DECLARATION
of 7 January 2022
amending Decree No. 363 / 2011 Coll., on Personnel Security and Safety Capability, as amended
The National Security Authority shall determine, pursuant to § 135 (f) and (j) of Act No. 412 / 2005 Coll., on the Protection of classified information and on security competence, as amended by Act No. 255 / 2011 Coll.:
Decree No. 363 / 2011 Coll., on Personnel Security and Safety Capability, as amended by Decree No. 415 / 2013 Coll. and Decree No. 400 / 2016 Coll., is amended as follows:
1. In the title of Section 10, the words "in the natural person questionnaire or in the questionnaire 'are deleted.
2. In Paragraph 10, the dot is replaced by a comma at the end of paragraph 1 and the following points (g) and (h) are added:
"(g) treatment in connection with alcohol consumption, the use of narcotic drugs or psychotropic substances or participation in gambling; or
(h) a change in the declaration of personality. ';
3. In Article 10 (2), the words "(b), (d) and (f) 'are replaced by" to (g)';
4. In Article 10 (3), "(b) and (d) 'is replaced by" to (e) and (g)';
5. In Annex 6, point 2.7 is added at the end of point 2:
"2.7 Relationship to the place of permanent residence (e.g. birth, on the basis of the official abolition of previous residence, property ownership, consent to the use of the property) '.
6. In Annex 6, point 3.8 is added at the end of point 3:
"3.8 Relationship to the address of another place of residence (for example property ownership, consent to the use of the property, rental right) '.
7. In Annex 6, the following point 4.7 is inserted after point 4.6:
"4.7 Relationship to the address for delivery (for example property ownership, consent to the use of the property, rental right) '.
Points 4.7 to 4.9 shall be renumbered 4.8 to 4.10.
8. In Annex 6, point 9.4, the word "fuses' is deleted.
9. In Annex 6, point 9.8, the words ", a share in a commercial corporation, virtual assets such as cryptocurrency, non-encumbered token - NFT work 'are added at the end of the text.
10. In Annex 6, at the end of point 9.11.5, the words "(for example, interest, amount of part outstanding) 'are added.
11. In Annex 6, point 11, the words "lasting and final 'shall be added at the end of the text in brackets.
12. In Annex 6, point 16 reads as follows:
"16. Use of a narcotic or psychotropic substance under the law governing the field of addictive substances and the consumption of alcohol, participation in gambling and treatment in connection with alcohol consumption, use of narcotic drugs or psychotropic substances or participation in gambling '.
13. In Annex 6, point 16.1.1, "Species' is replaced by" Detailed statement (e.g. frequency and duration of use in the past and at present, including one-off experience, species used and quantities of narcotic drugs or psychotropic substances, circumstances of use / use) '.
14. In Annex 6, point 16.1.2 is deleted.
15. In Annex 6, at the end of point 16.2.1, the words "(for example, the frequency of consumption in the past and at present, the species and quantities to be consumed, the circumstances of consumption, stays at an alcohol holding) 'are added.
16. Point 16.3 of Annex 6 reads as follows:
"16.3 Participation in gambling within the meaning of the gambling law (for example, odds, technical games, live games)."
17. In Annex 6, point 16.3.1, the words "with regard to 'are deleted, after the word" frequency', the words "/ inserted 'are deleted, and the words" weekly / monthly, overall balance' are inserted after the word "amount '.
18. Point 16.4 of Annex 6 reads as follows:
"16.4 Treatment related to alcohol consumption, use of narcotic drugs or psychotropic substances (problematic use, harmful use, addiction) or participation in gambling, both in the past and at present."
19. In Annex 6, at the end of point 16.4.1, the words "(e.g. treatment period and method, name of establishment or name of expert) 'are added.
Efficacy
This Decree shall take effect on 1 July 2022.
