on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on joint control at national borders
On 16 February 1973, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on joint control at national borders was signed in Berlin.
Pursuant to Article 12 thereof, the Agreement entered into force on 3 July 1973.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on joint control at national borders
The Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic, led by the desire to extend and deepen cooperation in the area of joint control at national borders on the basis of the Treaty between the Czechoslovak Socialist Republic and the German Democratic Republic on cooperation in the field of transport and on passport, customs and other control at the crossing of state borders of 21 December 1970, decided to conclude this agreement.
To that end, they appointed their agents:

who, following the exchange of full powers which have been found to be in good and proper form, have agreed as follows:
Where the term "control authorities' is used in this Agreement, this shall mean the authorities carrying out passport and customs checks on persons, goods and means of transport, as well as epidemiological, veterinary and phytoquarantine checks at national borders between the German Democratic Republic and the Czechoslovak Socialist Republic in rail, road and river transport.
(1) The control authorities of the Contracting Parties shall carry out joint checks at points and sections at open border crossing points, as set out in the Annex to this Agreement.
(2) The extension of the joint control to other border crossing points and, where appropriate, the arrangements for its implementation shall be agreed by the competent central authorities and indicated in the Annex hereto.
(1) The checks on persons, goods and means of transport shall be carried out as the first authorities of the Contracting Party from whose territory the persons and goods leave. The authorities of the Contracting Party in whose territory the person and the goods enter shall proceed immediately after the inspection has been declared terminated.
(2) The control of persons, goods and means of transport carried out by the control authorities of the Contracting Party from whose territory the persons and goods are removed shall also be paid for when those control authorities have forwarded the documents authorising the transfer of national borders to the control authorities of the Contracting Party in whose territory the persons and goods enter.
(3) Joint control of railway, postal and other staff of a Contracting Party serving at railway stations within the territory of the other Contracting Party shall be carried out by the inspection authorities at the exchange stations designated in the relevant arrangements of the Contracting Parties' railway administrations.
(1) Control of means of transport crossing national borders means internal and external control of such means.
(2) The competent authorities of the Contracting Party in whose territory joint control is carried out shall take measures at border crossing points to ensure the protection of national borders.
(3) Means of transport transiting national borders into rail and river transport shall be guarded by the authorities of the Contracting Party in whose territory the inspection is carried out in railway stations, sections of railway lines, ports and sections of waterways intended for joint control.
(1) The competent authorities of the Contracting Parties shall establish in their territory the necessary material technical conditions for carrying out joint checks.
(2) The competent authorities of the Contracting Party in whose territory joint control is carried out shall provide the control authorities of the other Contracting Party with the necessary internal facilities, ensure that they are maintained and repaired and shall bear all the costs involved. A list shall be drawn up in duplicate of the service rooms and facilities used by the control authorities of the other Contracting Party, confirming each other.
(3) Staff telephone interviews shall be provided free of charge to the control authorities of the other Contracting Party.
(4) The manner and extent of the compensation paid, including the procedure to be used, shall be agreed by the competent central authorities of the Contracting Parties.
The transport authorities of the Contracting Party in whose territory a joint inspection is carried out shall provide the members of the inspection authorities with free transport to carry out the joint control. At the same time, they will make available the necessary service units on international passenger trains.
The inspection authorities shall be informed in due time of the expected number of persons crossing national borders as well as of other important circumstances affecting the implementation of joint control.
In agreement with the control authorities of its Contracting Party, the transport authorities shall ensure the necessary separation between international transport and internal transport wherever joint control is carried out.
In the event of a disease or accident of a member of a supervisory authority in the territory of the other Contracting Party, the authorities of that Contracting Party shall give him medical treatment free of charge.
(1) The provisions of Articles 5, 6 and 9 shall also apply to the authorities and staff of the Contracting Parties which, in respect of the clearance of persons, goods and means of transport crossing national borders, operate at the places and sections referred to in Article 2 (1) and which are not control bodies within the meaning of Article 1.
(2) The Contracting Parties shall designate an official responsible for managing the authorities referred to in Article 1 (1) and Article 10 (1).
The competent central authorities may negotiate the necessary arrangements for the implementation of this Agreement.
(1) The Agreement shall be subject to approval under the constitutional provisions of the Contracting Parties and shall enter into force on the date of the exchange of notes on such approval.
(2) The Agreement is concluded for a period of five years. If one of the Contracting Parties has not notified the Agreement at the latest one year before the expiry of that period, it shall remain in force for a further five years. The expiry date of the Treaty between the Czechoslovak Socialist Republic and the German Democratic Republic on cooperation in the field of transport and on passport, customs and other control at the crossing of state borders of 21 December 1970 will also expire.
Done at Berlin, 16 February 1973 in duplicate, each in the Czech and German languages, the two texts being equally authentic.

Common veterinary and phytosanitary checks shall be carried out only at the border crossing point of one Contracting Party. The border crossing points shall be designated by name in agreement with the competent central authorities of the Contracting Parties.
The competent central authorities shall agree on the date of the start of joint control.
