Decret of the President of the Republic
of 27 October 1945
on certain measures in library matters.
On the proposal of the Government,
Cleaning up public books from some of the library records of the period of infreedom.
(1) In library inserts, in which they are registered as authorised persons of the German Empire, the Kingdom of Hungary, persons governed by public law under German or Hungarian law, the German Party of Nazi, fascist parties of Hungarian and other departments, organisations, undertakings, establishments, personal associations, funds and special-purpose assets of these regimes, or related thereto, and as their direct legal predecessors of the Czechoslovak State, the Czech or Moravian-Silesian State or their enterprises, the institutions and funds belonging to them or managed by them, the library court shall delete the law-transition registration and renew the registration for the previously authorised person.
(2) If a former Protectorate of Bohemia and Moravia or its undertaking, institute or fund belonging to it or managed by it is registered in a library insert as a person authorised by the Czechoslovak State or its undertaking, institute or fund belonging to it or managed by it, the library court shall register in place of them as a person authorised by the Czechoslovak State or by it.
(3) The erasures and entries referred to in paragraphs 1 and 2 shall be carried out by the court, by reference to that decree, on a proposal from the Office (authority) in whose field the management of the assets covered by the library registration is to be carried out.
The Library Court shall, upon application by the owner or person, delete the library otherwise authorised by reference to the following decree:
1. notes of seizure, registered on the proposal of the former German authorities and authorities, in particular the former secret state police;
2. Notes to the introduction of forced administration pursuant to the Government Decree of 21 March 1939, No 87 Coll., on the management and supervision of economic enterprises, as well as the registration of the ban on the disposal, loading and smuggling, carried out during the period of infreedom on the proposal of the Ministry of Agriculture (former Ministry of Agriculture and Forestry) or the Land Office for Bohemia and Moravia;
3. the comments made pursuant to § § § 1 and 14 of the Act of 16 April 1919, No. 215 Coll., on preventing the large property of the land, registered during the period of infreedom to design the land office for Bohemia and Moravia.
The Court of Libraries may also, on its own initiative, perform the erasures and entries provided for in Sections 1 and 2 in the ordinary course of dealing with library matters relating to the relevant insert.
Submission and registration pursuant to § § 1 and § 2 are free of charge.
Certificates required for certain library entries.
(1) If the library court has reasonable doubts as to whether the legal conduct under which the library registration is sought is not contrary to the rules of the
1. to the President of the Republic of 19 May 1945, No. 5 Coll., on the nullity of certain property-law negotiations from the time of infreedom and on the national administration of the property values of Germans, Hungarians, traitors and collaborators and certain organisations and institutes,
2. decree of the President of the Republic of 21 June 1945, No. 12 Coll., on confiscation and accelerated distribution of agricultural assets of Germans, Hungarians and traitors and enemies of the Czech and Slovak people,
3. decree of the President of the Republic of 25 October 1945, No. 108 Coll., on the confiscation of hostile property and National Recovery Funds,
require the applicant to submit within a reasonable period a certificate to the local national committee on the national reliability of the persons involved in the legal proceedings.
(2) The provisions on the handling of library applications, to which the original of the relevant document is not attached, shall apply mutatis mutandis (Section 88 of the Bookmark.).
Final provision.
This decree takes effect on the day of its publication and applies in the Czech and Moravian-Silesian countries; It shall be implemented by the Minister of Justice in agreement with the Ministers involved.
