concerning popular control in the Slovak Socialist Republic
The Slovak National Council decided on this law:
Basic provisions
The mission of the people's control bodies, with the active participation of the people, is to consolidate socialist legality and state discipline in the performance of tasks in the field of national economy and state administration, to increase the awareness of the responsibilities of managers for the entrusted section of activities and to protect the political and economic interests of socialist society and state. People's control bodies are based on the guidelines and resolutions of the Communist Party of Czechoslovakia.
(1) People's control bodies carry out their mission in particular by:
(a) carry out control activities, discuss the results of the check with the heads of the authorities and the organisation, and, where appropriate, with their superior authorities, and ensure that the deficiencies identified are remedied;
(b) give incentives to exercise the responsibility of persons and organisations in accordance with the relevant rules and impose sanctions where applicable; *)
(c) ensure that public administrations and socialist organisations carry out the tasks arising from their laws and other generally binding legislation, respect state discipline in the performance of the tasks of economic and cultural construction, respect citizens' rights and pursue their activities to satisfy social interests and needs;
(d) generalise knowledge of the control activity and submit the necessary proposals to the relevant management and other authorities;
(e) give incentives to improve the rule of law.
(2) People's control bodies cooperate in their work with citizens and their organisations and use their incentives and warnings; create the assets of the co-workers and involve them in carrying out control activities.
(3) According to the nature of the case, the authorities of the Communist Party of Czechoslovakia, the bodies of social organisations and the collective working in the audited bodies and organisations are informed of the results of their control actions.
(4) The control of the authorities of the people's control shall not apply to the decision-making activities of courts, prosecutors, economic arbitrage, public notaries, investigating, searching and clarifying bodies carried out in accordance with the provisions of specific regulations.
(1) The People's Control Authorities in the Slovak Socialist Republic are:
(a) the Committee of People's Control of the Slovak Socialist Republic,
(b) committees of popular control of national committees;
(c) the popular control racing committee.
(2) The popular control committees and the popular control racing committee referred to in paragraph 1 are part of the system of popular control bodies in the Czechoslovak Socialist Republic.
Committee of People's Control of the Slovak Socialist Republic
(1) The Committee of People's Control of the Slovak Socialist Republic controls in particular:
(a) performing the selected tasks of the State Plan for the Development of the National Economy and the State Budget of the Slovak Socialist Republic and, where appropriate, the budgets of the National Committees;
(b) the effectiveness of the work and management of public administrations and state economic, budgetary and other state organisations;
(c) the use and protection of property in socialist social ownership;
(d) the state and level of handling of complaints, notifications and initiatives of citizens and organisations;
e) the performance of other tasks arising from the laws and other generally binding legislation, from the resolutions of the Government of the Slovak Socialist Republic and the Government of the Czechoslovak Socialist Republic.
(2) The Committee of People's Control of the Slovak Socialist Republic directly examines serious complaints, notifications and initiatives.
(3) The Committee of People's Control of the Slovak Socialist Republic monitors the application of the general rules on control activities, organises the exchange of experience from the activities of control authorities and ensures the unification of control practices in the Slovak Socialist Republic.
(1) The control function of the Committee of People's Control of the Slovak Socialist Republic applies to the following authorities and organisations within the competence of the Republic:
(a) central and controlled bodies of state administration;
(b) the executive bodies of the national committees;
(c) state economic, budgetary and other state organisations managed or managed by central government bodies of the Republic and national committees;
(d) cooperative, social and other organisations, including their undertakings and economic establishments, as regards the performance of the tasks of the State Plan for the Development of the National Economy of the Republic, their relations with the State Budget of the Republic, the budgets of the National Committees and the fulfilment of their other obligations under the laws and other generally binding laws.
(2) The Committee of People's Control of the Slovak Socialist Republic controls the sectors and activities falling within the competence of the Federation, with the knowledge of the Government of the Slovak Socialist Republic being entrusted with the Committee of People's Control of the Czechoslovak Socialist Republic. The Committee of People's Control of the Slovak Socialist Republic may delegate these tasks to the Committees of People's Control of Regional National Committees, or to the Committees of People's Control of District National Committees.
(1) The Committee of People's Control of the Slovak Socialist Republic submits to the Government of the Slovak Socialist Republic for approval a draft of its control plan; report on the results of important control actions to the Government.
(2) The Committee of People's Control of the Slovak Socialist Republic shall, at the request of the Bureau of the Slovak National Council, report to the authorities of the Slovak National Council on the findings of the inspection activity or carry out the checks necessary for the performance of the tasks of the Slovak National Council and their bodies.
The Committee of People's Control of the Slovak Socialist Republic directs the activities of the Committees of People's Control of National Committees, in particular unifying their procedures for planning and carrying out control activities, issuing methodological guidelines and guidelines for their activities and carrying out other tasks which belong to it as the central authority of the Slovak Socialist Republic's state administration in the control section.
The Committee of People's Control of the Slovak Socialist Republic ensures the mutual coordination of professional control activities with ministries and other central authorities of the state administration of the Republic, in particular in the preparation of plans for control activities. According to the guidelines of the Government of the Slovak Socialist Republic, it unifies the procedure for controlling compliance, important resolutions or other measures of the Government of the Slovak Socialist Republic and the Government of the Czechoslovak Socialist Republic. In cooperation with the competent authorities of the Republic, it shall organise joint control actions.
(1) The Committee of People's Control of the Slovak Socialist Republic consists of the President, who is a member of the Government of the Slovak Socialist Republic, of the Vice-Presidents and other members in the number 8-12 appointed and withdrawn by the Government of the Slovak Socialist Republic.
(2) The work of the Committee of People's Control of the Slovak Socialist Republic and its apparatus is managed by the President; Vice-Presidents of the Committee of People's Control of the Slovak Socialist Republic.
(3) The Committee of People's Control of the Slovak Socialist Republic decides in the College on fundamental matters within its competence. The Committee shall act by an absolute majority of its members.
(4) The resolution of the Committee of People's Control of the Slovak Socialist Republic is issued by its President. If the President does not agree with the resolution of the Committee, he shall have the right to suspend the enforcement of the resolution and to refer the matter to the Government of the Slovak Socialist Republic for a decision.
(5) Other issues falling within the competence of the Committee of People's Control of the Slovak Socialist Republic shall be decided by the President, the Vice-Presidents and, to the extent of their powers, the other members and staff of the Committee.
(6) A more detailed definition of the tasks of the Committee of People's Control of the Slovak Socialist Republic and the principles of its activities and organisation will be laid down in the Statute. The Committee shall lay down its rules of procedure.
Committees of People's Control of National Committees
The provisions of the National Committees Act apply to the setting-up, composition of the meetings of the Committees of People's Control of National Committees.
(1) The committees of the national committees shall carry out checks within the competence of the national committees of the level concerned. They shall check in particular:
(a) the performance of the selected tasks of the economic plan and the national committee's budget;
(b) the use and protection of property held in socialist property;
(c) the effectiveness of the work and management of the national committee and of the organisations managed or managed by the national committee;
(d) compliance with the resolutions of the National Committee and its Board;
(e) the performance of other tasks arising for national committees and bodies governed or managed by them by law, other generally binding laws and resolutions of the Government of the Slovak Socialist Republic and the Government of the Czechoslovak Socialist Republic;
(f) the status and level of handling of complaints, notifications and initiatives of citizens and organisations by national committees and bodies managed or managed by them.
(2) The Committees of People's Control of National Committees directly examine serious complaints, notifications and initiatives.
(1) The control powers of the Committees of People's Control of National Committees shall cover:
(a) bodies and organisations managed or managed by the national committee of the relevant stage;
(b) to the executive bodies of the national committees of lower grades and the organisations managed or managed by those national committees;
(c) to joint management of economic, cooperative and other organisations, to the extent that the national committees exercise public administration vis-à-vis them under specific rules.
(2) The Committees of People's Control of the Regional National Committees and the Committees of People's Control of the Regional National Committees are also authorised to carry out checks in organisations centrally managed by the authorities of the Republic, in cooperative, social and other organisations, if they are on the control tasks arising from the control plan of the Committee of People's Control of the Slovak Socialist Republic or other serious control tasks entrusted to them.
(3) Under the authority of the Committee of People's Control of the Slovak Socialist Republic, the committees of the Regional National Committees and, where appropriate, the committees of the Regional National Committees may also carry out control in organisations managed by the federal authorities.
(4) In carrying out the control tasks referred to in paragraphs 2 and 3 and, where appropriate, in accordance with Paragraph 11, where the tasks are centrally coordinated, the guidelines of the Committee of People's Control of the Slovak Socialist Republic are managed,
(1) The committees of the national higher-level committees shall direct the activities of the committees of the national lower-level committees, in particular to unify their procedures for planning and carrying out control activities, organise joint control actions with them, decide on appeals against their decisions and carry out other tasks in reviewing their decisions in administrative procedures.
(2) The Committees of People's Control of the Regional National Committees and of the People's Control Committees of the District National Committees, which have set up, direct and provide methodological assistance under the conditions laid down in Article 15, shall guide their activities.
(3) Committees of popular control; the national committees cooperate with other bodies and organisations and ensure mutual coordination of professional control activities with other state bodies operating in the perimeter of the relevant national committee.
(1) The Committees of People's Control of National Committees carry out control tasks for the needs of the Plenary Session of the National Committee, its Board of Directors, the Committee of People's Control of the National Committee of the Higher Level, the Committee of People's Control of the Slovak Socialist Republic, as well as 1 other serious control tasks entrusted to them by the Committee. The Committees of People's Control of National Committees shall submit a draft plan of their control activities for approval to the plenary session of the National Committee.
(2) The Committee of People's Control of the National Committee is responsible for its activities to the plenary session of the National Committee; in the exercise of control activities it shall follow the guidelines and guidelines of the Committee of People's Control of the National Committee of Higher Education and the Committee of People's Control of the Slovak Socialist Republic.
Race Commission of People's Control
(1) The People's Control Racing Commission shall be established in enterprises, other organisations and establishments managed by the authorities of the Republic or by national committees where optimal conditions are created and after the agreement of the Government of the Slovak Socialist Republic.
(2) The Commission shall carry out checks on the economic activity of the undertaking, organisation or establishment in which they were set up.
(3) The Government of the Slovak Socialist Republic sets out the scope of the activities and authorisations of the competitive commissions of popular control and the conditions for their establishment.
Common and final provisions
(1) The authorities of the People's Control shall act independently of the authorities of the State and Economic Management when carrying out the checks in the institutions and bodies and when assessing the facts established.
(2) The obligations and authorisations of the authorities of the people's control, their members, workers and coworkers, as well as the obligations of other authorities and organisations towards the authorities of the people's control, are laid down in the Federal Assembly Act. *)
(3) The committees of popular control of local national committees and the committees of popular control of local national committees are entitled to impose on officials and staff of controlled bodies and organisations for the misconduct of their duties of reprimand. *) People's review committees of local national committees are also entitled to impose a reprimand with a fine, *) if they are empowered to do so by a committee of local national committees.
(1) Reimbursement of the salary (loss of earnings) to members and co-workers of the Committee of People's Control of the Slovak Socialist Republic shall be provided in the short term, released for office, at the rate of the average earnings of the organisations in which they are in working or similar proportions. The People's Control Committee of the Slovak Socialist Republic shall, at their request, reimburse the organisations for the compensation paid from their budget.
(2) Reimbursement of travel and other expenses to the members and co-workers of the Committee of People's Control of the Slovak Socialist Republic shall be provided by the Committee in accordance with the relevant rules. * *)
(3) The provision of compensation to members and co-workers of the committees of popular control of national committees is governed by the provisions applicable to national committees. * * *)
(4) Reimbursement of wages, travel and other expenses to members and co-workers of race boards shall be provided by popular control according to the relevant rules †) by organisations in which the race committee operates.
A working or similar ratio shall be maintained for the chairpersons and vice-chairmen of the popular control committees, if they are released for the performance of their duties. Instead of pay (other remuneration / work), the Committee of People's Control of the Slovak Socialist Republic or the competent national committee shall provide them with adequate remuneration for the performance of their duties. More detailed arrangements are laid down by the Government of the Slovak Socialist Republic.
(1) The existing Commission on People's Control of National Committees is being converted into the national committees on People's Control of National Committees under this Act.
(2) The provisions of this Act on local, regional and regional popular control committees apply to other national committees, which are based on local, regional and regional national committees.
(1) The Committee of People's Control of the Slovak Socialist Republic may, on the basis of a decision of the Government of the Slovak Socialist Republic and in cooperation with the competent central authorities of the Republic, establish committees of popular control in production units managed by the authorities of the Republic.
(2) The organisation, scope, duties and authorisations of the popular control committees in production units within the competence of the Republic of Slovakia shall be regulated by the Government of the Slovak Socialist Republic.
The scope of the other public authorities in the field of control, inspection and supervision, as laid down in specific regulations, is not affected by this law.
Paragraph 58 to 60 of Act No. 69 / 1967 Coll., on National Committees, as amended, is amended as follows:
1. Paragraph 58 reads:
"The Regional and Regional National Committees shall establish popular control committees; they may also be set up by the municipal and local national committees, after consultation with the popular control committee of the relevant district national committee. ';

"(1) The Committee of People's Control of the National Committee shall be composed of the President, Vice-President and other Members who shall elect and withdraw the Plenary Session of the National Committee from the Members of the National Committee and other citizens. The membership of the Committee of People's Control of the National Committee shall be incompatible with the function of President, Vice-President, Secretary, Chairman of the Commission and Head of Department of the National Committee responsible, the National Committee of the Lower Level, or with the function of Head of Organisation managed or managed by the National Committee responsible.
(2) The chairman of the Committee of People's Control of the National Committee shall be the Member of the National Committee; shall have the right to attend meetings of the Advisory Council with the advisory vote. The Vice-President of the People's Control Committee shall be represented.
(3) The expert work for the Committees of People's Control of National Committees provides the apparatus. The number of staff of the apparatus and the cost thereof shall be determined by the plenary meeting of the National Committee, on a proposal from the Committee of People's Control, taking into account the tasks performed by the Committees of People's Control of the National Committees under specific rules. ';
3. Paragraph 60 reads:
"(1) The Committee of People's Control of the National Committee shall meet as necessary. At its meetings, it shall decide on matters of principle falling within the competence of the Committee. The Committee shall act by an absolute majority of its members. The resolution of the People's Control Committee shall be issued by its President. The Chairman of the Committee of People's Control of the National Committee shall be entitled to suspend the enforcement of the resolution of the Committee if the resolution is contrary to a generally binding law or the resolution of the National Committee; submit the matter to the next plenary session of the national committee for decision.
(2) The Chairman, the Vice-President and, where appropriate, the additional members and staff of the Committee shall decide on other matters within the competence of the Committee of People's Control of the National Committee. "
(1) Where the Act No. 69 / 1967 Coll., on National Committees, as well as the Slovak National Council Act No. 43 / 1968 Coll., on the Capital of Slovakia Bratislava, on the Slovak National Council Act No. 131 / 1970 Coll., on the establishment of the Regional National Committees in the Slovak Socialist Republic and on the measures related thereto or in other regulations, the Commission of People's Control of National Committees or, where this is understood to be the general title of the "Commission," these are the popular control committees.
(2) They are repealed.
(a) Paragraph 81 (2) of Act No. 69 / 1967 Coll., on National Committees;
(b) § 1b (2) second sentence and § 1b (3) and (4) of the Slovak National Council Act No 207 / 1968 Coll., on the establishment of ministries and other central bodies of the Slovak Socialist Republic, as supplemented by Act SNR No. 150 / 1970 Coll.;
(c) Act No. 70 / 1967 Coll., on People's Control Commissions, as amended by Act No. 85 / 1968 Coll.
This Act shall take effect on the day of its publication.
