of 17 December 1951
on the organisation of state forests and national timber mining enterprises.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
In order to secure and disseminate the forestry wealth of the Republic and to better implement the forestry production plan, progressive organisational principles and methods of management should be applied in forestry and timber mining, in particular to separate the cultivation and protection of forests from logging.
§ 2.
(1) The cultivation and protection of forests on all forestry national property, with the exception of those in military management and specially designated forests, shall be carried out by the Administration of State Forests as a public administration facility at the Ministry of Forestry and the Wood Industry, as from 1 January 1952, in the case of forests under the administration of national committees, gradually under the agreement of the Ministry of Forestry and Wood Industry with the Ministry of Interior. The management of state forests shall carry out its tasks through regional forest administrations and forest management. The Minister of Forestry and the Wood Industry shall adapt the organisation and competence of the Administration of State Forests by decree.
(2) On 1 January 1952, the administration of the state forests of Czechoslovakia, a national enterprise, under Act No. 66 / 1951 Coll., on the Professional Management of Forests, and under Act No. 65 / 1950 Coll., on the Management of Forestry Seeds and Plants, and the Implementation of Forestry-Technical Meliorations - Paid for Bystrin.
§ 3.
(1) For the extraction of timber in the forests referred to in § 2 (1) and its removal, for the purchase and supply of timber and for the provision of special services to the forestry industry, the Minister of Forestry and the Wood Industry shall, on 1 January 1952, establish national undertakings (hereinafter referred to as "undertakings') in accordance with the provisions of Act No. 103 / 1950 Coll., on National Industrial Enterprises. The provisions on national industrial undertakings shall apply mutatis mutandis to undertakings, unless otherwise provided for in this Regulation.
(2) The Ministry of Forestry and the Wood Industry will issue the Organisational Regulations (Statutes) of undertakings by decree in the Official Journal.
§ 4.
(1) Forest national property, which has so far been in the administration of Czechoslovak state forests, a national enterprise, and has served to grow and protect forests, goes to the administration of the Ministry of Forestry and the timber industry, which will implement it through the Administration of State Forests.
(2) The assets, which were still under the management of the Czechoslovak State Forests, a national enterprise, and served the extraction and supply of timber and the provision of special services to the forestry economy, as well as the commitments of the repealed national enterprise of the Czechoslovak State Forests, are transferred to undertakings established under Article 3 (1) of this Regulation, provided that certain parts of this property and liabilities are not transferred to the State Forestry Administration by the Minister of Forestry in agreement with the Minister of Finance. In an agreement with the Minister for Finance, the Minister for Forestry and the Wood Industry sets out the start-up equity of the enterprises.
§ 5.
Czechoslovak state forests, a national enterprise, shall be abolished on 31 December 1951 without liquidation.
§ 6.
National committees, in particular regional and regional committees, shall monitor and supervise the activities of regional forest administrations and forestry administrations, as well as undertakings, in particular as regards the implementation of the production plan, assist them in the performance of their tasks, draw their attention to any defects and deficiencies and help to eliminate them.
§ 7.
The existing provisions contrary to this government regulation, in particular the provisions of Act No. 312 / 1948 Coll., on the organisation of state forests and goods, are hereby repealed.
§ 8.
This Regulation shall enter into force on 1 January 1952; they shall be carried out by the Minister for Forestry and the Wood Industry in agreement with participating members of the Government.
