measures to mitigate and eliminate the negative consequences of such situations.
The Contracting Parties shall assist each other in industrial accidents or natural disasters in the common border area adversely affecting the environment. The conditions for granting such assistance, as well as the list of facilities, materials and services, shall be determined in specific agreements.
The legal protection and use of the results of cooperation will be governed by the Treaty on the legal protection of inventions, industrial designs, utility models and trade marks when carrying out economic and scientific and technological cooperation of 12.4.1973 and by other agreements in this field which bind the Contracting Parties and by the laws of the Contracting Parties on matters which are not covered by these Agreements.
The results of the cooperation provided for in this Agreement may be transmitted to third States, their legal or natural persons, only after the consent of the competent authorities of the Contracting Parties has been given.
The Contracting Parties shall not be held liable for the obligations of organisations in carrying out cooperation under this Agreement.
This Agreement does not affect the rights and obligations of the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics resulting from other international environmental agreements.
This Agreement shall enter into force on the date of signature and shall be concluded for a period of 5 years.
It shall be extended by no later than five years, unless one of the Contracting Parties denies it in writing not later than six months before the expiry of the current period.
The termination of this Agreement shall not affect the validity of agreements and contracts concluded under this Agreement.
Done at Moscow, 17 February 1989, in two original copies, each in the Czech and Russian languages, the two texts being equally authentic.
