Order of the Minister for Finance
of 1 August 1950
on the procedure for submission.
In an agreement with the Minister of the Interior pursuant to § 59 (1) of Act No. 89 / 1950 Coll., on Administrative Criminal Procedure:
The procedure may, at the request of the defendant, discuss:
(a) offences involving the reduction or threat of a customs duty or of a duty levied pursuant to Articles 61 and 62 of the Administrative Criminal Code, in so far as the reduced or threatened tax or customs duty or their sum does not exceed CZK 10,000;
(b) offences in the course of the circulation of goods in contact with a foreign person in accordance with § 63 of the Act which infringed prohibitions or restrictions issued to protect the financial interests of the State, provided that the infringement is less serious and does not at the same time result in a general price of goods of more than 20 000 CZK;
(c) foreign exchange offences in accordance with Paragraph 64 of the CITL., if they are for the import, export or transit of tender, or for the export of gifts or valuables, if the value of gifts or valuables does not exceed 20 000 CZK and if they are for tender, more than 10 000 CZK.
Detailed procedures for offences referred to in § 1 may be carried out only where:
(a) the offence or attempted offence has been committed by a person not residing in the territory of the Czechoslovak Republic; or
(b) the offence or attempted offence was committed on exit from the territory of the Czechoslovak Republic by a person residing in that territory.
The detailed procedure shall not be used,
(a) if the manner or nature of the act implies that an hostile attitude towards the People's Democratic establishment of the Republic has been or should have been expressed; or
(b) if the circumstances of the case appear to indicate that it is an act prepared with a particular consideration or an act involving another person or an offender already convicted; or
(c) if the offences referred to in Article 1 are in the mix with other offences or criminal offences.
The detailed procedures shall be carried out by the criminal and customs authorities financial services.
This Regulation shall take effect on 1 August 1950.
