DECLARATION
of 25 June 2014
on safety and technical requirements for the handling of pyrotechnic articles
The Ministry of Industry and Trade, in agreement with the Czech Mining Authority, provides pursuant to § 36d paragraph 3 of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 184 / 2011 Coll.:
§ 1
Subject matter
(1) This Decree provides
(a) safety and technical requirements for the handling of pyrotechnic articles as regards their safe storage and use, in relation to their division into classes and categories; and
(b) the definition of fireworks, as well as the information to be provided in the report on the implementation of fireworks.
(2) This Decree applies to the treatment, storage and use of pyrotechnic articles of categories 4, T2 and P2 with the exception of those listed in Annex 1 to Government Regulation No 32 / 2014 Coll., on the treatment of pyrotechnic articles, and pyrotechnic articles classified in Class IV and subclass T2, with the exception of those listed in Annex 2 to Government Regulation No 32 / 2014 Coll., on the treatment of pyrotechnic articles, and pyrotechnic articles considered to be explosive articles ("pyrotechnic articles considered to be explosive articles').
(3) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
§ 2
Storage of pyrotechnic articles treated as explosive articles
Pyrotechnic articles considered to be explosive articles shall be stored in explosive storages (1) in accordance with instructions for use.
§ 3
Use of pyrotechnic articles regarded as explosive articles
(1) The use of pyrotechnic articles treated as explosive articles means their firing, destruction and destruction.
(2) Pyrotechnic articles considered to be explosive articles are used in accordance with the instructions for use in a condition supplied by their manufacturer or importer in such a way as to avoid endangering the life, health of persons, animals and property and in accordance with the requirements laid down in other legislation2).
(3) Damaged or manifestly inoperative pyrotechnic articles considered to be explosive articles shall be immediately destroyed or disposed of in accordance with the instructions for use.
(4) Pyrotechnic articles deemed to be explosive articles shall not be used in closed spaces unless they are intended for this purpose, and within a radius of 250 metres from church buildings, medical facilities in which bed care, children's facilities, social facilities associated with accommodation, schools and school establishments, children's professional treatments and recovery facilities are provided, and in sports events except where their use is permitted by the local authorities).
§ 4
Fireworks
(1) Fireworks means the simultaneous or short sequence of subsequent firing of pyrotechnic articles
(a) categories 1, 2, 3 or T1, or Classes I, II, III, or subclasses T0 or T1; or
(b) category 4 or T2, or class IV or subclass T2, which are not regarded as explosive articles, where applicable in combination with pyrotechnic articles referred to in (a), for the production of heat, light, sound, gas, smoke or a combination of these effects by self-sustaining exothermic chemical reactions, provided that the total net mass of explosive substances contained in all pyrotechnic articles so fired by one operator exceeds 10 kg per 24 hours in the territory of one municipality.
(2) Announcement4) Fireworks to the local competent municipal authority and to the fire brigade of the county
(a) details of the fireworks person required by the administration (5) for the submission and contact telephone;
(b) the place where fireworks are carried out;
(c) the date and time of the start of the preparation of the fireworks, the date and time of the fireworks and its duration;
(d) the quantities and types of pyrotechnic articles used;
(e) the means of ensuring the protection of the life and health of persons and property, including maps or schemes showing the launches and territories at risk of the effects of detonated pyrotechnic articles, in particular by spreading their parts and the impact of hazardous residues upon their launch; and
(f) the way in which pyrotechnic articles are stored and secured against alienation during the preparation and execution of fireworks.
§ 5
Transitional provision
The requirements laid down for the performance of fireworks shall be met by the holder of the fireworks detonator authorisation issued under the Mining Act before the date of entry into force of this Ordinance and for this purpose shall be considered to be at the same time as the person with competence for Category 4 entertainment pyrotechnics and Category T2 theatre pyrotechnics under the Firearms, Ammo and Pyrotechnic Articles Act (6). The holder of a certificate of professional competence for Category 4 fireworks or Category T2 theatre pyrotechnics under the Firearms, Ammo and Pyrotechnic Articles Act (6) shall also be considered to be competent for the performance of firefighting functions under the Mining Act.
§ 6
Repeal
Decree No 174 / 1992 Coll., on pyrotechnic articles and their handling, is repealed.
§ 7
Efficacy
This decree shall take effect on the day of its publication.
