amending certain Regulations relating to the Regulation on safety and health at work and safety of operation of dedicated electrical equipment in mining, mining and explosive operations
The Czech Mining Office provides pursuant to Sections 5 (3) and 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Amendment of the Ordinance on Safety and Health at Work and Safety at Operation in Mining and Conquering Unreserved Minerals in Underground
Decree No. 22 / 1989 Coll., on the Safety and Health at Work and the Safety of Operation in Mining and Mining Activities Underground, as amended by Decree No. 477 / 1991 Coll., Decree No. 340 / 1992 Coll., Decree No. 3 / 1994 Coll., Decree No. 54 / 1996 Coll., Decree No. 109 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 330 / 2002 Coll., Decree No. 141 / 2004 Coll., Decree No. 298 / 2005 Coll., Decree No. 282 / 2007 Coll., Decree No. 361 / 2009 Coll., Decree No. 35 / 2010 Coll., Decree No. 176 / 2011 Coll., is amended as follows:
1. In Article 4 (5), the words "on safety table3) 'are replaced by the words" safety marks3)';

"(1) In mining works in which workers are present or may be present, the mining air shall contain at least 20% oxygen by volume and the concentrations of the following gaseous pollutants shall not exceed:

(3) A racing mine may allow for a transitional period:
(a) reduced oxygen concentration to 19%; and
(b) an increased concentration of up to 1,5% of carbon dioxide, provided that the average concentration of carbon dioxide for an eight-hour or shorter working shift does not exceed the value referred to in paragraph 1 and the carbon dioxide concentration in the mining air is continuously measured throughout the work;
at the same time, however, he shall be obliged to order measures to remedy this condition. ';
7. Paragraph 83 (1) to (3) reads as follows:

(b) an increased concentration of up to 1,5% of carbon dioxide, provided that the average concentration of carbon dioxide for an eight-hour or shorter working shift does not exceed the value referred to in paragraph 1 and the carbon dioxide concentration in the mining air is continuously measured throughout the work;
at the same time, however, he shall be obliged to order measures to remedy this condition. ';
8. Paragraph 86 (4) reads as follows:
"(4) The main fan shall have two power lines. Each shall ensure the operation of all main fans with respect to their approved parameters. ';

(3) The race mine or its authorised worker may, for a transitional period:
(a) reduced oxygen concentration to 19%; and
(b) an increased concentration of up to 1,5% of carbon dioxide, provided that the average concentration of carbon dioxide for an eight-hour or shorter working shift does not exceed the value referred to in paragraph 1, and the concentration of carbon dioxide in the mining air shall be measured continuously or periodically at intervals determined by the factory mine or by the worker authorised by it throughout the work;
at the same time, however, he shall be obliged to order measures to remedy this condition. ';

(1) In mining works in which workers are present or may be present, the mining air must contain at least 20% oxygen by volume and the concentrations of the following gaseous pollutants must not exceed the following values:

(3) The race mine or its authorised worker may, for a transitional period:

11. in § 206 paragraphs 4 to 6 read:
"(4) In justified cases, several main service stations may be set up for the mine. The main and auxiliary gas station projects must approve the racing mines.
(5) The power supply to the main service station shall be provided by two supply lines, each of which shall ensure the operation of all pumps, including back-ups, respecting their approved parameters.
(6) Pumps, their engines and distribution equipment must be designed by the project and located in a mine so that the expected maximum water level does not put them out of service. '

13. Paragraph 225, including the title and footnotes Nos 52 and 53, reads as follows:
Equipment operator
(1) Self-service may be entrusted to a worker who:
(a) meets the requirements of Article 15;
(b) have completed the age of 18, unless a higher age limit is set for the operation of the establishment concerned;
(c) meets the requirements for the competence to operate dedicated electrical equipment under the Ordinance governing the safety of operation of dedicated electrical equipment in mining activities, activities carried out by mining and the handling of explosives (52), competence to operate technical equipment under the Ordinance governing the safety of operation of technical equipment in mining activities, activities carried out by mining activities or professional competence to drive motor vehicles under the Road Traffic Act (53), according to the type of equipment;
(d) have passed the examination before the committee set up by the race mine.
(2) A worker with at least one year's experience in the operation of such machinery may be entrusted with the separate operation of the mining or loading and mine-free machinery. The training provided for in Section 15 shall be at least 200 hours.
(3) The driver of the mining locomotive shall be recommended for this function prior to the test referred to in Section 15, on the basis of a psychological examination and shall have at least three months of experience in the mode of transport for which it is to be tested. The training provided for in Section 15 must be completed for at least 200 hours. The provisions of this paragraph shall not apply to locomotives with a gauge of 900 and 1,435 millimetres.
(4) The operator must be regularly examined from the knowledge of the operational documentation and regulations to ensure the safety of work and operation. If the test periods are not provided for by another legislation or technical standard, they shall be determined by the organisation.

"(9) The coupling of inanimate parts of electrical equipment and their connection to the main earth line shall be carried out in such a way as to ensure the safety and correct functioning of such electrical installations. ';

"(2) Control circuits shall be performed as isolated or single-polically connected to the protective wire. If they are performed as single-pole connection to the protective wire, the coils of the contactors, relays and electromagnets shall always be connected by one pole to the return (grounded) wire. All contacts must always be connected to an ungrounded branch which must be secured against short circuit. '

Head of electrical engineering
(1) For the management of the installation, operation, revision, testing, inspection and operation of dedicated electrical equipment, the organisation shall determine, at each operated lower level, the leading electrical technician competent in accordance with the Ordinance governing the safety of operation of dedicated electrical equipment in mining, mining and explosive management activities. The head of an electrotechnician for a fluent mine, where it is run or conquered, must have a university degree obtained in a master's study programme in the field of technical sciences and technology focusing on electrotechnics86).
(2) If the head of electrical engineering cannot direct the installation, operation, revision, testing, inspection and operation of dedicated electrical equipment, the organisation shall designate an additional worker for direct management of these activities meeting the requirements for the competence of electrical equipment under the Ordinance governing the safety of operation of dedicated electrical equipment in mining, mining and explosive management activities (86).

"(1) The maintenance of electrical equipment must be carried out in accordance with § 230 and under the Decree governing the safety of operation of dedicated electrical equipment in mining, mining and explosives handling activities (64).
(2) The arrangements, time limits for inspections, maintenance and revisions of electrical equipment shall be determined by the organisation in the order of inspection, maintenance and revision (64). ';

Amendment of the Ordinance on Safety and Health at Work and Safety at Operation in Mining Activities and in Mining Activities on the Surface
Decree No. 26 / 1989 Coll., on safety and health at work and safety at the operation of mining activities and on the activity carried out by mining on the surface, as amended by Decree No. 340 / 1992 Coll., Decree No. 8 / 1994 Coll., Decree No. 236 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 142 / 2004 Coll., Decree No. 298 / 2005 Coll. and Decree No. 240 / 2009 Coll., are amended as follows:
1. Paragraph 9, including the title, reads:
Inspection service
(1) In shifts where authorised mining or mining activities or activities directly related to those activities are carried out in the quarry, such as the installation, operation, revision, testing, inspection and operation of dedicated technical installations, or the work associated with increased hazards or open fire work, an inspection service shall be provided in the quarry, the organisation and tasks of which shall be determined by the quarry or the racing. This service can only be entrusted to a worker capable of managing the liquidation of an accident (Paragraph 18c (1)).
(2) A racetrack or racetrack may, on the basis of a risk assessment, while taking measures to eliminate them, also allow the inspection service to be carried out outside the quarry and for several quarries, taking into account in the measure the procedure for managing the work to save people and to combat the accident during the absence of the accident manager, which shall be incorporated into the emergency plan. ';

(3) Paragraph 77, including the title and footnotes 32 and 33, reads as follows:
Equipment operator

(d) has been informed of the operational documentation.
(2) A locomotive driver shall be recommended for this function prior to the test provided for in Paragraph 13 and shall have at least three months of experience in the mode of transport for which he is to be tested. The training provided for in Section 13 must be completed for at least 200 hours. The provisions of this paragraph shall not apply to locomotives with a gauge of 900 and 1,435 millimetres.
(3) The operator must be regularly reviewed from the knowledge of the operational documentation and regulations to ensure safety of work and operation. If the test periods are not provided for by another legislation, they shall be determined by the organisation.

Amendment of the Regulation on safety and health at work and safety of operations in the treatment and processing of minerals
Decree No. 51 / 1989 Coll., on Safety and Health at Work and Safety of Operation in the Treatment and Processing of Minerals, as amended by Decree No. 340 / 1992 Coll., Decree No. 9 / 1994 Coll., Decree No. 237 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 143 / 2004 Coll., Decree No. 298 / 2005 Coll., Decree No. 395 / 2011 Coll. and Decree No. 12 / 2013 Coll., are amended as follows:
1. Paragraph 35 (4), including footnote 20, is deleted.
Paragraph 5 shall become paragraph 4.

Amendment of the Ordinance on Safety and Health at Work and Safety at Operation in Mining in Underground
Decree No. 55 / 1996 Coll., on the requirements to ensure safety and health at work and safety of operations in underground activities, as amended by Decree No. 238 / 1998 Coll., Decree No. 144 / 2004 Coll., Decree No. 298 / 2005 Coll. and Decree No. 265 / 2012 Coll., are amended as follows:
1. Paragraph 50, including the title, reads:
Air composition
(1) In underground works in which workers or persons may be present or may be present, the air must contain at least 20% oxygen by volume and the concentrations of the following gaseous pollutants must not exceed the following values:

(2) The concentration of explosive gases in the air of underground works must not exceed 25% of the lower explosive limit. Only places outside the effective ventilation range are allowed local concentrations of explosive gases up to 50% of the lower explosive limit, but the necessary measures must be taken to remove this condition.
(3) A quantity of fresh wind shall be delivered underground in order to comply with the composition of the air referred to in paragraphs 1 and 2. Where gaseous pollutants are detected in the air above the values referred to in paragraphs 1 and 2 or flammable gases or other gaseous pollutants above those laid down by other legislation, the operation of the work in the underground shall be stopped.
(4) If the composition of the air does not comply with the conditions set out in paragraphs 1 and 2, the underground work shall be marked by a ban on entry or by a ban on access. Furthermore, only work can be done to remove this condition.
(5) The influence of external climatic conditions on ventilation must be verified in the cave. '
