DECLARATION
of 7 January 2010
amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll. and Act No. 227 / 2009 Coll., ("the Act ') for implementation of Sections 5 (3), 10 (3) and 51a (3) of the Act:
Decree No. 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended by Decree No. 356 / 2004 Coll., Decree No. 389 / 2004 Coll., Decree No. 214 / 2005 Coll., Decree No. 36 / 2007 Coll., Decree No. 316 / 2007 Coll. and Decree No. 288 / 2008 Coll., is amended as follows:
1. Paragraph 1, including footnotes 1 and 1a, reads as follows:
This decree implements the relevant provisions of the European Community1) and, following the directly applicable regulations of the European Community1a), regulates
(a) general measures to combat and prevent the spread of animal diseases;
(b) the manner and time limits for the notification of diseases;
(c) the procedure, the processing aspects and the content of contingency plans for the occurrence of certain dangerous diseases;
(d) for which diseases animal health programmes are drawn up;
(e) animal health conditions and rules on animal vaccination;
(f) requirements for national reference laboratories;
(g) measures to combat and prevent the spread of certain dangerous diseases;
(h) the aspects under which the recognition of herds, holdings, zones or states is to be carried out as disease-free.

Council Directive 80 / 1095 / EEC of 11 November 1980 laying down the conditions for the establishment of a Community territory free of classical swine fever and for the maintenance of that territory free of classical swine fever, as amended. Council Directive 2002 / 99 / EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption.
(1a) Regulation (EC) No 999 / 2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies, as amended. Commission Regulation (EC) No 1266 / 2007 of 26 October 2007 laying down detailed rules for the application of Council Directive 2000 / 75 / EC as regards the control, monitoring, surveillance and restrictions on movements of certain animals of susceptible species in relation to bluetongue, as amended. Regulation (EC) No 1774 / 2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption, as amended. '
2.
(1) The State Veterinary Administration shall, in accordance with Article 48 (1) (c) of the Act, draw up and update, in accordance with the criteria set out in Annex 3 to this Regulation and in accordance with the principles for drawing up contingency plans, national contingency plans for the occurrence of the diseases listed in Annex 1 to this Regulation and, where required, of certain other dangerous diseases. Those plans shall include comprehensive rules to ensure an effective and coordinated procedure for the implementation of emergency veterinary measures to control and prevent the spread of the disease and ensure the availability of everything deemed necessary for the rapid eradication of outbreaks, including buildings, equipment, devices and materials.
(2) The Regional Veterinary Administration shall draw up and update regional contingency plans in accordance with national contingency plans and taking into account local conditions.
(3) The State Veterinary Administration shall submit national contingency plans to the Commission for approval. "
3. In Paragraph 4 (1), the word "of character 'shall be inserted after the words" relating'.
4. In Article 4 (2), the words "and the Municipal Veterinary Administration in Prague (the Regional Veterinary Administration) 'are deleted.
5. Sections 5 and 6, including the title and footnotes No 1b and 1c, read:
"Animal healing programmes
(1) The State Veterinary Administration shall, taking into account the state and development of the disease situation, draw up draft annual or multiannual programmes for the recovery of animals from certain dangerous diseases, in particular from the diseases referred to in the Decision of the European Communities on expenditure in the veterinary field (1b).
(2) Animal health programmes are drawn up as programmes for the eradication, control and monitoring of a disease.
(1) Where a financial contribution from the European Union (hereinafter referred to as "the Union") is required to finance the animal welfare programme, the State Veterinary Administration shall act in accordance with the Decision of the European Communities on expenditure in the veterinary field (1c).
(2) The animal welfare programme contains the information required by the decision of the European Communities on expenditure in the veterinary field (1c).
(1b) Article 27 and Annex I to Council Decision 2009 / 470 / EC.

6. Article 7 to 9, including the title and footnotes 1d, 1e and 1f, read:
"Disease reporting
(1) The State Veterinary Administration shall report to the Commission and the other Member States on the occurrence of disease from diseases referred to in European Community rules on disease notification (1d).
(2) The State Veterinary Administration shall report in accordance with paragraph 1:
(a) a primary outbreak of the disease referred to in paragraph 1, detected in the territory of the Czech Republic;
(b) after the last outbreak of that disease has been disposed of, the end of the protection and control measures introduced to control it.
(3) The report referred to in paragraph 2 shall be submitted directly by the State Veterinary Administration to the Commission and to the other Member States within 24 hours of:
(a) the detection of the primary outbreak referred to in paragraph 2 (a);
(b) the end of the safeguard and enforcement measures referred to in paragraph 2 (b).
(4) If there is an outbreak of classical swine fever, it is sufficient to provide the Commission and the other Member States with the information provided for in Article 39.
(5) The report contains the information set out in Annex 2 to this Decree; it is transmitted by telex using the codified form and codes established by the Decision of the European Communities on the method of reporting the disease (1e).
(1) The State Veterinary Administration shall also report directly to the Commission any additional (secondary) outbreak of the disease referred to in Section 7 (1) found in the Czech Republic.
(2) The report referred to in paragraph 1 shall be submitted by the State Veterinary Administration not later than the first working day of each week and shall cover the week ending at midnight on the Sunday preceding the report.
(3) Paragraph 7 (5) shall apply mutatis mutandis to the content and manner of transmission of reports.
The State Veterinary Administration shall report to the International Office of Disease (OIE) the occurrence of diseases in accordance with the decision of that Office on the single list of diseases and on the introduction of a new reporting system1f).

7. In Paragraph 10 (1) of the Introductory Part of the provision, the words "in the cases and under the conditions laid down in the provisions of the European Communities and this Decree 'shall be inserted after the words" only'.
8. in Article 10 (1) (b):
"(b) The Commission has taken a decision to supplement the protection and control measures concerning vaccination of animals."
9. In Section 10, paragraphs 3 and 4 are added, including footnote 1g:
"(3) In the protection and control measures allowing vaccination of animals, the veterinary authorities shall lay down detailed conditions:
(a) the implementation and course of vaccination;
(b) the procedure where clinical signs of the disease in the vaccinated animal are detected or killed.
(4) Only registered vaccines and other substances authorised for use in the provision of veterinary care are eligible for vaccination.
1g) Sections 9 and 25 of Act No. 378 / 2007 Coll., on Medicines and on Amendments to Certain Related Acts (Act on Medicines), as amended by Act No. 296 / 2008 Coll. '.
Article 10 (11) and (12) read:
(1) Where the provisions of the European Communities so require on measures to prevent and combat diseases, the veterinary authorities shall require the protection and control measures to ensure that all vaccinated animals:
(a) have been identified by means of a clear and easily legible indication in the manner laid down by the provisions of the European Communities on measures to prevent and combat diseases and, where appropriate, in the manner laid down by the State Veterinary Administration;
(b) remain in the vaccination area except for those animals which are sent to slaughterhouses designated by the Regional Veterinary Administration for immediate slaughter. They may be moved only after examination of all animals of susceptible species on the holding by an official veterinarian confirming that none of the animals examined are suspected of being infected.
(2) Where vaccination of animals is completed, the movement of animals of species susceptible to the detected disease from the vaccination zone may be allowed only on the basis of the measures taken by the Commission after the expiry of the period laid down by it.
(3) The State Veterinary Administration shall regularly inform the Commission, through the Standing Committee on the Food Chain and Animal Health (the Standing Committee), of the results of the vaccination carried out.
By way of derogation from Article 10 (1), emergency vaccination may only be decided upon after the Commission has informed the Commission of this measure and unless this affects the essential interests of the Union in the field of animal health. This decision shall take into account, in particular, the degree of concentration of animals in the areas concerned, the need to protect individual herds and holdings and the geographical area where vaccination is carried out. The next emergency vaccination procedure shall depend on whether the Union institutions agree to continue it or whether they conclude that the measures concerning such vaccination need to be amended, extended or terminated. ';
11. in Article 13 (1) (b) (1) and (2):
"1. has combined all animals of species susceptible to the disease and recorded for each category the number of animals already dead, infected and suspected. In addition, they shall order the breeder to update these data in order to take into account animals born or dead during the period of suspicion and to submit them on request to the authorities carrying out national veterinary surveillance in order to be able to check them during each inspection carried out on the holding,
2. all animals of species susceptible to the disease in question which are on the holding have been kept at their housing sites and, where appropriate, at other places allowing their quarantine and ensuring that they are not moved from or to the holding. However, the regional veterinary administration shall take into account the possible role of vectors, as appropriate. ';
12. Paragraph 13 (2), including footnote 1, reads:
"(2) Any movement of persons, animals of other species, not susceptible to the disease, means of transport, animal products, carcases of dead or killed animals and other animal by-products not intended for human consumption (1h), tools, feed, bedding, manure, urinals and other objects or materials which may carry disease agents from or to the holding shall be subject to the approval of the Regional Veterinary Administration in accordance with Sections 13 and 49 (1) (d) of the Act, which also lays down the conditions for preventing any risk of spread of the disease.
1h) Article 2 (1) (a) of Regulation (EC) No 1774 / 2002 of the European Parliament and of the Council. '
13. in Article 13 (3) (c), the words "confiscates of animal origin" shall be replaced by the words "animal by-products" and the words "litter" shall be replaced by "bedding."
14. In Paragraph 14 (1), the word "contact 'is inserted after the word" contact', and the words "which, due to their location, layout or contact with a holding where there is a suspicion of the presence of the relevant disease, may be considered as being reasonably suspected of possible contamination 'are deleted.
15. In § 14 (2), § 40 (4), § 54 (6) of the introductory part of the provision, § 54 (7) of the introductory part of the provision, § 81, § 86 (3), § 87 (2), § 92 (2), § 149 (2), § 157 (2) and § 170 (4), the word "repealed" is replaced by "terminated."
16.
(1) Where the presence of one of the diseases listed in Annex 1 to this Regulation has been confirmed on the holding, the Regional Veterinary Administration shall carry out an epidemiological inquiry in accordance with Article 13 (3) and shall, in accordance with Articles 15 and 49 (1) (d) of the Law on protection and control measures referred to in Article 13 (1) (b) and (2), order further protective and control measures, namely:
(a) the immediate killing and, where appropriate, the slaughter of all animals of susceptible species on the holding. The carcases of dead and killed animals shall be disposed of in the rendering plant, or burned or buried where possible on the spot, in accordance with the directly applicable European Community Regulation laying down health rules for animal by-products (2). Such activities shall be carried out in such a way as to minimise the risk of spreading the disease agent;
(b) disposal or appropriate treatment or treatment of certain objects or materials, such as tools, feed, bedding, manure and urinals, which may transmit the disease agent. This treatment, carried out in accordance with the instructions of the Regional Veterinary Administration, is intended to ensure the destruction of the disease agent or its vector;
(c) after compliance with the protective and protective measures referred to in (a) and (b) cleaning and disinfection, where appropriate, disinsecting and exerting buildings in which animals of susceptible species are housed and their immediate surroundings, as well as means of transport and any equipment likely to be contaminated, in the manner and under the conditions set out in Article 21.
(2) Where the burial of carcases of dead and killed animals and other animal by-products is ordered, they shall be carried out at the burial sites specified in the emergency plans of the county or contingency plans. If it is not possible to use these burial sites, burial is carried out at sufficient depth (Section 40 (4) of the Act) so that these carcases and other animal by-products which may be carriers of the disease cannot be dug up by carnivorous animals and in a suitable place to prevent contamination of the groundwater and any pollution of the environment.
(3) The protection and control measures referred to in paragraph 1 may be extended to contact holdings where there are grounds for suspecting their possible infection.
(4) The national crisis centre and the regional crisis control centres coordinate protective and control measures to combat the disease as quickly as possible, as well as to carry out an epidemiological investigation.

17. in Paragraph 16 (1):
"(1) The Regional Veterinary Administration may, in accordance with Articles 15 and 49 (1) (d) of the Act, on an infected holding consisting of 2 or more separate production units, waive the requirements laid down in Article 15 (1) (a) in the case of infested production units, provided that the official veterinarian confirms that:
(a) the structure and size of these units and the activities carried out under them guarantee their separation as regards stables and equipment, feed, feeding and personnel; and
(b) their separation makes it impossible to transmit the disease from one unit to another. "
18. In Section 16 (2) of the introductory part of the provision, the words "in accordance with Sections 13 (1) (b) and 49 (1) (f) of the Act 'are deleted.
19. Paragraph 17 (1) reads:
"(1) If the presence of the disease has been confirmed, the Regional Veterinary Administration shall establish a protection zone with a radius of not less than 3 km and a surveillance zone with a radius of not less than 10 km, if necessary an additional restricted zone. ';
20. In Article 17, at the end of paragraph 3, the words "and for the application of these measures' shall be added.
21. In § 17 (5), § 23, § 27 (1) (c), § 41 (3), § 42 (2), § 44 (2) (c), § 45 (2) (c), § 50 (1) of the introductory part of the provision, § 50 (2), § 51 (2), § 54 (1) of the introductory part of the provision, § 54 (5) (a), § 54 (8) (b), § 55 (2) of the introductory part of the provision, § 58 (3), § 90 (2), § 90 (4), § 97 (1) (a) (4), § 97 (b) (3), § 173 (4) (a) and (b) the words "§ 10 (2) shall be deleted.
22. in Article 18 (1) (d), the words "under the supervision of an official veterinarian" shall be inserted after the word "transport" and the words "for slaughter" shall be replaced by the words "for immediate slaughter."
23. in Paragraph 18 (3):
"(3) The State Veterinary Administration shall inform the Commission and the other Member States of the measures taken through the Standing Committee."
24. in Article 19 (1) (d), the words "under the supervision of an official veterinarian" shall be inserted after the words "transported" and the words "necessary" shall be replaced by "immediate."
25. in Article 20 (1) (c), the words "registered and" shall be inserted after the words "registered and" and the words "with special legislation" shall be replaced by the words "with breeders' law."
26. In Section 21 (1) of the Introductory Part of the provision, the words "in accordance with Sections 13 (1) (c) and 49 (1) (d) of the Act 'are replaced by the words" in the framework of safeguard and enforcement measures'.
27. in Article 21 (2), the words "in accordance with Articles 13 (1) (c) and 49 (1) (d) of the Act" shall be deleted;
28. (1) Samples taken for laboratory testing to detect the presence of the disease agent shall be examined in accordance with Section 52 (4) of the Act by the national reference laboratories, competent for each disease, or by reference laboratories, technically and staffing, so that they can detect at any time, in particular when the disease is first present, the type, subtype and variant of the agent concerned, as well as other laboratories referred to in Section 52 (3) of the Act. They shall apply diagnostic methods established in accordance with individual procedures and methods approved by the Union authorities for the diagnosis and control of the relevant disease or otherwise in accordance with the provisions of the European Communities on disease prevention and control measures.
(2) National Reference Laboratory
(a) be responsible for coordinating the standards and diagnostic methods used in the diagnosis of the diseases concerned and for testing vaccines;
(b) may provide diagnostic reagents to other diagnostic laboratories;
c) checks the quality of diagnostic reagents used in the Czech Republic;
(d) carry out regular comparative tests on the diagnostic methods used;
(e) keep isolates of the viruses of the relevant diseases from cases confirmed in the Czech Republic;
(f) ensure confirmation of positive results obtained in other diagnostic laboratories;
(g) cooperate with the relevant reference laboratories within the Union.
(3) The State Veterinary Administration shall keep and keep up to date the list of national reference laboratories and make it available, including any subsequent amendments, to the other Member States and to the public. '
30. In Article 26 (b), the words "in other herds where seropositive pigs have been detected. In this case, the Regional Veterinary Administration shall carry out additional tests, in particular new tests with samples taken at least 28 days after the previous sampling, before confirming the presence of swine vesicular disease 'is replaced by" in other herds where seropositive pigs are found. In this case, further testing shall be carried out by the Regional Veterinary Administration prior to the confirmation of the presence of the disease, in particular re-random testing at a distance of at least 28 days from the previous sampling.'
31. in Article 27 (1) (a), the words' pigs within the zone 'shall be replaced by' animals of species susceptible to the disease ';
32. in Article 27 (1) (b), the words "with pigs" shall be replaced by the words "with animals of species susceptible to this disease" and the words "pigs" shall be replaced by the words "animals."
33. in Article 27 (1) (d), the word "used" is replaced by the word "used" and the word "litter" is replaced by "litter."
34. in Article 27 (1) (e) (1) and (2), the words "tagged in accordance with special legislation (m3)" shall be replaced by "registered and tagged in accordance with breeding law (m3)";
35. in Paragraph 27 (1) (f) (1) of footnote 4:
"(4) Paragraph 3 (3) of Decree No 289 / 2007 Coll., on animal health and veterinary requirements for animal products not covered by the directly applicable provisions of the European Communities."
36. in Paragraph 27 (2) (b), "housing" is replaced by "farming."
37. in Article 27 (5), the words "competent authority at the owner's reasoned request" shall be replaced by the words "Regional Veterinary Administration at the breeder's reasoned request."
38. In Section 28 (1) of the introductory part of the provision, the words "Paragraph 13 (1) (b) 'are deleted.
39. in Article 28 (1) (a):
"(a) an inventory of all pig holdings;"
40. in Article 28 (1) (b), the words "within the surveillance zone" shall be replaced by the words "from a holding in the zone" and the words "directly" shall be deleted;
41. in Paragraph 28 (1) (c) (3), the word "transported" is replaced by "transported."
42. Paragraph 28 (1) (c) (4) and (5) read as follows:
"4. each pig has been registered and marked in accordance with the breeding law),
5. the means of transport, equipment and equipment used to transport these pigs have been cleaned and disinfected after transport; ';

46. in Paragraph 29 (1) (b), the word "contaminated" shall be replaced by "infected."
47. in Article 29 (1) (c) (2), the words "infected and contaminated" shall be replaced by the words "infected" and the words "in such a way as to avoid the risk of spreading the swine vesicular disease virus" shall be replaced by "under the supervision of an official veterinarian in such a way as to avoid the risk of spreading swine vesicular disease."
48. In Paragraph 30 (2) of the Introductory Part of the provision, the words "in the case 'are replaced by the words" taking into account the type of agricultural activity carried out on the holding. In case'.
49. in Paragraph 30 (2) (b) (1), the words "the area in which" are replaced by the words "the zones in which."
50. Article 31 and 32, including footnote 5, read:
For the purposes of this Title:
(a) animal of susceptible species - each ruminant;
(b) animals - animals belonging to susceptible species, except wild animals for which specific measures may be taken by the Union institutions;
(c) vector - Culicoides able to transmit bluetongue to be detected in accordance with the procedure laid down in European Community rules on disease prevention and control measures.
(1) Where there is one or more animals of a susceptible species suspected of the disease on a holding situated in an area which is not subject to restrictions as a result of protection and control measures ordered in relation to the occurrence or suspected occurrence of bluetongue, the Regional Veterinary Administration shall, in accordance with Articles 13 and 49 (1) (d) of the Law:
(a) immediately initiate monitoring of the holding and investigations to confirm or rule out the presence of the disease, to carry out clinical investigations on suspected and dead animals or to provide for their autopsy;
(b) ensure that an inventory is made of places which may allow the vector to survive or host it, in particular places suitable for reproduction;
(c) order the breeder in particular to:
1. make an inventory of animals of susceptible species, indicating for each species the number of animals already dead and infected, as well as animals that may have been infected. The inventory data shall be updated by the breeder to take into account animals born or dead during the period of suspicion and, on request, to submit them to the authorities carrying out national veterinary surveillance for inspection and verification,
2. comply with the prohibition on any movement from or to a holding of animals of susceptible species;
3. Restricted the possibility of movements of animals of susceptible species, including their stay outside the stable, at the time of activity of vectors, where it can be assumed that there are means of implementing this measure,
4. Treated regularly animals of susceptible species, buildings used for housing and their surroundings, especially places favourable to vectors, approved insecticidal agents. The frequency of treatment shall be determined by the Regional Veterinary Administration taking into account the duration of the insecticide used and the climatic conditions,
5. ensure, in accordance with the directly applicable European Communities Regulation laying down health rules for animal by-products (2), the disposal of carcases of animals dead on the holding.
(2) The Regional Veterinary Administration, in accordance with the directly applicable Regulation of the European Communities on implementing provisions for Council Directive 2000 / 75 / EC as regards the control, monitoring, surveillance and restrictions on movements of certain animals of susceptible species in relation to bluetongue (5),
(a) carry out an epidemiological inquiry;
(b) implement programmes for the monitoring of bluetongue in restricted zones and for the surveillance of bluetongue outside restricted zones;
(c) provide data on bluetongue collected during the application of the programmes referred to in point (a) to the State Veterinary Administration which fulfils the information obligations under the directly applicable European Community Regulation on the implementing provisions for Council Directive 2000 / 75 / EC as regards the control, monitoring, surveillance and restriction of movements of certain animals of susceptible species in relation to bluetongue (5).
(3) Pending the introduction of the measures referred to in paragraph 1, animals of a susceptible species shall not be moved from or onto the holding and their movement at the time of activity of the vectors shall be restricted as far as possible.

51. in Articles 33 (2) and 96, the word "withdrawn" shall be replaced by "terminated."

In § 34 (1) (a) of the Introductory Part of the Provisions, § 41 (1) of the Introductory Part of the Provisions, § 82 (1) of the Introductory Part of the Provisions, § 92 (3) of the Introductory Part of the Provisions and § 97 (1) (a) of the Introductory Part of the Provisions, the words "competent authority" are replaced by the words "Regional Veterinary Administration."
53.In Article 34 (1) (a) (1) and Article 36 (1) (b), the word 'ruminants' is replaced by 'animals of a susceptible species'.
54. In § 34 (1) (a) (2), § 95 (1) (c) (5), § 97 (1) (a) (2) and § 150 (1) (i), the words "with special legislation (m2)" shall be replaced by the words "with a directly applicable European Communities Regulation on health rules for animal by-products (2)."
55. In § 34 (1) (a) (4), § 37 (2), § 38 (c), § 100 (2) and § 172 (b) and (c), the words "in accordance with § 10 (2) and § 48 (1) (o) (2) of the Act" shall be deleted.
56. in Article 34 (1) (a), the words "; the State Veterinary Administration shall inform the Commission of the initiation of vaccination" shall be added at the end of the text in point 4.
57. in Paragraph 35 (2), the words "in which" shall be replaced by "in which."
