Decree on conditions for recognition of equivalence and nostallization of certificates issued by foreign schools

of 29 December 2004
on the conditions for the recognition of equivalence and nostallization of certificates issued by foreign schools
The Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry ') provides, pursuant to § 108 (8) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act):
§ 1
Conditions for recognition of equivalence
Certificate of recognition of equivalence abroad issued by a graduate of a foreign school for basic, secondary or higher vocational education (hereinafter referred to as the "Foreign Certificate ') in the Czech Republic (1) shall be issued in accordance with the model set out in Annex No 1 within 30 days of the date of receipt of the application for its issue by the Regional Office.
§ 2
Conditions of nostallization
(1) The Regional Authority issues a nostrafication clause on the recognition of the validity of a foreign certificate in the Czech Republic (hereinafter referred to as the "nostallization clause") in accordance with the model set out in Annex 2 where the decision on the application for nostafikaci2 is positive; the notation clause is part of that Decision.
(2) The Nostrified Foreign Certificate is valid on the territory of the Czech Republic from the date on which the decision on nostallization was taken.
§ 3
Conditions of organisation of the nostrification test
(1) The nostrification examination shall verify that the knowledge and skills of the applicant correspond to the objectives and content of the training according to the relevant training programme3). A practical test may be part of the novification test. The Nostrification Test is usually held in the Czech language; in another language (4), in agreement with the applicant and the Regional Authority, a novification test may take place if this does not affect the purpose of the test.
(2) The nominee examination, the term and content of which are determined by the Regional Office, is carried out by the applicant at the school, selected by the Regional Office from primary schools, secondary schools, conservatories and higher vocational schools located in the territory of the Region. In the absence of a primary, secondary or higher vocational school or conservatory in the territory of the region, which corresponds to the content and scope of its training programme or at least partly to the foreign school which issued the foreign certificate, the corresponding school in which the notation test will be conducted may be selected from schools located in the territory of another region.
(3) The registration test shall be held before a committee of at least three members whose chairman and other members are appointed by the Regional Office.
(4) The committee shall decide by voting on the evaluation of the overall result of the notation test. In the event of a tie, the President of the Commission shall vote.
(5) A report shall be drawn up on the notation test.
§ 4
Recognition of Foreign Education by Ministry, Ministry of Interior and Ministry of Defence
(1) The provisions of paragraphs 2 and 3 shall apply mutatis mutandis to the Ministry's procedure for notarification of the foreign certificate issued by a foreign school with an educational programme, which is carried out in agreement with the Ministry in 5).
(2) Paragraph 1 to 3 shall apply mutatis mutandis to the procedure of the Ministry of the Interior for the recognition of foreign education in the field of police and fire protection activities and the Ministry of Defence in the recognition of foreign education in the field of military.
§ 5
Repeal
The following shall be deleted:
1. Decree No. 385 / 1991 Coll., on the recognition of the equivalence and conditions of nostallization of certificates issued by foreign schools.
2. Decree No. 332 / 1998 Coll., amending Decree of the Ministry of Education, Youth and Sports of the Czech Republic No. 385 / 1991 Coll., on the recognition of equivalence and conditions of nostallization of certificates issued by foreign schools.
3. Decree No. 236 / 2003 Coll., amending Decree No. 385 / 1991 Coll., on the recognition of equivalence and conditions for the notation of certificates issued by foreign schools, as amended by Decree No. 332 / 1998 Coll., and Decree No. 127 / 1997 Coll., on special schools and special maternity schools.
§ 6
Efficacy
This decree shall take effect on the day of its publication.
