DECLARATION
Central Geological Office
of 21 October 1961
on the registration of geological works and the collection and registration of their results
The Central Geological Authority shall, in agreement with the State Planning Commission and other participating central bodies, provide for the organisation of the State Geological Service pursuant to § 2 (b) and (f) of Government Decree No 11 / 1958 Coll.:

Část I

Preliminary provisions
§ 1
Purpose
The purpose of this decree is to avoid duplication in the implementation of geological work by registering works before they are included in the plan, to allow full exploitation of the results of geological work by their complete capture, continuous registration and control, thereby creating conditions to improve the economy and quality of geological research and exploration.
§ 2
Scope
The decree covers all organisations carrying out geological work. In its Part III, it also applies to organisations which do not carry out geological work but within the scope of which the geological reports and documentation referred to in Section 12 of the Decree are produced.
§ 3
Geological work
Geological works within the meaning of this Decree are geological research and geological exploration of bearing (including mining research), hydrogeological and engineering-geological (building geological), carried out by all methods of geological science including geophysics, geochemistry, etc., and by all means of exploratory techniques.
§ 4
Geological Fund
Geological works are registered and collected and recorded by the Central Geological Office through the Geological Fund in Prague with a branch in Bratislava ("Geofund").

Část II

Registration of geological works
§ 5
Obligation to register and check
(1) Before the geological work is included in the plan, the implementing organisations shall register them with the Geofund. The registration obligations are not subject to the work referred to in Section 6 of the Decree.
(2) The registered geological works included in the plan are controlled by the superior economic authority, for the works covered by Decree No. 22 / 1961 Coll., on the design, budgeting, planning, financing, invoicing and payment of geological works, also the Czechoslovak State Bank in the scope and in the manner laid down in Section 24 of the Decree cited.
§ 6
Exceptions to registration
(1) According to this decree, they do not register:
(a) the geological work of the mining survey carried out in the mining area; However, surface geological mapping and wells deeper than 100 m shall be registered;
(b) the work of engineering-geological exploration in which the probe work is not used or limited to shallow wells and other shallow probes up to a depth of 15 m, if the total diameter of wells and shafts for one task (one action) does not exceed 75 m; exploratory work for routes of different lines such as pipelines, pipelines, pipelines, cable lines, overhead power lines, melioration networks, etc., if they do not apply sounding works of more than 15 m;
(c) hydrogeological work without the use of probationary work, hydrogeological exploration and drawing work (wells) for individual housing construction and shallow wells and wells up to 10 m for required loading capacity up to 0,3 l / sec., if the total metre on one task (one action) does not exceed 50 m; construction of acceptance wells according to the implementation project without limitation.
(2) There is no need to register separately the partial geological work and tasks carried out for other organisations if they are part of a geological research or research task which has already been properly registered. When entering (ordering) partial work, the contracting organisation must confirm to the organisation that the respective geological task has been registered by the Geofund and state the date and number of the marketing authorisation.
§ 7
Registration procedure
(1) The application for registration is submitted by an organisation which intends to include geological work in the plan, double on the registration sheet, *) for works carried out in the Czech regions of the Geofund in Prague, for works carried out in the Slovak regions of the Geofund branch in Bratislava. The territory of the intended work must be indicated on the situation plan (s) of the appropriate scale attached to the registration sheet.
(2) If geological drilling and mining works are registered in the mining area of another organisation, it should be accompanied by a certificate to the registration request that the relevant mining organisation agrees to carry out the work. Any discrepancy must be removed before the application for registration is submitted, with the participation of the Central Geological Office, the management of economic organisations, the authorities of the State Mining Administration, etc.
(3) The Geofund will examine the application for registration in terms of geological examination, i.e. whether geological work has already been carried out in the same territory or whether it is not carried out or registered, as appropriate. According to the outcome of the investigation, the geological work under consideration shall be registered or refused.
(4) The Geofund will reject the registration of work if work has been carried out or is carried out in the same territory, or if necessary works which may replace the work envisaged, so that their duplicate implementation is inefficient.
(5) If the Geofund finds, in its investigation, that work has already been carried out or is being carried out in the territory or, where appropriate, registered work which, although not preventing the proposed registration but which may be used in the course of the task, may be used, it shall draw the applicant's attention to this fact in a certified registration sheet, provided that it assumes that such work is not known to the applicant.
(6) Geofund shall confirm the registration to the applicant in one copy of the registration form which he returns.
(7) The Geofund is entitled to request additional documents or projects for registration.
(8) Geofund will normally handle the application within 14 days of its submission.
§ 8
Use of Geofund comments
(1) The comments made by the GeoFund, pointing out the geological work already carried out in the territory, must be taken into account in the preparation and approval of the project and, where appropriate, in the inclusion of the action in the plan.
(2) If the Geofund on the registration sheet states that other organisations carry out geological work in the vicinity of the intended work, the relevant organisations are required to communicate continuously the partial results of their work which may contribute to the management of the tasks to be carried out.
§ 9
Amendment and cancellation of registration
(1) If, following the registration, there is a change in the intended work, a change must be reported to the Geofund file that registered the work in the following cases:
(a) where the territory of the work planned changes wholly or in a substantial part; when registering individual wells, if more than 500 m is present;
(b) unless the work ends in the year indicated on the registration sheet. However, there is no need to report a delay in the date of termination of work of less than three months;
(c) where the purpose or, to a significant extent, the nature of the work changes.
(2) When the territory or place of work is changed [paragraph 1 (a)], new work shall be registered. This new registration shall be handled by the Geofund in the manner set out in Section 7 (6). In other cases, the notified amendment shall only be recorded in its supporting documents.
(3) If an action, registered in accordance with Section 7, is not implemented, it is the responsibility of the competent organisation to inform the Geofund without delay that the action will not be implemented.
§ 10
Use of registration to check proper submission of geological reports
If an organisation fails to fulfil its obligation under Part III of the Decree, Geofund shall have the right to refuse to register further works.
§ 11
Appeals against refusal of registration
An appeal against a refusal to register shall be decided by the Central Geological Office in cooperation with the relevant central economic authorities.

Část III
