Decree of the Ministry of Education and Health and of the State Social Security Office on the partial reimbursement of the costs of care provided in certain youth establishments

on the partial reimbursement of the cost of care provided in certain youth establishments
The Ministry of Education and Health and the State Social Security Office, in agreement with the Ministry of Justice, with other participating central authorities and with the Central Council of Trade Unions, provides for social security under Section 508 (1) of the Civil Code, under Section 11 (2) of Act No. 20 / 1966 Coll., on the care of the health of the people, and under Section 143 (1) of Act No. 101 / 1964 Coll., on social security:
§ 1
Basic provisions
(1) This decree provides for a uniform partial reimbursement of the costs of care (accommodation and facilities, including clothing) provided to children or adolescents (hereinafter referred to as "children ')
(a) in the following educational establishments:
in pre-school and school-age children's homes, in basic nine-year-old boarding schools, in children's sorting houses, in basic nine-year-olds and special schools with children's homes, in youth homes with protective education, including sorting homes, in boarding schools for young people requiring special care in the first and second cycles (including nursery schools for those young people) and in facilities carrying out similar tasks;
(b) in the following medical establishments:
in infants' institutions, if they are children located in them for reasons other than health, in children's homes for children under 3 years *) and in children's professional hospitals, if they are children physically, mentally or sensually defective in those hospitals for reasons other than treatment.
(2) The establishments referred to in paragraph 1 (a) to (c) are hereinafter referred to as "equipment."
(3) Partial reimbursement of costs (hereinafter referred to as "reimbursement of costs") means reimbursement of the child's own income and of the nursing parents and, where appropriate, other obliged persons (hereinafter referred to as "parents"). *)
§ 2
Amount of reimbursement
(1) The reimbursement of costs shall be determined on the basis of the net monthly income of the parents and their maintenance obligations towards children in accordance with the following scales:
(a) for pre-school children by scale I (Annex No 1),
(b) for children under 12 years of age according to scale II (Annex No 2),
(c) for children over 12 years of age, by scale III (Annex 3),
(d) in children physically, mentally or sensual, regardless of age according to scale IV (Annex 4).
(2) If one of the parents has deliberately given up more favourable work or assets, or if he is not making use of his earning capacity and possibilities, the amount of his net monthly income shall be based on his ability and possibilities.
(3) Where a parent also has a maintenance obligation for persons other than children, his net monthly income shall be taken as the basis for determining the cost, minus the amount corresponding to that maintenance obligation.
(4) If the child has both parents, the amount of the costs shall be the sum of the amounts corresponding to them, but not more than the amount corresponding to the highest rate of the scale concerned.
(5) However, the reimbursement of costs shall be at least:
(a) for pre-school children, an amount equal to their own income;
(c) for other children over the age of 6, 70% of their own income; if there are children over 15, also 70% of their work income.
(6) Where reimbursement of costs is determined according to the child's occupational income, an amount of 120, - Cčs shall be deducted from the amount determined in accordance with paragraph 5.
§ 3
Adjustment of costs in special circumstances
(2) If parents or other children dress up, they will be reduced by two degrees.
(3) The reimbursement of costs may be reduced proportionately if special considerations are required.
(4) Where the specific circumstances of the case so justify, the reimbursement of the costs determined in accordance with scale IV may be increased accordingly, up to a maximum of the highest rate of that scale.
§ 4
Reimbursement of costs by the child's own income
(1) In particular, the child contributes to the reimbursement of costs through his own revenue.
(2) The income of the child shall be regarded as the own income of the pension, the occupational income to the extent referred to in Article 2 (5) and (6) and other periodic income. A part of the maintenance exceeding that prescribed by the court shall not be regarded as the child's own income.
§ 5
Reimbursement of costs to nurses
(1) If the child does not have his or her own income or if that income is not sufficient to cover the costs, he or she shall contribute to the costs of the parent. * *)
(2) The allowance shall be determined by the competent authority empowered by each parent individually.
(3) If the child does not have his or her own income and the sum of the two parents' nursing fees would exceed the highest rate according to the scale, the allowance shall be fixed to each of the parents of the amount corresponding to the highest rate, by a work to be determined by the ratio of the rates applicable to them.
(4) The allowance is rounded to ten crowns.
§ 6
Provision of documentation to determine the reimbursement of costs
Parents shall:
(a) submit to the district national committee responsible for the place of residence prior to the arrival of the child a declaration of property and family status, indicating the amount of all income and the names, dates of birth and degree of affiliation of the persons who are not insured, as well as a statement as to whether and to what extent they have been ordered to pay maintenance and to whom they are payable by the court; the amount of revenue shall be evidenced by the confirmation of the competent organisation, post office or authority of the national committee, or by an honorary statement of other revenue, where appropriate; the amount of the maintenance obligation laid down must be demonstrated by a decision of the court;
(b) notify the competent authority, within 15 days at the latest, of changes in the facts relevant for determining the amount of the costs to be recovered for the purpose of its adjustment.
§ 7
Payment of costs
(1) If the child receives an orphan's or other pension, it is paid by the State Social Security Office or another payer directly to the establishment on the basis of his notification that the child is in the establishment.
(2) The medical fee shall be payable, unless decided by the court, on the day on which the child enters the establishment for the period up to the end of the current calendar month and for the following months on the 15th day of each month.
(3) Costs shall not be reimbursed:
(a) for the period when, with the consent of the establishment, the child is at least two consecutive days with parents or other persons during the month;
(b) during the period of residence of the child in a hospital for the purpose of treatment.
(4) For a period of less than one month, the reimbursement of costs shall be determined on a daily basis. The daily reimbursement of costs shall be one-thirty per month. The calculated total amount shall be rounded to ten crowns.
(5) The bill of overpayments and arrears shall be made by the establishment by the 15th day of next month and shall be notified to the parents and, where appropriate, to the children as regards the reimbursement of the costs of their own income.
(6) The child's own income may not be used to cover sickness arrears.
(7) When a child is transferred to another establishment, the arrears shall not be transferred to the establishment to which the child is transferred.
§ 8
Repeal
They shall be deleted:
1. Decree No. 115 / 1958 of the Ministry of Education and Culture of the Ú. l., on the rate of nursing care in children's homes, in youth homes requiring special care and in nurseries;
2. Article 1 and Article 2 (2) of the Directives of the Ministry of Education and Culture of 11 January 1962 No 58 870 / 1961-E II / 2, on student accommodation and catering allowances and on financial standards for the purchase of food in boarding schools *), as amended by the Directives of the Ministry of Education and Culture of 17 February 1964 No 5621 / 1964-E II / 3; * * *)
3. the Ministry of Health Directive No. 149 / 1953 Coll. NV, on the uniform treatment of children's homes from 1 to 3 years of age;
4. Sections 112 and 114 (1) of Decree No. 102 / 1964 Coll., implementing the Social Security Act;
5. Article 24, Section And the Directives of the State Social Security Office No 25 / 1964, number 19, Coll. of the SÚSZ, on Constitutional Social Welfare;
6th Directive of the Ministry of Education and Culture No. 10 / 1964 Coll. NV, on the measurement of nursing fees in children's homes, youth homes requiring special care and youth homes with protective education, and on the determination of the contribution to the provision of arrangements in social care institutions for children in custody or in the execution of prison sentences.
§ 9
Efficacy
This Decree shall take effect on 1 January 1968.
