of 17 December 1970
on certain measures in the field of supply of agricultural products and needs
The Federal Committee on Agriculture and Nutrition, pursuant to § 268 (2) and § 392 of Economic Code No. 109 / 1964 Coll., § 15 (1) of Act No. 51 / 1959 Coll., on the Purchase of Agricultural Products, and Article 144 (2) of Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, in agreement with the participating authorities and after approval by the main arbiter of the Czechoslovak Socialist Republic:
Decree No. 55 / 1967 Coll., on the basic conditions of supply of agricultural products and needs, as amended by Regulations No. 150 / 1968 Coll. and No. 139 / 1969 Coll., is amended as follows:
1. In Paragraph 2, the present provision becomes paragraph 1 and the following paragraph is added:
"(2) As a general rule, the Treaties are concluded within the terms of the amended ministries of agriculture and nutrition of the Republics."
2. Article 3 (2) reads as follows:
"(2) The supplier and the customer shall, at the request of the other Party in a timely manner, conclude a contract for the supply of agricultural products and supplies on the basis of a planning act. ';
3. Paragraph 14 (4) reads as follows:
"(4) The claims of individual farmers for resales resulting from the supply of agricultural products shall be determined by the Ministry of Agriculture and Nutrition of the Republics. *) '
4. Paragraph 14 (6), second sentence:
"If this measure does not produce the desired result, the National Committee shall proceed to the enforcement of commitments under the administrative rules. * *) '
5. Article 20 (1) reads as follows:
"(1) The quality of grains and oilseeds shall be determined on the basis of an analysis carried out in accordance with the methods laid down in technical standards ČSN 46 1011 and 46 2302 according to which grains and oilseeds are also taken over. '
6. Paragraph 23 (1) omits the designation of technical standards

7. Article 25 (2) and (3) reads as follows:
"(2) The delivery periods for straw flax and straw hemp shall be agreed by the buyer with the agricultural organisation in the contract; the period shall not exceed 30 June of the year following the harvest. If the purchaser of flax and hemp does not withdraw within the time limits agreed in the contract, the agricultural organisation shall have the right to carry out the storage of the unrecovered product. The supply is satisfied in this case by sending a notice of storage. The costs of storing the uncollected flax and hemp shall be borne by the buyer at the cost of his own storage costs per 1 q per week started. The same costs shall be borne by the purchaser in the event that the agricultural organisation has agreed to a later withdrawal period than originally agreed in the contract. The agricultural organisation shall have the right to invoice a value equal to 80% of the price of the estimated quantity of flax stored in storage in the course of the storage of the uncollected product.
(3) The agricultural organisation is entitled to invite customers to evaluate flax and hemp before the end of the agreed delivery period, but not later than 14 days before the end of that period. The collector shall be obliged to evaluate flax and hemp within 14 days of this invitation; otherwise the quality declared by the agricultural organisation shall apply to take-over within the agreed delivery period. ';
8. § 26
"(1) The collector shall also indicate on the proof of receipt of the supply the date on which the hops taken over are to be classified. Classification in the quality classes shall be carried out by the customer within the time limits set out in the plan, but not later than 7 days from the date of receipt. The collector shall take two samples from each lot taken together with the representative of the agricultural organisation, seal them and mark them with the address of the agricultural organisation; one of them will keep and the other will hand over to the agricultural organisation. According to the sample, the lot delivered will be evaluated. If the representative of the agricultural organisation does not participate in the sampling, it shall be carried out by the buyer himself in the presence of a social inspection body or other impartial person.
(2) Classification and evaluation shall be carried out in the store of the purchaser, in the presence of a representative of the agricultural organisation, on the basis of the type of quality samples established by the authority authorised to decide on the quality of hops. Where the inclusion of hops in the quality classes or price assessments to the agreement does not occur, or if the representative of the agricultural organisation does not appear for evaluation, the purchaser shall ensure that the quality of hops is immediately determined on the basis of the original sample by the authority empowered to decide on the quality of hops [§ 9 (1) (e)].
(3) If the agricultural organisation offers hops for delivery in accordance with its plan and the buyer does not take over the hops within 7 days, the application shall be made mutatis mutandis in accordance with Paragraph 25 (2), whereby the purchaser is obliged to provide compensation for the storage of 0,50 CZK for each 1 q per day. Reimbursement shall be paid at the rate of the costs actually incurred.
(4) For deliveries, the net weight of each hops jog shall be rounded to half a kilogram; the weight up to 0,25 kg shall not be taken into account; the weight shall be rounded up from 0,26 kg to 0,75 kg and the weight shall be from 0,76 kg to 1 kg up.
(5) Agricultural organisations are obliged to return samples of hops to customers immediately after the award procedure. "
9. Paragraph 31 (4) reads as follows:
"(4) Melase is produced in a sugar factory. The agricultural organisation shall withdraw molasses no later than 31 May of the year following the harvest, otherwise it shall lose entitlement to the supply of molasses. The removal of molasses shall be negotiated in the contract. '
10. Paragraph 32 (1) changes the designation of the technical standard "nuts' to the designation" fresh nuts'; the following technical standard shall be inserted after the technical standard for nuts fresh:
"dry nuts CSN 56 8189 '.
11. In Paragraph 32, the following paragraph 2 is inserted after paragraph 1:
"(2) For the supply of fruit and vegetables, customers enter into long-term contracts with agricultural organisations, whereby regional agricultural associations (production agricultural administrations), or their superior bodies, recognise the character of organisations specialised in fruit or vegetable production. The annual volumes of supplies are specified at the dates set for the conclusion of contracts (Section 2 (2)). With agricultural organisations with which long-term supply contracts will not be negotiated, the buyer shall conclude a delivery contract for the year. '
The designation of paragraphs 2, 3, 4, 5, 6, 7 and 8 shall be amended to paragraphs 3, 4, 5, 6, 7, 8 and 9.
12. In Paragraph 39 (2), the designation of the technical standard "ČSN 46 5820 pickling of seeds with dry stains" shall be deleted.
13. in Paragraph 52 (1), the text "young bovine animals fattened" is amended to the wording "calves for slaughter fattened with milk compound feedingstuffs."
14. the fifth sentence of Paragraph 53 (4) reads:
"For suckling calves, a flat-rate reduction of 1 kg per head shall be made and for suckling calves fattened with milk-based compound feedingstuffs of 3 kg per piece. '
15. In Paragraph 58, paragraphs 6 and 7 are inserted after paragraph 5:
"(6) The collector shall be obliged to take over live slaughter poultry which does not show obvious signs of injury or disease as safe if the opposite is not detected by the State veterinarian before being collected at the premises of the agricultural organisation.
(7) The collector may not exercise the right of liability for defects in live slaughter poultry or the right of liability for damage arising from its defects if the poultry have been taken as safe without obvious signs of injury or disease; This also applies to slaughter poultry delivered with bruising. However, the supplier shall be responsible for the degradation of meat and fat caused by the non-compliance with the obligation not to feed prior to supply with an undesirable effect on the quality of meat and fat (§ 53 (2)). '
The designation of paragraphs 6, 7, 8 and 9 shall be amended to paragraphs 8, 9, 10 and 11.
16. Paragraph 60 (3) reads as follows:
"(3) Contracts shall be concluded for the supply of non-standard market fish and fish not covered by the technical standard, fish handles, fleece and eggs, in which delivery conditions and prices shall be agreed. ';
17. Paragraph 60 (4) and (5) are replaced by paragraphs 4 to 8 of the following text:
"(4) For supplies of game, contracts shall be concluded for a calendar year broken down by quarter by type of game and by weight of dead weight.
(5) In the contract for the supply of venison, the buyer shall agree with the supplier the method of reporting the catch, the dates of collection, the places of purchase and other purchasing and delivery conditions. Where it has been agreed that the supplier will transport the game to a shopping place outside the hunting zone, the amount of compensation for transport costs to that place must be explicitly agreed in the contract; these costs shall be borne by the customer.
(6) The following quality conditions shall be used for the supply of game by users of the hunt:
(a) game of cloven-hoofed game,
cuts properly eviscerated, not parboiled, not too badly damaged by the shooting, males (except whines) without heads, bare game (including black) with heads;
(b) game of small game:
rabbits - squeezed and not shot,
pheasants and ducks - unshot,
partridges - crochet and unshot.
(c) For each game species, the following deadweight shall be determined:

For cloven-hoofed animals, the lowest weight applies only to adult cuts. Young and healthy pieces can also be supplied in a lower weight.
(d) The pheasants shall be taken over by the customer from the users of the hunt according to the following quality classes:
Class I
- Cock and chicken over 70 dkg dead weight
Class II.
- Cock and chicken up to 70 dkg of dead weight and all pieces with shot belly regardless of weight.
(7) The conditions for the supply and collection of live game shall be agreed by the users of the hunt with the customer in the contract.
(8) The obligation to pay periodic penalty payments for supplies of fish, fish handles, trawl, eggs, game and game is established only if the penalty has been expressly agreed in the contract. '
18. The following paragraph shall be inserted after Paragraph 60:
Leather
(1) The hides and skins referred to in this Decree are furskins of fur animals (i.e. mink, nutrition, noble fox species and rabbits kept in the wholesale farms of socialist agricultural organisations), hereinafter referred to as "fur animal skins."
(2) The terms of supply and purchases shall be agreed between the supplier and the customer in the contract.
(3) The obligation to pay periodic penalty payments shall arise only if the periodic penalty payments have been expressly agreed in the contract. ';
19. Paragraph 69 (6) reads as follows:
"(6) The quality of sheep's lumbar cheese is determined by CSN 57 1137. Sheep's lumps are taken over in pre-arranged places. The receipt shall be confirmed by the buyer in the supplier's book indicating the quality of the product delivered. The collector shall take samples from each chest and analyse the samples no later than the second day following the collection; the remains of the samples must be kept for inspection purposes within 12 hours of the following day. At the request of the agricultural organisation, the purchaser shall transmit to him a sealed sample for inspection purposes. The conversion of sheep's lumpy cheese into a milk supply contract shall be carried out in a ratio of 1: 11 (1 kg of sheep's lumpy cheese equal to 11 litres of milk). '
20. Paragraph 77 (5), first sentence:
"Long-term contracts shall be concluded for supplies of piglets for at least two years; the volume of annual deliveries shall be broken down into months for the first year of the long-term contract, for the following years at the dates set for the conclusion of contracts (Section 2 (2)). ';
21. Article 77 (6) and (7) reads as follows:
"(6) The collector shall remove the contracted piglets within 10 days at the latest (piglets delivered above the contract within 21 days) from the date on which they were offered to him by the agricultural organisation for removal. If the successful tenderer does not remove the piglets in the agreed quantity and time, he may not be relieved of liability for the damage caused by it.
(7) The penalty for non-delivered or unremoved piglets is 100 Kcs. '
22. Paragraph 3 shall be deleted in Paragraph 78.
23. The following paragraph is inserted after Paragraph 78:
(1) Where pregnancy has been guaranteed during the sale of breeding animals and the animal health certificate shows a lower degree of pregnancy, the buyer shall be entitled to require a discount on the supplier of up to 15% of the selling price. In cases of established heightiness, a discount may be required in justified cases up to the level of the slaughter value.
(2) If the number of chickens from the total supply of sorted chickens is lower than the sex guarantee, this defect must be claimed in writing within a period of 77 days of the age of the chickens; where a claim is made within this period, a discount of the same amount as that invoiced in the relevant delivery shall be payable to the customer for each hen below that percentage of sex. '
24. In § 100 (a) Medicinal and aromatic plants the first sentence before the colon reads:
"The collector shall pay the import fee if the value of the supply exceeds 20 CZK as follows: '
In the second sentence (after the colon), the words:
"if the delivery exceeds 10 CZK."
25.

(2) The Ministry of Agriculture and Nutrition of the Republic shall, after consulting the central authorities of the Republic, determine which products and to what extent they are purchased into state funds.
(3) The collectors referred to in paragraph 1 shall be obliged to purchase the agricultural products listed there if they are fit for direct consumption or processing, even if they do not comply with the technical standards, subject to the following conditions:
(a) cereals, bovine animals for slaughter, calves for slaughter, pigs for slaughter and milk, even if the quantity offered exceeds the quantity of supplies agreed in the contract (non-contractual deliveries) or even if the contract for the supply of these products has not been concluded (non-contractual deliveries);
(b) the other products referred to in paragraph 1 (a) only from agricultural organisations which have concluded a contract with the customer to supply the product in question, even if the quantity offered exceeds the quantity of supplies agreed in the contract (non-contractual deliveries);
(c) the products referred to in paragraph 1 (b) only from agricultural organisations which have concluded a contract with the customer to supply the product in question, in the quantity agreed in the contract; the supply contract may be undertaken by the agricultural organisation to deliver and the customer shall withdraw all market production of the product concerned. The Ministry of Agriculture and Nutrition of the Republics may, after consulting the Federal Committee on Agriculture and Nutrition and the central authorities involved, provide for an obligation to withdraw the quantity offered, even if it exceeds the volume of supplies agreed in the contract (non-contractual deliveries).
(4) Fruit and vegetable collectors referred to in paragraph 1 (b) of this Article shall: (b) they shall be obliged to withdraw from the agricultural organisations which have concluded long-term supply contracts with them pursuant to Paragraph 32 (2), any quantity of the contracted species produced on the contractual surface provided that their quality complies with the technical standards. Non-standard products (non-compliant technical standards) shall be taken over by customers from such organisations as long as they can be placed on the market or for processing.
(5) The Ministry of Agriculture and Nutrition of the Republics may entrust the purchase of the agricultural products referred to in paragraph 1 and other agricultural products on their territory to other socialist organisations, after consultation with the central authorities of their superiors or mandates to abolish them. The purchase of medicinal and aromatic plants may be entrusted only to a socialist organisation which has received specific authorisation to carry out this activity from the Ministry of Health of the Republic.
(6) Joint cooperative undertakings and associations of agricultural organisations may only purchase agricultural products from their member organisations if they need such products to carry out an activity approved in the instrument of establishment. "
26.
"(1) Agricultural organisations and individual farmers may sell:
(a) bovine animals for slaughter and calves for slaughter exclusively to agricultural purchasing and supplying undertakings;
(b) tobacco exclusively to plants of the tobacco industry;
(c) cereals exclusively to agricultural purchasing and supply undertakings, with the exception of the sale to the organisations referred to in Article 109 (6) of which they are members, and the sale and performance in kind of the members and employees in accordance with the special rules; *)
(d) slaughter pigs exclusively to agricultural purchasing and supply undertakings, except for the sale and in kind to members and employees under special rules; *)
(e) milk exclusively to dairy establishments with the exception of sales and in kind to members and employees under special rules; *)
(f) piglets exclusively to agricultural purchasing and supply undertakings and establishments o.p. Large feedingstuffs, with the exception of the sale to the organisations referred to in § 109 (6) of which they are members, the sale and in kind to members and employees in accordance with the special regulations *) and the sale to other agricultural organisations on the basis of long-term contracts concluded before 31 December 1969 and registered with the OCT Agricultural Supply and Purchase;
(g) wine produced under special rules; *)
(h) agricultural products not referred to in (a) to (g) to any customer authorised to purchase the product in question pursuant to § 109 or to a freely direct consumer.
(2) Seed and seed must be produced and delivered only to the extent laid down by specific provisions. * *)
(3) Agricultural organisations and joint cooperatives may sell agricultural products and their products directly to the commercial network or in their own establishment only if they have the consent of the Ministry of Agriculture and Nutrition of the Republic. "
27.
"(1) Organisations may not agree in a contract by way of derogation from the provisions of § 5 (2), § 6 (3), § 7 (2) to (5), § 8, § 9, § 10, § 50 (1), § 53 (6) and (7), § 54 (1), § 58 (6) and (7) and § 77 (5) to (7) of this order.
(2) The Ministry of Agriculture and Nutrition of the Republics may, in justified cases, authorise an exemption from the provisions of Sections 109 and 110 of this Decree on its territory after consulting the central authorities concerned. "
28. Paragraph 114 is deleted.
Decree No. 123 / 1964 Coll., issuing the basic conditions for the supply of agricultural products, is amended as follows:
Paragraph 72 (2) reads as follows:
"(2) The collector may not exercise the right of liability for defects in live slaughter poultry or the right of liability for damage caused by its defects if the poultry have been taken as safe without obvious signs of injury or disease; This also applies to slaughter poultry delivered with bruising. However, the supplier shall be responsible for the degradation of meat and fat caused by the non-compliance with the obligation not to feed prior to supply with an undesirable effect on the quality of meat and fat (§ 53 (2)). '
This Decree shall take effect on 1 January 1971.
