Parliament has decided on this law of the Czech Republic:
Amendment of the State Social Support Act

1. In the second sentence of Article 3 (1), the words "resident at the Ministry of Interior 'shall be inserted after the words" except for asylum applicants'.
2. In Article 5 (6), the words "referred to in paragraph 7 'are replaced by the words" corresponding to 25% of the average monthly wage in the national economy for the calendar year preceding the period from 1 July to 30 June of the following calendar year for which the income is collected; paragraph 7 of the second sentence shall apply mutatis mutandis to the determination of the average wage on the national economy'.
3. In Article 5 (7), the words "except for persons engaged in an activity which is considered to be an ancillary self-employed activity under a special legislature38) shall be inserted after the word" law. "
4. In Article 5 (8) (b), the words "referred to in paragraph 7 'are replaced by the words" corresponding to one twelfth of the annual income from the business and other self-employment for the calendar year for which the income is collected or, in the cases referred to in paragraph 6, the amount indicated therein'.
Transitional provision
The amount of the benefit from the State social assistance which is due on the date of application of this Act shall be reassessed on that date in accordance with Article 5 (2) of the Law. Even if, within three calendar months following the date of application of this Act, the beneficiary proves that his income from business or other self-employed activities and the income of persons considered in conjunction with him or her, taken into account in the decision on benefits, is the income of persons carrying out an activity which is considered to be a secondary self-employed activity under the Pension Insurance Act or the income of persons whose activity is not considered to be the activity of self-employed persons because they did not carry out that activity on a continuous basis.
Amendment of the Value Added Tax Act
Act No. 235 / 2004 Coll., on Value Added Tax, as amended by Act No. 635 / 2004 Coll. and Act No. 669 / 2004 Coll., is amended as follows:
1. in Paragraph 57 (1), the following point (b) is inserted after point (a):
"(b) educational and educational activities provided by other entities which have not been set up or set up for business purposes and which are entitled to carry out such activities within the territory of the country; or"
Point (b) shall be renumbered (c).
2. In Paragraph 57 (3), the words "in accordance with paragraph 1 (a) 'shall be inserted after the words" taxes'.
3. in Paragraph 61 (b):
"(b) the supply of services and supplies of goods by public bodies or other legal persons which have not been set up or set up for business purposes, provided that such services or goods are closely linked to the protection and education of children and youth;"
EFFECTIVE
This Act shall take effect on the day of its publication.
