GOVERNMENT DECLARATION
of 24 June 1964
adjusting the pensions of certain persons
The Government of the Czechoslovak Socialist Republic provides for social security under § 141 of Act No. 101 / 1964 Coll., on social security, and under § 142 of Act No. 103 / 1964 Coll., on social security of cooperative peasants:
(1) The County National Committees may reasonably reduce pension pensions (insurance) which they recognise to be excessively high, bearing in mind that they belong to:
(a) persons who, in public life or in the economy, took a particularly important position in the former political and economic establishment, or even in a period of infreedom, have used that position to maintain a capitalist order or to strengthen the influence of the occupants and have actively contributed to the exploitation and persecution of workers,
(b) former entrepreneurs who have exploited foreign labour;
(c) persons who, in the past political and economic establishment, in particular during the period of infreedom, as members of the suppressant apparatus, have acted with particular zeal and initiative against workers and thus effectively assist in their exploitation and persecution.
(2) The pensions of the survivors of the persons referred to in the preceding paragraph may likewise be reduced.
(1) In reducing pensions, account shall be taken of the degree of political and economic importance of the former status of those persons, the duration of the activity in that capacity and the harmful effects of that activity on workers.
(2) The pension will not be reduced if those persons or survivors, under the influence of the educational activities of a socialist society, have shown a positive attitude towards the socialist establishment, in particular if they have obtained work merit in building socialism in our country.
(3) Invalidity (partial invalidity) pension is not reduced if full (partial) invalidity is caused by an accident at work (occupational disease). in this case, the survivors' pensions shall not be reduced either.
Persons whose pension has been reduced under this decree or adjusted under similar provisions previously in force may be entitled to an increase by the District National Committee to the full legal amount provided that they have obtained the benefits of their employment under the influence of the educational activity of a socialist society or if there are other reasons worthy of special consideration.
National Defence and Interior Ministers shall determine which authorities are entitled to the measures provided for in this Order in respect of social security pensions of members of the armed forces.
This Decree shall take effect on 1 July 1964.
