of 12 November 1984
implementing the Civil ID Act
The Federal Ministry of the Interior provides, in an agreement with the participating central authorities pursuant to Sections 2 and 13 of Act No. 75 / 1957 Coll., on Civil Documents:
Issue of civil certificates
(1) Civil ID is issued to citizens of the Czech and Slovak Federal Republic (hereinafter referred to as "citizens") over 15 years of age by the District Administration of Public Security of the District Command of the Slovak Republic, in whose district the citizen is declared permanent residence.
(2) Citizens who are 15 years of age in a calendar year may also be issued with their identity cards before reaching that age, provided that they are handed over in a mass, solemn manner.
(3) A citizen's card is not issued to citizens who are not resident on the territory of the Czech and Slovak Federal Republic.
Documents needed for issuing the identity card
(1) A citizen who applies for the issue of his first identity card in the calendar year in which he reaches the age of 15 must submit:
(a) birth certificate;
(b) two sharp, non-retreaded, non-woven black and white photographs made of the same negative on a smooth, shiny half-carton with a diameter of 3,5x4,5 cm, of which the lower white edge is 0,5 cm wide, showing a citizen in a three-quarter profile, in civil clothing, without headgear and without glasses with dark glasses, the height of the face part of the head (from the eyes to the chin) of at least 13 mm ("photographs"),
(c) proof of birth number, (1) if the birth number is not indicated on the birth certificate.
(2) A citizen who applies for the issue of his first identity card after returning his / her legal capacity shall submit:
(a) birth certificate (birth certificate and birth certificate),
(b) two sharp, non-threaded photographs made of the same negative on a smooth, shiny half-carton or made by an apparatus with simultaneous exposure to multiple lenses, measuring 3,5 x 4,5 cm, showing a citizen in a three-quarter profile, in civil clothing, without headgear and sunglasses with dark glasses, height of the face part of the head (from the eyes to the chin) of at least 13 mm ("photographs"),
(c) a decision by the court on the return of eligibility to legal acts provided for in the rule of law;
(d) proof of the birth number if the birth number is not indicated on another document submitted.
(3) A citizen who applies for the issue of his first identity card after obtaining Czechoslovak citizenship or his permanent residence abroad is obliged to submit:
(a) birth certificate (birth certificate and birth certificate),
(b) two photographs;
(c) proof of grounds for issuing a citizen's card (e.g. proof of Czechoslovak citizenship),
(d) a document of the status (marriage certificate, court decision on divorce of a marriage or a declaration of invalidity, accompanied by a clause of legal authority, a death certificate of the spouse or a decision of the court on the declaration of the spouse's death provided by a legal instrument), if the citizen is married, divorced or widowed,
(e) birth certificates of children (adopted) under the age of 15 (hereinafter referred to as "children"), if they are parents or adopters,
(f) proof of the birth number and, if married, proof of the birth number and place of birth of the spouse, provided that such information is not shown on another document submitted.
(1) When applying for a new identity card, the citizen is obliged to present his current identity card and two photographs.
(2) If a citizen applies for a new identity card and cannot present the current identity card, although it has already been issued to him, he shall submit:
(a) a certificate of surrender, loss or theft of the identity card;
(b) two photographs;
(3) A citizen who has been refunded to legal proceedings is required to submit, in addition to two photographs, a decision by the court to return to legal proceedings provided for in the rule of law.
(4) If a citizen applies for a new identity card after the termination of his permanent residence abroad, he shall submit, in addition to two photographs, a certificate of surrender of a travel document authorising him to stay abroad and, if a man older than 19 years, also a card of goal, a military book, a release note or a certificate of incapacity for military active service for consultation and copying of relevant data.
(5) In addition to the documents referred to in paragraph 1 or, where appropriate, in paragraphs 2, 3 or 4, a citizen is required to submit:
(a) the birth certificate (birth certificate and birth certificate), if it had no parent details on the current identity card or if it had an existing identity card issued after the change of surname and no surname on it;
(b) the marriage certificate and, where applicable, the proof of the spouse's birth number if he is married and has not had on the current identity card details of the spouse (name, surname, surname, birth number and place of birth);
(c) proof of the birth number, if the birth number did not appear on the current identity card and does not appear on another document presented,
(d) proof of the birth number of the children, if they did not appear on the current identity card.
(6) If the reason for the issue of a new identity card is a change in the surname, name or birth number, or if a citizen simultaneously requests the identification of a new identity card, he shall also be required to provide proof of that change or a document confirming a new entry.
(7) If, at the time of the issue of a new citizenship card, a citizen simultaneously applies for the registration of an academic degree, academic-scientific degree, a status mark or any other degree of graduate of a university which he did not have on his current citizenship card, he is required to submit the relevant document (e.g. diploma, university certificate, proof of the composition of the state rigorous examination or rigorous examination) .2). When two or more titles are obtained, only one of these titles is recorded before the citizen's surname; the remaining titles are entered under the heading "Special records' at the request of the citizen.
(1) At the invitation of the district administration of the National Security Corps, a citizen is required to submit evidence of Czechoslovak citizenship if there is doubt about his citizenship. 3)
(2) Instead of a matrix document issued by an authority of a foreign state, a citizen is required to submit an extract of the special matrix.
(3) At the invitation of the District Administration of Public Security or the District Headquarters of the Slovak Republic, a citizen is required to submit a decision by the Supreme Court of the Czech and Slovak Federal Republic, together with the decision of the foreign court, on the recognition of the decision of the foreign court in the territory of the Czech and Slovak Federal Republic, if that recognition is required by law. 6)
(1) The documents must be presented in an original or certified copy (certified photocopy). In the case of foreign language documents, the citizen is obliged to submit a certified translation into the Czech or Slovak language at the invitation of the District Administration of Public Security.
(2) If doubts arise as to the correctness or completeness of the documents or the particulars referred to therein, the citizen is obliged to submit a new document at the invitation of the District Administration of Public Security.
(3) The documents required for the issue of the identity card may be presented by a person close to him or living with him or his authorised representative for the citizen requesting it.
(4) The citizen is obliged to take over the ID in person and to confirm the accuracy of the information contained in it by signing it. The County Public Security Administration shall return the documents submitted to the citizen when the card is transferred, except for the current identity card and the certificate of surrender, loss or theft of the identity card.
Entries on the ID card
(1) When issuing the identity card, the District Administration of Public Security records the data on the basis of the documents submitted.
(2) Upon receipt of the identity card, the citizen shall submit it without undue delay to the employer (7) for a record of a work or similar relationship, or, where appropriate, of a member's relationship with the cooperative, or of a school for a school or a high school (hereinafter referred to as employment).
(1) The District Administration of Public Security shall enter in the identity card, on the basis of a decision of the court bearing a legal power clause, the imposition of a stay ban, the suspension of the rest of the sentence, or the execution of the remainder of that sentence, the execution of a stay ban, including the abandonment of the sentence or the execution of the remainder.
(2) The District Administration of Public Security shall enter in the identity card on the basis of a decision of the court bearing a clause on the legal power of limitation of legal capacity and recovery.
(3) With regard to the entries referred to in paragraphs 1 and 2, the citizen is required to appear at an invitation to the District Administration of Public Security responsible for the place of permanent residence.
(4) A citizen with whom the prohibition of residence has been imposed, or who has been waived, has the right to issue a new identity card in which that sentence is no longer recognised. The right to issue a new identity card, to which it is no longer entitled to limitation of legal capacity, shall also be granted to a citizen to whom legal capacity has been returned.
(1) The citizen is obliged to ensure that the basic information recorded on the identity card is always in accordance with the facts. To that end, it shall:
(a) request the district administration of Public Security to issue a new identity card no later than 15 days after the change of surname, name or birth number (if indicated on the first page of the ID card);
(b) to present, at the latest 15 days after the change in the status (conclusion of the marriage, divorce of the marriage, annulment of the marriage, widowhood) - if there has not been a change of surname - an identity card with the appropriate document to the authority responsible for the registration of the change,
(c) present, at birth, adoption, death, revocation or change of surname, name or birth number of the children, with the appropriate document of the authority responsible for carrying out the register,
(d) submit a residence certificate to the competent authority (5) for entry of permanent and temporary residence data, 10)
(e) to submit an employer's identity card (7) or to the school for registration at the time of the establishment and termination of employment;
f) present upon modification (repair) of the birth number
1. entered under the heading "Special records" of the identity card within 15 days of the registration of that authority, to which the national committee has transferred its competence under the special regulations, 14)
2. registered on the sixth page of the ID card within 15 days of registration of this change to the district department of the Czech Statistical Office or Slovak Statistical Office, born after 31 December 1968 in the territory of the Czech and Slovak Federal Republic, or the municipal department of the Czech Statistical Office in Brno, born after 31 December 1968 in a foreign country, or the authority to which the national committee was transferred under special regulations, 14), born before 1 January 1969,11)
(g) to submit an identity card to the military service on taking up and leaving the essential (replacement) service to record the entry or termination of the essential (replacement) service;
(h) submit, on entry and termination of the civil service, the identity card designated by the organisation10a) for the entry of such data. 10b)
(2) At the request of the citizen, the information referred to in points (b), (c) and (f) of paragraph 1 shall be recorded by the district Public Security Administration upon presentation of the relevant documents.
(3) When changing the military ratio, the citizen is obliged to ask the district (district) military administration to indicate the change. At the request of the citizen, the district administration of Public Security will also mark this change upon presentation of a gate card, a military book, a release note or a certificate of incompetence for military active service. In the case of a withdrawal procedure, the change in the military ratio may be indicated by the draft commission on the identity card.
After the issue of the ID, the District Administration of Public Security shall enter in the section "Special Records', at the request of the citizen, other than basic data and their changes (e.g. data on educational attainment, title of university graduate, scientific qualifications).
(1) A citizen shall not make any entries, amendments or corrections in his or her identity card.
(2) If new data or change data cannot be entered in the identity card because the relevant entry section is fully filled, the citizen is obliged to ask the Public Security Administration to issue a new identity card.
They shall enter in their identity card:
(a) competent authorities (5) data on the permanent and temporary residence of the citizen;
(b) authorities responsible for the management of the data matrix
1. on the conclusion of a marriage, divorce or annulment of a marriage, of widower,
2. on the birth, adoption, death, revocation or change of surname, name or birth number of children;
3. on the implementation of the election of citizenship and, where appropriate, the conclusion of an agreement on citizenship, 12)
(c) appropriate health care establishments, at the request of a citizen, information on vaccination - re-vaccination against tetanus, data on serious diseases which, under certain circumstances, require the immediate administration of a drug or the provision of special first aid and data on its blood group and subgroup,
(d) the district department of the Czech Statistical Office or Slovak Statistical Office, or the district (district, municipal) or, where applicable, the municipal authorities, if they are entrusted with this, changes in the birth numbers registered on page 6 or under the heading "special records" of the identity card,
(e) military services information on the taking-up and termination of the basic service; the termination of the basic (replacement) service may be subsequently registered by the district (district) military administration responsible for the permanent residence of the citizen,
(f) designated organisation10a) entry and exit of civil service, 10b)
(g) employers (7) and schools to establish and terminate employment.
(10a) Employers and schools shall immediately notify the nearest department of Public Security or Police Department of the Slovak Republic of anyone who refuses to submit a card to record the facts referred to in § 12 (e) to (g) or to submit an identity card for such registration which has lost the powers of proof. 13)
Provisions common, transitional and final
At the request of a citizen, the district government of Public Security or the district headquarters of the Slovak Republic will take over the identity card for the long-term residence of a citizen abroad.
(1) Citizens released from the State Union and citizens who terminate their permanent residence in the territory of the Czech and Slovak Federal Republic are required to hand over their identity card to the District Administration of Public Security or to the Regional Headquarters of the Slovak Police College responsible for their last permanent residence in the territory of the Czech and Slovak Federal Republic.
(2) A citizen's citizenship card which has been deprived of legal capacity by decision of the court shall be required to be handed over to the district administration of Public Security responsible for the place of permanent residence of the citizen by his guardian.
(3) The departments of the Department of Correctional Education of the Ministry of Justice of the Czech Republic and of the Department of Correctional Education of the Ministry of Justice of the Slovak Republic withdraw civil certificates to citizens entering the prison sentence and immediately send them to the district administration of Public Security responsible for the place of permanent residence of the citizen. Citizens released from prison shall be returned to their identity card if they have not lost their evidence power. 13)
(4) The deceased's identity card shall be handed over to the district public security administration responsible for the last residence of the deceased or to the national committee responsible for the management of the mantle by the person who last cared for or provided for the deceased's funeral. The Ombudsman responsible for the management of the register shall immediately forward the identity card to the District Administration of Public Security responsible for the last residence of the deceased.
In exchange for a card that has lost the power of proof, 13) for a new ID, the district administration of Public Security will withdraw the current identity card. A citizen to whom a new identity card has been issued for a lost or stolen card shall be obliged to surrender it to the nearest Public Security Service if the original identity card is found or otherwise returned.
If the identity card is sent by post, it must be submitted as a valuable typology or package with a stated price above 1000 Kcs.
(1) Civil certificates issued under previous rules are valid for the period for which they were issued.
(2) Citizens who do not have registered data on children under 15 years of age, their daily studies, their attendance at primary school, or their principal occupation, as authorised by the Routes (14), are required to submit their identity card to the Public Security Council or to the Regional Headquarters of the Slovak Republic, a school or a competent authority (14) no later than six months after the date of application of this Decree.
(1) The soldiers in the occupation of the Czechoslovak army are required to apply for the issue of an identity card by 31 December 1991 at the latest.
(2) Citizens carrying out a basic (replacement) service may apply before the end of the service to issue their identity card, which they hold in custody with the Public Security District Administration or with the Regional Command of the Slovak Police Department responsible for their permanent residence.
(3) Photographs required under the current legislation may be submitted for the issue of the identity card until 31 December 1991.
Decree No. 135 / 1978 of the Federal Ministry of Interior, Coll., which issues more detailed provisions on civil ID, is hereby repealed.
This Decree shall take effect on 1 July 1985.
