GOVERNMENT REGULATION

of 27 April 2022

amending Government Regulation No 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended

The Government orders pursuant to § 22 paragraph 1 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll., Act No. 34 / 2011 Coll. and Act No. 526 / 2020 Coll., ("the Act ') to implement Sections 2 (d) and 12 and 13 of the Act:

Government Decree No. 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended by Government Decree No. 391 / 2016 Coll., Government Decree No. 101 / 2018 Coll., Government Decree No. 146 / 2019 Coll., Government Decree No. 121 / 2020 Coll., Government Decree No. 344 / 2020 Coll. and Government Decree No. 334 / 2021 Coll., are amended as follows:

1. At the end of footnote 1, the sentences are added to separate rows

"Commission Delegated Directive (EU) 2021 / 1978 of 11 August 2021 amending, for the purposes of adapting to scientific and technical progress, Annex IV to Directive 2011 / 65 / EU of the European Parliament and of the Council as regards the exemption for use of bis (2-ethylhexyl) phthalate (DEHP), butylbenzylphthalate (BBP), dibutylphthalate (DBP) and diisobutyl phthalate (DIBP) in spare parts obtained from medical devices used for repair or renovation.

46. Bis (2-ethylhexyl) phthalate (DEHP) in plastic parts of coils for magnetic resonance detectors (MRI). Expires on 1 January 2024.

47. The substances bis (2-ethylhexyl) phthalate (DEHP), butylbenzylphthalate (BBP), dibutylphthalate (DBP) and diisobutyl phthalate (DIBP) contained in spare parts obtained from medical devices, including in vitro diagnostic medical devices and their accessories, and used for their repair or renovation, provided that the re-use is carried out within a controlled closed return system between undertakings and that the consumer is informed of any re-use of the parts. Expires on 21 July 2028. '

Čl. II

Efficacy

This Regulation shall enter into force on the day following that of its publication, with the exception of Article I, points 2 to 14, which shall take effect on 1 October 2022.
