Ordinance of the Federal Ministry of the Interior on the Demonstration of Jurisdiction with the National Security Corps and Authorisation to carry out its tasks

Federal Ministry of the Interior
of 18 January 1979
on the demonstration of competence with the National Security Corps and the authorisation to carry out its tasks
The Federal Ministry of Interior provides, pursuant to Section 17 of Act No. 40 / 1974 Coll., on the National Security Corps ("the Act '):
Demonstration of membership of the National Security Corps
§ 1
(1) In the exercise of their powers under the law and other legislation, members of the National Security Corps (hereinafter referred to as "members") demonstrate their competence to the National Security Corps by the following means:
(a) a uniform national;
(b) a service pass;
(c) a badge of criminal service;
(d) oral declaration (1)
(2) The demonstration of competence referred to in paragraph 1 shall be governed by the character of specific service operations, operations or other professional activities (hereinafter referred to as "the service ') and by the exercise by members of their competence in uniform or in civil clothes.
§ 2
(1) Members exercising their powers in a uniform manner shall demonstrate their competence to the National Security Corps in a uniform manner and, where appropriate, by oral declaration; except by means of a service card:
(a) upon entry into undertakings, establishments, offices, institutes, etc., where the entry is controlled by a member of the racing guard or by another authorised person;
(b) if they are requested to do so in the course of a service operation.
(2) The members referred to in paragraph 1 shall be shown in a uniform manner and, where appropriate, by oral declaration:
(a) if they act under a uniform command in emergency situations and in other mass actions threatening public policy;
(b) for surveillance of objects and other similar services;
(c) persons affected by the operation, in particular:
- drunk and committing a riot or other inappropriate behaviour,
- caught committing intentional criminal acts,
- an armed firearm or stabbing weapon, a mass-efficiency weapon or other subject capable of seriously endangering human life or health,
- refugees from the execution of a prison sentence or detention,
- which, at the order of the prosecutor or of the court, are to be detained and delivered to custody or at the order of the court, until the execution of the sentence of imprisonment,
- presented and summoned,
- which are subject to a nationwide search;
(d) persons who have come to the service room of the National Security Corps for notification or enquiry.
§ 3
(1) Members exercising their powers in civil clothing demonstrate their competence with the National Security Corps before commencing the service with an oral declaration and a service card or badge of a criminal service.
(2) In the cases referred to in Article 2 (2) (a), (b), (c) and (d), the members referred to in paragraph 1 shall only be proved by oral declaration. other means, i.e. a service card or badge of criminal service, only where circumstances permit it.
Demonstration of an authorisation to perform the tasks of the National Security Corps
§ 4
(1) Workers of the authorities called upon to perform the tasks of the National Security Corps pursuant to Article 51 (1) and persons called pursuant to Articles 51 (2) and (3) and 52 (1) of the Act (hereinafter referred to as "the persons called") in the exercise of their powers, as laid down by law and other legislation, demonstrate the following powers:
(a) their prescribed uniform with an outer marking;
(b) a certificate confirming the authorisation to carry out the tasks of the National Security Corps (hereinafter referred to as "the Card");
(c) oral declaration (2)
(2) The external marking referred to in paragraph 1 (a) is a red-coloured sleeve, 100 mm wide with black letters "SNB" of a height of 60 mm and a width of 30 mm to be worn on the left.
§ 5
(1) Soldiers of the troops of the Ministry of Interior, the Czechoslovak People's Army, members of the People's militia, the Department of Correctional Education and the public fire services appointed to carry out the tasks of the National Security Corps pursuant to § 51 (2) and (3) of the Act demonstrate the following authority:
(a) by his prescribed uniform with the external marking and, where appropriate, by oral declaration; in the cases referred to in Article 2 (1) (a) and (b), they shall always be required to prove themselves by means of a licence;
(b) an oral declaration and a certificate where they exercise jurisdiction in civil clothing.
(2) Workers of the authorities called pursuant to Article 51 (1) of the Act, soldiers of the army of the Ministry of Interior called in the long term pursuant to Article 51 (2) of the Act and soldiers from the occupation of the Czechoslovak People's Army called in accordance with Article 52 (1) of the Act for the performance of the tasks of the National Security Corps demonstrate this authorisation by oral declaration and identification.
(3) In the cases referred to in § 2 (2) (a), (b), (c) and (d)
(a) the persons referred to in paragraph 1 who exercise their powers in their prescribed uniform with an outer marking shall be shown only by their prescribed uniform with an outer marking and, where appropriate, by an oral declaration;
(b) the persons referred to in paragraph 1 who exercise their competence in civil clothing and the persons referred to in paragraph 2 shall be shown only by an oral declaration; a licence only if circumstances permit.
Common and final provisions
§ 6
Members and persons called upon in the exercise of their powers may not, in any case, hand over the documents referred to in paragraphs 1 (1) (b) and 4 (1) (b); they shall, on request, only give access to their first party and, where appropriate, communicate their registration number. In doing so, they shall not be obliged to disclose their name, surname, rank or function.
§ 7
The Federal Ministry of Interior Decree No. 42 / 1974 Coll., on Proving Jurisdiction with the National Security Corps is hereby repealed.
§ 8
This Decree shall take effect on 1 March 1979.
