on the Protocol amending the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance
On 21 June 1974, the Protocol on the Amendments to the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance was signed in Sofia.
President of the Republic The Protocol was ratified and the instrument of ratification was deposited with the Government of the Union of Soviet Socialist Republics, depositary of the Protocol, on 24 February 1975.
The Protocol entered into force on 13 February 1976 pursuant to Article 2 thereof.
The Czech translation of the Protocol is being announced simultaneously.

PROTOCOL
on amendments to the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance
the Governments of the People's Republic of Bulgaria, the People's Republic of Hungary, the German Democratic Republic, the Republic of Cuba, the People's Republic of Mongolia, the People's Republic of Poland, the Socialist Republic of Romania, the Union of Soviet Socialist Republics and the Czechoslovak Socialist Republic,
taking into account resolutions XVI, XVI and XXVIII. RVHP meetings on amendments to the Statute of the RVHP and to the Convention on the Eligibility, Privileges and Immunities of the RVHP,
Bearing in mind the provisions of Article XVI of the RVHP Statute and Article VI of the Convention on the Eligibility, Privileges and Immunities of the RVHP,
they have agreed as follows:
Implement the amendments to the Statute of the Council of mutual economic assistance and to the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance signed on 14 December 1959 and entered into force on 13 April 1960, as amended by Annexes 1 and 2 to this Protocol.
The Protocol shall be ratified by the signatory States and shall enter into force on the date on which all the signatory States deposit their instruments of ratification with the depositary, which the depositary shall inform those States thereof. In doing so, it is noted that the Republic of Cuba and the People's Republic of Mongolia will simultaneously ratify the Statute of the RVHP and the Convention on the Legal Jurisdiction, Privileges and Immunities of the RVHP with the amendments made pursuant to Article 1 of this Protocol.
Once the Protocol enters into force, it shall be registered by the depositary in accordance with Article 102 of the Charter of the United Nations.
The Protocol was drawn up in one copy in Russian. The Protocol will be placed in the custody of the Government of the Union of Soviet Socialist Republics, which will be the depositary of this Protocol.
The Government of the USSR will circulate certified copies of the Protocol to the governments of the other Member States of the RVHP that have signed this Protocol and will also report to these governments and Council secretaries on the deposit of the instruments of ratification in custody with the Government of the USSR.

ANNEX 1
Amendments
Statute of the Council for Mutual Economic Assistance
1. The words' to further deepen and improve cooperation and the development of socialist economic integration 'shall be inserted after the words' by unifying and coordinating the efforts of the Council Member States'; the words "to the continuous growth of labour productivity" shall be inserted in the words "to gradually converge and balance the level of economic development,"
2. The second paragraph of Article I (2) shall read as follows:
"Economic and scientific and technical cooperation between the Member States of the Council shall be carried out in accordance with the principles of socialist internationalism, on the basis of respect for national sovereignty, independence and national interests, non-interference in the internal affairs of the States, full equality, mutual advantages and mutual assistance '.
3. In Article II (2), the word "European 'shall be deleted.
4. in Article II, point 4 (d), the words "recommendations adopted in the Council 'shall be replaced by the words" recommendations of the Council institutions which have adopted';
5. Article III (1) shall read as follows:
"1. In accordance with the objectives and principles referred to in Article I of this Statute, the Council shall:
(a) organise all-round economic and scientific and technical cooperation between the Member States of the Council on the most rational use of their natural resources and on speeding up the development of production forces and helping to develop socialist economic integration;
(b) assist in improving the international socialist division of work by coordinating national economic development plans, specialisation and co-operation of the production of the Member States of the Council;
(c) take measures to examine economic and scientific and technical problems in which the Council Member States are interested;
(d) assist the Council Member States in developing, agreeing and implementing common measures;
the development of industry and agriculture in the Council Member States;
to develop transport in order primarily to ensure the increasing transport of export, import and transit costs of the Council Member States;
the most efficient use of the basic investments made by the Council Member States for the development of mining and processing industries, as well as the construction of the most important buildings of interest to two or more States;
developing the exchange of goods and services between and between Council Member States and other States;
exchange of scientific and technical knowledge and advanced production experience;
(e) take further action to achieve the Council's objectives. "
6. Article III (2) shall read as follows:
"Mutual Economic Assistance Council in accordance with this Statute
(a) be entitled to act by its authorities acting within the limits of its jurisdiction, recommendations and decisions;
(b) may negotiate international agreements with Council Member States, other States and international organisations. "
7. In Article IV (2), the words "or does not imply otherwise 'shall be inserted after the words" Unless otherwise stated in the decisions'.
8.
"1. In order to exercise its competence and powers under Article III of this Statute, the Council shall have the following main bodies:
Council meetings,
The Executive Committee of the Council,
Council committees,
the Council Standing Committee,
Council Secretariat. ';
9. Article VI (3) and (5) shall read as follows:
'3. Regular Council meetings shall be held at least once a year, in successive stages in the capitals of the Council Member States; they shall be chaired by the Head of Delegation of the State in whose territory the meeting is held. ';
"5.
(a) discuss:
the fundamental issues of economic and scientific and technological cooperation and identify the guidelines for the Council's action;
the report of the Executive Committee on the activities of the Council;
(b) perform other functions which prove necessary to achieve the objectives of the Council. "
10. Article VII shall read as follows:
Council Executive Committee
1. The Executive Committee of the Council of mutual economic assistance shall be composed of representatives of all Council Member States at the level of the Deputy Presidents; each State has one representative on the Executive Committee.
The Executive Committee shall be the main executive body of the Council.
2. The Executive Committee shall normally hold its meetings once a quarter.
3. The Executive Committee shall be entitled, within the limits of its competence, to make recommendations and decisions in accordance with this Statute. The Executive Committee may submit proposals for consideration to Council meetings.
4. Executive Committee
(a) manage all the work related to the implementation of the Council's tasks in accordance with the resolutions of the Council's meetings, continuously monitor the fulfilment by the Council Member States of the commitments resulting from the recommendations made by the Council institutions;
(b) manage the work to coordinate national economic development plans, specialise and co-operate the production of the Member States of the Council and organise the development of basic guidelines for rational division of labour in the most important sectors of production of those States;
(c) discuss the proposals of the Member States of the Council and the competent authorities of the Council on matters of economic and scientific and technological cooperation, analyse the state of such cooperation and develop measures for its further development;
(d) develop guidelines and measures to develop the exchange of goods and services between Council Member States, scientific and technological cooperation between Council Member States;
(e) manage the work of committees, standing committees, the Council Secretariat, as well as other relevant Council bodies and identify the main issues and directions of their activities;
(f) approve:
the staffing of the Council Secretariat, the Council's budget and the Secretariat's report on the implementation of the budget,
the statutes of committees, standing commissions and the Council Secretariat, as well as other Council bodies;
(g) establish financial management control bodies for the Council Secretariat;
(h) perform other functions resulting from this Statute and from recommendations and decisions of the Council meetings.
5. The Executive Committee may establish such bodies as it finds necessary for the performance of its functions.
6. The Executive Committee shall establish its rules of procedure. ';
11. Article VIII of the Council Statute shall be inserted as follows:
Council committees
1. The Council Committees set up a Council meeting to ensure a comprehensive discussion and multilateral solution to the most important problems of cooperation between the Member States of the Council in the field of economics, science and technology.
The Council committees shall perform the functions set out in their statutes as well as other functions resulting from the recommendations and decisions of the Council meetings and the Executive Committee of the Council.
2. The Council committees shall consist of senior officials, the competent authorities of the Member States of the Council, each State having one representative on the Committee.
3. The committees of the Council shall be entitled to:
(a) make recommendations and decisions in accordance with this Statute;
(b) submit proposals for the meetings of the Council and the Executive Committee of the Council;
(c) establish working bodies to prepare for committee meetings and agree on the various issues relating to the competence of committees, as well as to convene scientific and technological conferences and other meetings;
(d) request materials, opinions and proposals from standing committees and other relevant Council bodies on issues relating to their activities.
4. The Council committees shall report annually to the Executive Committee on the work done.
5. The Council committees shall lay down their rules of procedure. "
12. Article VIII- XVII of the current Council Statute shall be renumbered Article IX- XVIII.
13. The title of Article VIII1 shall read "Standing Council Commission."
14. Article VIII (1), second paragraph, shall be deleted.
15. Article VIII (2) shall read as follows:
'2. Standing commissions shall consist of delegations appointed by the Council Member States. ';
16. Article VIII (3) shall read as follows:
'3. Standing commissions shall be entitled within the limits of their jurisdiction:
(a) make recommendations and decisions in accordance with this Statute;
(b) submit proposals to the meetings of the Council and the Executive Committee, as well as to submit, on request or on its own initiative, materials, opinions and proposals to other relevant Council bodies;
(c) to establish working bodies for the preparation of committee meetings and to agree on individual issues falling within the competence of the commissions, as well as to convene scientific and technological conferences and other meetings. "
17. The first paragraph of point 4 of Article VIII shall be transferred as second paragraph to point 1 of the same Article, as follows:
"Standing commissions shall develop measures and prepare proposals for the implementation of such cooperation, including the preparation of relevant multilateral agreements; carry out other functions resulting from this Statute and from recommendations and decisions of the Council, the Executive Committee and the Council committees. ';
18. The second paragraph of Article VIII (4) shall be left as point 4 of that Article.
19. Points 5, 6 and 7 of Article VIII shall be deleted; point 8 of this Article shall become point 5.
20. The title of Article IX shall read "Council Secretariat."
21. Article IX (1) (2) shall read as follows:
"The Council Secretariat shall be appointed by the Council meeting, its Deputy Council Executive Committee.
The Secretariat of the Council and its Deputy Ministers shall manage the work of the Council Secretariat. Secretariat staff shall be composed of citizens of the Council Member States according to the Statute of the Council Secretariat. ';
22. Article IX (2) shall read as follows:
"2.
(a) organise and assist during meetings of the Council institutions and consultations carried out within the Council, produce materials or assist in the preparation of materials for meetings of the Council bodies in accordance with the work plans of those bodies and perform the function of secretariat of the other Council bodies;
(b) compile economic summaries and carry out economic studies on the basis of Council Member State materials; draw up and publish information and other material on economic and scientific and technological cooperation issues of the Council Member States, as well as other summaries and studies;
(c) draw up proposals on the various issues of Council work in order to discuss them in the competent Council bodies;
(d) develop or co-operate in the drafting of multilateral agreements on economic and scientific and technological cooperation, as recommended and decided by the Council institutions;
(e) organise and carry out a record of compliance with the recommendations and decisions of the Council institutions and draw up appropriate proposals for their consideration;
(f) carry out other activities resulting from this Statute, from Council recommendations and decisions, as well as from the Statute of the Council Secretariat. ";
23. The title of Article X will be: "Council relations with other countries."
24. Article X, first paragraph, shall be supplemented by the words "or cooperate with them in other forms."
25. Article X, second paragraph, shall read as follows:
"The conditions under which non-members of the Council may participate in the work of the Council institutions or cooperate with the Council in other forms shall be determined by the Council in accordance with arrangements with those States, which shall as a general rule be agreed upon. ';
26. Article XI shall read as follows:
"Council contacts with international organisations
The Council of Mutual Economic Assistance may establish and maintain contacts with the UN institutions and with experts and other international organisations.
The nature and form of such contacts shall be determined by the Council in accordance with arrangements with the competent UN authorities and international organisations, in particular by concluding agreements with them. ';
27. Article XII shall read as follows:
"Financial matters
All Council revenue and expenditure shall be set out in the budget of the Council. The Member States of the Council shall bear the costs relating to the maintenance of the secretariat and to the financing of its activities, as well as other costs incurred by the Council in accordance with its budget. The amount of the contributions by Member States to the Council budget shall be determined by the Council meeting.
2. The Council Secretariat shall submit to the Executive Committee of the Council a draft budget of the Council for each calendar year and a report on the implementation of the budget.
The revision of the financial management of the Council Secretariat shall be carried out annually.
3. The cost of staying for the meetings of the Council institutions, as well as the deliberations carried out within the Council, shall be borne by the State sending a representative to such meetings and meetings.
4. The costs associated with the provision of the buildings and other technical means necessary for the meetings and meetings referred to in point 3 of this Article shall be borne by the State where the meetings and consultations are held, except where such meetings and meetings are held in Council rooms. ';
28. Article XIII (5) shall read as follows:
"5. The Heads of State in the Executive Committee of the Council are also permanent representatives of their States in the Council. The Permanent Representative of the State in the Council shall have a Deputy Director at the seat of the Council Secretariat and the necessary number of advisers and other staff. ';
29. In Article XV (4), the words "provisionally on the date on which the Council meeting decides to accept that State as a member of the Council and definitively... 'shall be inserted after the words" the Statute shall become effective'.

ANNEX 2
Amendments
Conventions on the legal capacity, privileges and immunities of the Council of mutual economic assistance
(1) Article IV (2) shall read as follows:
'2. In addition to the privileges and immunities referred to in point 1 of this Article, the Permanent Representatives of the States of the Council and their Deputy Members shall enjoy the privileges and immunities which the Member State grants to diplomatic representatives. ';
(2) Article IV (5) shall read as follows:
"5. Representatives within the meaning of point 1 of this Article shall mean permanent representatives of the States within the Council, their Deputy, Heads of Delegation, their members and secretaries and advisors and experts. ';
3.
"1. The Executive Committee of the Council of mutual economic assistance shall, on a proposal from the Secretary of the Council, determine the categories of officials to whom the provisions of this Article apply. The names of such officials shall be communicated regularly by the Council Secretary to the Council Member States. ';
4.
"As regards the secretaries of the Council and its Deputy Members, the right to waive the immunity of the Executive Committee of the Council shall lie with them. ';
5. In Article VI (4), the words "this Convention shall take effect 'shall be replaced by the words:" and shall declare its agreement to accede to this Convention, this Convention shall provisionally take effect on the date on which the Council meeting decides to accept that State as a member of the Council, and definitively...'.
