of 15 March 2012
amending Act No. 212 / 2009 Coll., which mitigates property injustices to citizens of the Czech Republic for immovable property left in the territory of Podkarpatské Rusi in connection with its contractual assignment to the Union of Soviet Socialist Republics
Parliament has decided on this law of the Czech Republic:
Act No. 212 / 2009 Coll., which mitigates property injustices to the citizens of the Czech Republic for immovable property left in the territory of Podkarpatské Rusi in connection with its contractual assignment to the Union of Soviet Socialist Republics, is amended as follows:
1. in Article 3 (1) (c):
"(c) in the period from 29 September 1938, in Podkarpatské Rusi, it left its immovable property and ceased it until 23 May 19456), or left it or lost its immovable property in the territory of Podkarpatské Rusi in connection with the contractual transfer of that territory to the Union of Soviet Socialist Republics (hereinafter referred to as" real estate ") and is able to prove these facts in the manner set out in Article 6 of this Act."
2. In Article 3 (3), the words "death declaration 'are replaced by the words" declared dead'.
3. In Article 3, the following paragraph 4 is inserted after paragraph 3:
"(4) The legal persons referred to in paragraph 3 shall be granted settlement under this law even if the beneficiary referred to in paragraph 1 does not fulfil the conditions of citizenship referred to in paragraph 1 (a) because he died between 29 September 1938 and 29 June 1945, or was declared dead as a result of racial persecution or involvement in a departmental activity, and the date of death was established between 29 September 1938 and 29 June 1945 if, on the date of his death or his declaration, such person could be considered as a Czechoslovak national citizen and that person would fulfil the condition referred to in paragraph 1 (c). '
Paragraph 4 shall become paragraph 5.
4. In Article 4, the following sentence is added at the end of paragraph 2: "The State is a party to an administrative procedure under this Act."
5. In Article 5 (1), "2012 'is replaced by" 2013'.
6. In Article 6, in the last sentence of paragraph 1, the words "for disposal or" and "and disposal" shall be deleted.
Transitional provisions
1. Proceedings on applications under Act No. 212 / 2009 Coll., initiated before the date of entry into force of this Act, including judicial review of decisions given in those proceedings which were not final at the date of application of this Act, shall be completed in accordance with Act No. 212 / 2009 Coll., as effective from the date of entry into force of this Act.
2. Entitlement under the law to mitigate property injustices to the citizens of the Czech Republic for immovable property left on the territory of Podkarpatské Rusi in connection with its contractual assignment to the Union of Soviet Socialist Republics, as amended by Article 4 (1) of the Treaty on the Functioning of the European Union. Even this law, it is necessary to apply a written request to the Ministry of the Interior no later than 31 December 2013, otherwise the claim is no longer valid.
The following shall be deleted:
1. Act No. 42 / 1958 Coll., on the adaptation of certain claims and obligations related to the unification of Zakarpatsky Ukraine with the Ukrainian Soviet Socialist Republic.
2. Decree of the Ministry of Finance No. 43 / 1959 Ú. l., on applying for compensation for property left in Zakarpatské Ukraine under Act No. 42 / 1958 Coll.
3. Decree of the Ministry of Finance No. 159 / 1959 Ú. l., on the national settlement of certain claims of Act No. 42 / 1958 Coll., concerning Zakarpatska Ukraine.
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
