Government Regulation
of 17 June 1947
on criminal studies.
The Government of the Republic of Czechoslovakia hereby orders, pursuant to Article IX of the Law of 23 May 1873, No 119 of the Code of Criminal Procedure, Article 227 of the Code of Criminal Procedure, Article XXXIII / 1896, Article II, Sections 1 and 4 of the Law of 1 July 1927, No 107 of the Coll., amending certain provisions of the Code of Criminal Procedure and establishing judicial medical councils, and Sections 62 and 70 of the Law of 24 November 1926, No 218 of the Coll., on the Original Law on the Works of Literary, Artistic and Photographic Works:
A connoisseur.
(1) The remuneration of experts in criminal proceedings shall, as a general rule, be determined (Article 2) according to the schedule of expert fees attached to this Regulation. If the action in the tariff is not indicated or included in any of the acts referred to therein, the remuneration shall be determined according to the time and effort required for the action, taking into account the amount of the tariff remuneration for such action.
(2) The remuneration of experts who are not listed in the schedule of experts' fees should be determined according to the time and effort and the degree of knowledge or skills required to act and taking into account the remuneration of experts listed in the schedule for similar actions, as a general rule (§ 2) of an amount not exceeding 160, - Kčs.
If the expert act is excluded from the normal limits due to its scope, complexity or exceptional knowledge or skills required by it, or due to other exceptional circumstances, to the extent that the remuneration determined under the highest tariff heading or under § 1 (2) would be disproportionate, the remuneration shall be awarded at a reasonable rate.
If several experts have been recruited to act, each of them shall be entitled to a full remuneration.
Unless otherwise specified in the schedule of expert fees, the remuneration for examinations (examination, examination) shall also include remuneration for findings and assessments.
If the remuneration for the expert's activity which is carried out in the absence of the court, according to the schedule, depends on the duration of the period spent on the operation, the expert shall keep a separate statement showing in the chronological order how many hours he has spent on the day in question and what he has done in that period. The report shall be submitted by the expert to the court at the same time as the request for remuneration.
(1) The remuneration paid to public authorities and public institutes for expert activities at the rates laid down for the performance of such offices and institutes.
(2) If such rates are not fixed and the expert act is not free of charge, the court shall determine the remuneration mutatis mutandis in accordance with the provisions of this Regulation.
(1) The remuneration according to the scale of the expert's remuneration is for the expert not to consider whether it is an expert's activity in the preparatory procedure or in the main or appeal proceedings.
(2) If, at the time of the main or appeal hearing, the expert submits opinions on the basis of his own findings in the preparatory proceedings, the expert shall be remunerated in the same way as the opinion on the basis of another expert's findings. Where no specific remuneration is provided for in respect of an opinion given on the basis of the findings of another expert of the category of experts concerned, the court shall determine the remuneration by a fraction, normally not more than half of the remuneration awarded in the preparatory proceedings.
At the time of the autopsy, there is a reward of 40. - Cís, but if the corpse in decomposition has been dissected, the corpse exhumed, the corpse of a person who died of contagious disease or affected sepsis, or if the autopsy lasted for more than 2 hours, he may be awarded a higher, but not more than 80. - Cís. Other auxiliary persons recruited by experts shall have the usual remuneration for similar operations at their place of activity.
Compensation for waste of time.
(1) A special compensation for the loss of time shall be paid to the expert only:
(a) if he is called to an expert act in a municipality where he has neither his apartment nor his usual working room, for the time spent as a result outside his apartment and outside his usual working room; the period for which the expert's own activity has lasted shall be deducted from that period; or
(b) if, by order of the court, the court is present at the hearing for longer than is necessary for the submission of the finding and the opinion, during that time; until that time, the period for which the suspension of the same hearing took place or between two trials, if not more than one hour, shall be added and the period for which the expert's own action took place shall be deducted from it; or
(c) if an official hearing is held for an hour, but is delayed, during the waiting period; or
(d) if there is an official hearing, but it is not due to the causes which it is not responsible for, for the period from the date of the official hearing to the date of its submission at a later date, until it has been notified that the official hearing will not take place.
(2) Compensation for the loss of time is due to the expert in the amount of 40.- CZK for each starting hour. If, in the cases of paragraphs 1 (a) to (c), the period for granting the refund does not exceed half an hour, the refund shall not be due. If, in the case of paragraph 1 (d), the waiting period of more than half an hour has not elapsed, the compensation for the loss of time may not exceed the remuneration which would have been due for the act with which it met.
(3) Compensation for the loss of time is not the case if it is clear that the loss of time by experts does not cause damage to regular earnings, in particular if the expert is in the public service and does not, in addition, carry out private medical or other private employment leave.
Reimbursement of final expenses.
(1) Except as otherwise provided for in the schedule of experts' fees, the expert shall be entitled, in addition to the remuneration of all actual issues established, necessarily linked to the expert's activity. It is not appropriate to grant a replacement for tools and tools allowing permanent use.
(2) Issue related to medical and veterinary expert activities shall also include expenditure on disinfectants, reagents and a reasonable amount for the use of rubber gloves.
Travel expenses replacement.
(1) It is for the experts and auxiliary persons recruited by them (Section 8), if they have neither their flat nor their normal working rooms in the municipality where the expert's work is carried out, to make up for the actual costs incurred, up to a maximum of the amount equal to the public means of transport on scheduled routes III. classes of carriage or class II, as well as a refund for bed not exceeding 90 CZK per day and a refund for meals not exceeding 100 CZK per day.
(2) Experts who are public servants are entitled to reimbursement of travel and subsistence expenses in accordance with the rules applicable to official missions of public servants.
Entitlements of members of the medical court.
(1) Members of the medical court board who took part in its sitting are entitled, without regard to the number of cases discussed for each starting hour, to a remuneration of 120.- Kčs, presiding over the remuneration of 240.- Kčs.
(2) In addition to the remuneration for taking part in the deliberations referred to in paragraph 1, those who were the rapporteur (co-rapporteur) in the session of the Board shall be remunerated at 460.- Kčs for each item in which he was the rapporteur (co-rapporteur).
(3) Members of the Board who do not reside in its seat are entitled to reimbursement of travel expenses in accordance with the rules applicable to other experts (§ 12) when travelling to the Council.
(4) The remuneration referred to in paragraph 1 and the refunds referred to in paragraph 3 shall be allocated by the President to individual cases discussed in the same sitting as the time required to discuss each individual case.
(5) The clarification of the opinion or the additional opinion shall not give rise to any special remuneration.
Entitlements of members of the expert corps for opinions on matters of original law.
(1) Members of the expert panels for opinions on matters of original law which have taken part in their meetings are entitled, without regard to the number of cases discussed for each starting hour, to the remuneration of the 120.- Cčs, presiding over the remuneration 240.- Cčs.
(2) In addition to the remuneration for participating in the College meeting referred to in paragraph 1, who was rapporteur (co-rapporteur) or co-rapporteur (co-rapporteur) shall be remunerated for each matter in which he was rapporteur (co-rapporteur) or in which he produced (co-rapporteur) the opinion.
(3) Otherwise, Article 13 (3) to (5) of this Regulation applies mutatis mutandis.
General provisions.
(1) The call for experts should be limited to the extent necessary. In dubious cases, the court ascertains in an appropriate manner before the regulation of the expert inquiry if it is at all capable of obtaining results that could be used in criminal proceedings.
(2) A specialist doctor should only be called upon if he requires a proper assessment of the matter of specific expertise.
(1) The scope of the expert's activity is either defined by a clear and precise indication of the object, purpose and, according to the circumstances of the case, the method of investigation and by the provision of brief but comprehensive reports from the files.
(2) If the court needs expertise on several subjects and if it is not certain that the examination of some of them will not be sufficient, then only some and experts will be asked to refrain from further investigations once they have achieved their purpose. The examination of these subjects must always be undertaken and the use of this method of investigation, according to which it is likely that a positive result can be found.
(3) Auxiliary persons (§ 8) entitled to remuneration may be recruited by the expert, if there is no delay, only with the permission of the court. As a rule, the auxiliary persons are to be obtained at the place where the expert is performed.
(4) The court's orders shall be indicated indicating the extent, subject matter, method and purpose of the investigation in the file and, if the experts have been given orally, their acceptance shall be confirmed in the file by signature.
For acts which the expert has carried out against a judicial order or order or in a manner contrary to the provisions of Paragraph 16 (2), second sentence, there shall be no remuneration or compensation. This is also true of the actions carried out by the expert without a court order, unless there is a danger of delay. It is also not a special reward (compensation) for supplementing the finding or assessment, the lack of which the expert himself caused.
(1) The investigating judge or court shall determine the remuneration or compensation only at the request of the expert who is entered in the record in writing or orally.
(2) The remuneration (compensation) is determined by a resolution to be delivered to experts and parties.
(3) The expert and the parties have the right to file a complaint against this resolution in accordance with the relevant provisions of the Code of Criminal Procedure. The complaint lodged by the public prosecutor shall have suspensory effect as regards the payment of the remuneration (compensation) of the contested complaints.
A expert who does not apply for remuneration or compensation within 14 days of the date of completion of his or her operation and, if the opinion is given, from the date on which the opinion is submitted shall cease to be entitled to it.
The presiding court may, with the approval of the Ministry of Justice granted in agreement with the Ministry of Finance, negotiate a special contract with the expert on his remuneration. In that case, the provisions of this Regulation shall not apply. However, even in such cases, persons who have been recognised as liable for reimbursement shall be required to pay compensation at the rates laid down in this Regulation.
All provisions contrary to this Government Regulation shall be repealed, in particular:
1. Government Order of 9 October 1923, No 192 Coll., regulating the fees of judicial practitioners and veterinary practitioners in criminal proceedings and in non-dispute proceedings, in so far as it relates to criminal proceedings,
2. Government Decree of 13 October 1927, No. 153 Coll., adjusting the fees of forensic chemists in criminal proceedings,
3. Paragraph 12 of the Decree of 13 October 1927, No 154 Coll., laying down the rules of organisation, procedure and fees of the medical court, and
4. Government Decree of 18 July 1939, No 187 of the SLA, on criminal investigation fees.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister of Justice in agreement with the Ministers involved.
