of 30 March 2009
on the compensation of university students who, for political reasons, were prevented from completing their studies at university during the communist regime
The Government orders pursuant to § 8 of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime:
§ 1
A person who has been excluded from full-time studies at a university from the period from 25 February 1948 to 31 December 1956 (1) and the decision to exclude it has been revoked by the Act on extrajudicial rehabilitation (2) ("the rehabilitation student ') is entitled to one-off cash compensation of CZK 100 000 (" one-time compensation') if he is a citizen of the Czech Republic (3) and the relevant university was located in a territory which is part of the Czech Republic.
§ 2
(1) The granting of one-off compensation on the basis of a request from a rehabilitation student is decided by and paid by the Minister2), headed by a minister who is entitled under the Law on non-judicial rehabilitation to issue an instruction governing the applicant's study rehabilitation.
(2) A written request for a one-off refund ("the application") may be lodged with the Ministry referred to in paragraph 1 by 31 December 2011 at the latest, otherwise entitlement to it shall cease. The application shall include the original or an officially certified copy of:
(a) a decree or, where appropriate, another certificate or communication declaring the applicant's exclusion from the university, issued by the faculty or university on the basis of an instruction from the relevant Minister for Study Rehabilitation, issued under the Law on extrajudicial rehabilitation (2); or
(b) another document proving that the applicant is a rehabilitation student.
(3) A one-off refund shall be payable within 30 days of the date on which the decision granting the application became final.
§ 3
Entitlement to grant one-off compensation does not go to heirs of rehabilitation students. If a rehabilitation student to whom a one-off compensation has been granted by a final decision dies before its payment, the one-off refund becomes the object of the inheritance.
§ 4
This Regulation shall enter into force on the first day of the third calendar month following its publication.
