DECLARATION
Bureau of the Slovak National Council
of 6 November 1965
on the conservation of wildlife
The Bureau of the Slovak National Council provides, pursuant to § 10 paragraph 2 of the Slovak National Council Act No. 1 / 1955 Coll. SNR, on State Protection of Nature:
(1) Animal health is an important part of natural wealth. Some of its species are of particular importance to science and the economy, rare, and animals are also of cultural value for their existence. The state therefore provides them with protection.
(2) Animals living and dead are protected at all stages of development (eggs, larvae, cocoons, adult animals), including their natural and artificial settlements.
(1) Protection is granted to animals
(a) listed in the Annex to this Order,
(b) in protected territories, unless otherwise specified in the terms of their protection.
(2) The authority of the State Protection of Nature may declare that other species of animals present in a geographical area are also protected in a unique or small number. Where it is a vertebrate animal, it shall be given the same protection as those indicated in the Annex by an asterisk.
(1) Protected animals are not allowed to kill, catch, disturb or otherwise interfere with their natural development or their environment. It is also not allowed to destroy, damage, collect or relocate their development stages, including their used natural or artificial settlements.
(2) The provisions of paragraph 1 shall not apply to professional animal husbandry (*) which is used to increase their status in the wild as well as to cases where there is evidence of necessary environmental interference and natural development of protected animals due to the proper management of property or other property or for health reasons. However, if the species in the Annex are marked with an asterisk or an isolated occurrence or exceptional implantation, the necessary intervention may only be carried out in accordance with the instructions given by the Regional Authority.
(3) The exemption from the provisions of paragraph 1 for the purposes of scientific research, teaching and education, is authorised by the delegate of the Slovak National Council for Education and Culture and, in the case of animals declared as animals under the rules on hunting, or in the case of animals listed in the fisheries regulations, by the agent of the Slovak National Council for Agriculture in agreement with the agent of the Slovak National Council for Education and Culture.
(1) If, for any reason, the organisation or person takes over the breeding of the protected animal, it shall notify the Regional Authority of the acquisition of the protected animal within one month of the date of application of this decree or of the date on which it has taken the protected animal into breeding; that authority shall issue it with a statement of confirmation.
(2) Those who take over a dead protected animal in an annex marked with an asterisk shall immediately surrender it to the nearest museum or local school and report the matter to the State Conservation Authority; as regards birds and mammals marked with a cross, they shall report the finding to those authorities, but shall hand over the dead animal to the hunting operator where the dead animal was found.
(1) Organisations and persons authorised to breed and process protected animals (including parts thereof and development stages), or authorised to trade with them (zoos, preparation workshops, raw materials collection centres, organisations carrying out the capture, purchase, sale or export of live animals, etc.), are required to keep a registered register of the records (zoos, taxideros, etc.) listed in the Annex to this Decision and to whom such animals have been transferred.
(2) The authorisation provided for in the preceding paragraph is issued by the delegate of the Slovak National Council for Education and Culture.
The export of animals (their parts and stages of development) listed in the Annex to this Decree requires the consent given by the delegate of the Slovak National Council for Education and Culture in agreement with the agent of the Slovak National Council for Agriculture.
When intervening against pests and plant diseases, weeds and sanitary measures, it is necessary to ensure that non-affected animals are not threatened beyond what is necessary.
(1) Where the catching or killing of vertebrate animals is permitted, the means and equipment by which the animal can be caught or killed immediately shall be used. It is therefore prohibited to use, in particular, slingshots, air-conditioning machines, meshes, flywheels, explosives, poisons, adhesives and narcotic drugs for this purpose.
(2) Only persons older than 18 years of age may perform deliberate vertebrate eradication.
(3) Specific provisions are in force to protect useful birds. *)
The authorities of the State Protection of Nature have the right to check compliance with this Decree and to check whether the persons acting against its provisions are identified.
The provisions of this Decree, other than Section 7, do not apply to species of animals which can be caught or killed under hunting and fishing regulations, pest control and sanitary regulations.
This Decree shall take effect on 1 December 1965.
