Government Regulation
of 26 April 1946
on the adjustment of certain service and pay ratios of financial guards.
The Government of the Czechoslovak Republic hereby orders the President of the Republic, pursuant to § 3 of the Decree of 2 October 1945, No. 86 Coll., on the rebuilding of financial guards in the Czech and Moravian-Silesian countries and on the modification of certain service and pay conditions of the members of the Financial Guard:
The staff and salary arrangements of the financial guards shall continue to be governed by the provisions applicable to them on 29 September 1938, with the amendments resulting from this Regulation.
(1) The provisions of Part III of the Second Government Decree of 19 December 1930, No 202 Coll., implementing the regulations on the organisation of the financial guard and adjusting its service and certain salary ratios are deleted.
(2) Where the tax guards are referred to in Decree 202 / 1930 Coll. of the Government of the Government of the Czech Republic, this means that the tax guards are outside the service classes (the tax guards).
(3) In Decree-Law No 202 / 1930 Coll. the provisions of Sections 35 and 36 are deleted and the provisions of Sections 5, 9, 12, 15, 16, 17, 21, 4, 33, 34, 38, 40 and 44, paragraph 1 are amended or supplemented and read as follows:
The Financial Guard Corps shall be composed of officials of the financial service of the guards and gayists of the financial guards outside the service classes (hereinafter the Gayists of the financial guards).
Part I shall apply to officers of the financial service of the guard, part II shall apply to gayists of the financial guard and part III shall apply to all members of the financial guard, unless otherwise provided for in this Regulation.
(1) The financial service officers of the guards are state pragmatic officials of the 3rd service class, subject to derogations under this Regulation.
(2) The post of officials of the financial services of the guards shall be systemized according to their importance and taking into account the manner of service within the normal needs of the forces set out in the scale 4 to 8 of the salary scale.
Systemisation of service posts.
The service posts of the Gajist financial guards shall be systemized in I, II and III scales.
Financial guards waiting.
(1) Only those who have fulfilled the following special conditions outside the general conditions for a provision in the civil service may be designated as a candidate for a financial guard (the candidate):
(a) has completed at least 21 years of age and has not exceeded 25 years of age;
(b) has carried out a military service with a weapon by a representative;
(c) he is free, widowed or parted, childless and without maintenance obligations;
(d) have successfully completed a one-year training course linked to a school of local or other education equivalent;
(e) has a height of not less than 168 cm, and
(f) has the mental and physical capacity established by the official doctor, the designated financial administration, as well as other characteristics necessary for the service on the financial guard.
(2) The Ministry of Finance may allow a deviation from the special conditions laid down in paragraphs 1 (a) to (e) in cases of special consideration.
(3) The waiting period is set at one year, must be spent in the Financial Guard Corps and is attributable to the increase in service.
(4) The candidate shall be entitled, for the duration of the waiting period, to the service salary of the 3rd salary scale and to the service title "Assistant Financial Guard Officer."
(5) On taking up the service, the candidate shall take an oath in the version provided for in Paragraph 21 (1).
(6) If it is found that the candidate does not have the necessary capacity to serve or does not comply with the conditions prescribed for a permanent provision, the service shall be cancelled. If otherwise impeccable behaviour confesses to the candidate at the same time the rate of one month's salary.
(7) A candidate in active employment must not marry without prior approval from the Ministry of Finance.
(8) The provisions of this Regulation on gavages of financial guards shall apply, unless otherwise specified, to the candidates.
(1) A candidate shall be appointed by the Financial Guard's Gajist who:
(a) have completed the prescribed waiting period (§ 16 (3));
(b) satisfies the conditions of Paragraph 16 (1) (f); and
c) completed a training course for the financial guard with benefit.
(2) The provisions on the exclusion and deferral of the increase in service applicable to civil servants (Section 16 of the Salary Act) apply mutatis mutandis to the provisions of the Waiver by the tax guard.
(4) The gayists of the financial guards, who carried her out as candidates, do not take the oath.
Service titles.
(1) Gažista's financial guards, established in a service post, systemised in the 3rd scale, belong to the service title "Financial Guard Officer," after the "Superintendent of the Financial Guard," to the service post, systemized in the 2nd scale, the service title "Financial Guard Respicative" and to the service post, systemized in the I. scale, the service title "Financial Guard's chief respondent."
(2) A financial guard is obliged to use his title in the service of his service.
Salary ratios.
(1) The provisions of § 131, § 135, paragraph 1, § 138, paragraphs 1 to 4, § 139 to 142, 146, 147, § 148, paragraphs 1 and 4, § 149 to 151 of the Law on Payment shall apply mutatis mutandis.
(2) The service shall be increased by the procedure to higher degrees. The increase in the service fee in the I. salary scale occurs when the gentile of the financial guard has reached the deductible service period prescribed for the relevant grade of service (§ 38 (5)), in the other scales of pay, once the gentile of the financial guard has completed 3 years of commensurate service period with the service immediately preceding that of the same scale.
(3) The increase in the service is done ex officio.
(4) The provisions of Section 16 of the Salary Act apply mutatis mutandis to the exclusion and deferral of the increase in service.
The promotion of the gayist of the Financial Guard.
(1) The promotion of the gavel of the financial guard will be a loan of a higher rank on the same scale (III.) or a loan of a post systemised on the higher scale (§ 15).
(2) A post in the 2nd scale may be given to a gavel of financial guards who have at least good qualifications, a post in the first scale of pay to a gavel who has at least very good qualifications and who has successfully passed the test prescribed to achieve the position of chief respondent of the financial guard.
(3) The scope, manner and other conditions of the examination referred to in the preceding paragraph shall be determined by the Ministry of Finance, which may, in exceptional cases, be subject to the examination of the pardon. If the gentile of the financial guards has passed the technical or lower customs examination, he shall be exempt from the examination.
(4) Paragraph 17 (4) and (5) of the Law shall apply mutatis mutandis to the hire of a post systemised in the 2nd scale.
(5) In the case of the hire of a post systemised in the first scale, the degree of service of that scale shall be determined according to the allowance for service hours as follows:

(6) Paragraph 17 (2) of the Law applies mutatis mutandis.
Relaxing and providing salaries.
Similarly, the provisions applicable to pragmatic bailiffs and their survivors with a derogation referred to in § 91 shall apply to the retirement and provision salaries of gasiste financial guards and their survivors.
Termination of service.
(1) The service relationship of the gayist of the financial guard ends:
(a) loss of Czechoslovak citizenship;
(b) renunciation of a service or withdrawal from a pension relationship (§ 45);
(c) loss of office (§ 46),
(d) by the release of a disciplinary action [Paragraph 51 (1) (f)],
(e) transfer to another public service;
(f) death.
(1) The provisions on the amount of the service salary of members of the financial guard shall apply mutatis mutandis to the amount of the service salary of gentile officers and gentiles outside the service classes.
(2) The official of the financial service of the guard in active duty shall be entitled to an addition of the financial guard in the following annual area:

(3) The financial guards in active service to the Gazists belong to 3,000 Kcs per year in addition to the financial guards' regular allowances.
(4) The contribution of the financial guard shall be paid according to the principles of payment of the service, shall be payable at the same time as the service and shall not be included in the pension base.
(5) In Slovakia, from 1 November 1945 until the entry into force of the regulations unifying the service salaries of members of the gendarmerie for the territory of the whole state, financial guards are subject to regulations on the amount of the service salary of members of the gendarmerie in the Czech and Moravian-Silesian countries. The effectiveness of the Decree of the President of the Republic of 20 August 1945, No. 58 Coll., on the payment allowance of state and some other public employees, is extended for members of the Financial Guard in Slovakia.
(6) On 31 October 1945, the financial guards in Slovakia shall cease to be effective, if applicable:
1. Law of 28 February 1941, No 40 of the SLA, on the provisional adjustment of the salaries of civil servants and amending and supplementing certain provisions on staff-saving measures,
2. the Law of 2 July 1942, No 129 of the Coll. on the Expensive Benefit and amending certain provisions on the austerity measures of personnel;
3. the Law of 10 December 1942, No 232 of the Coll. on the Expensive Benefit and on the Disposable Christmas Aid to State Employees,
4. the Law of 28 October 1943, No 139 of the SLA, on the general expensive addition and addition of Act No. 102 / 1943 of the SLA,
5. Decree of the Slovak National Council of 16 May 1945, No. 39 SSR, on the provisional salary adjustment of civil servants,
6. Paragraph 7 of the Decree of 21 December 1938, No 380 Coll., on the austerity measures of personnel.
(7) After the adjustment of the salaries provided for under this Regulation, a member of the financial guard with the addition of a salary allowance under Decree No. 58 / 1945 Coll. and a special allowance under the Act of 13 December 1945, No. 159 Coll., on the special allowance of State and certain other public servants, as well as the beneficiaries of the State's resting (provision) salary, after the deduction of the salary tax (pension tax), shall not be less than the amount of the general allowance under Act No. 139 / 1943 Coll. of the Act No. 169 / 1945 Coll., if the staff were associated with the special allowance under Act No. 159 / 1945 Coll., as amended by Act No. 232 / 1942 Coll., and Act No. 102 / 1943 Coll., with the general allowance under Act No. 40 / 1941 Coll., with the special allowance under Law No. 129 / 1942 Coll. The difference, if any, falls as a compensatory personal allowance which is not subject to pension tax in Slovakia.
(8) The compensation allowance referred to in the preceding paragraph shall be reduced, for each increase in the service fee (corresponding to the salary), by the amount of such increase, but not more than the amount by which the salaries fixed in accordance with paragraph 7, after the increase in the service fee (corresponding to the salary), exceed the current salary.
(9) Where the family status (number of members of the family) taken into account for the purposes of determining the compensatory allowance is changed for the period from the first day of the next month, that allowance shall be determined as if the circumstances of the change introduced were the day before the entry into force of this Regulation.
(10) The compensatory personal allowance shall be rounded up if it is not expressed in crowns without pennies or if it is not divisible by twelve, to the nearest higher amount in crowns so divisible.
(11) The Minister for Finance is hereby authorised to compensate for any discrepancies in salary that may arise in the implementation of this Regulation by appropriate measures.
The rules applicable to the gendarmerie shall apply mutatis mutandis to authorised members of the financial guard.
(1) The officers of the financial services of the guard shall be charged from 1 July 1946 instead of the current service (with a service allowance) and the new service and relevant new operating charge III. the service classes of the relevant salary scale, the degree of service (with the allowance) and the group of posts pursuant to § § 103 and 104 of the Act of 24 June 1926, No 103 Coll., on the adjustment of the pay and certain service conditions of civil servants, as amended by the Law of 16 May 1946, No 139 Coll., adjusting the salary and certain service conditions of military and banking gasists.
(2) The new service and new operating fees, laid down in accordance with paragraph 1, with the educational and financial security allowance referred to in Article III (2), the salary allowance provided for in Decree No. 58 / 1945 Coll. and the special allowance provided for in Act No. 159 / 1945 Coll., are replaced by the sum of the salaries paid so far. The total of the current salaries is included in the service, operating, educational, salary allowance according to Decree No. 58 / 1945 Coll., special allowance according to Act No. 159 / 1945 Coll. and compensation allowance according to Article III (7).
(3) Should the sum of the current salaries exceed the sum of the new salaries referred to in paragraph 2, the compensatory allowance shall be equal to the difference between the two salaries. This allowance shall be reduced by one half of the amount by which the service will increase when the service has completely ceased.
(1) As from 1 July 1946, the financial guards of the Gažis shall be assessed instead of the current service and operating fee of the new service and the applicable new operating fee pursuant to § § § 132 and 133 of the salary law as amended by Act No. 139 / 1946 Coll. The new service shall be provided as follows:
(a) the financial guard's assistant officers and officers shall receive the same level of service at the new Level III salary scale as they achieved in the current scale III;
(b) the overseers of the financial guards shall be given the appropriate grade of the new scale II, as provided for in paragraph 2;
(c) the respondents of the financial guard shall be given the appropriate degree of the new Ib scale in accordance with the provisions of paragraph 2;
(d) the top respondents of the financial guard in the current 2nd salary scale shall receive the services of the relevant degree of the new Ia scale according to the chargeable period of service (§ 38 (5));
(e) the top respondents of the financial guard in the current I. salary scale shall receive the same level of service at the rate of the new Ia salary scale as they achieved in the current I. salary scale.
(2) The ordinary, payable to the tax guards referred to in paragraph 1 (b) and (c) shall be determined in accordance with the provisions on promotion (Paragraph 17 (4) and (5) of the Salary Law) and the amount of service which they would have had had had this Regulation taken effect on the day before their promotion.
(3) The new service and new operating fees, fixed in accordance with paragraph 1, with the educational and financial security allowance provided for in Article III (3), the salary allowance provided for in Decree No. 58 / 1945 Coll. and the special allowance provided for in Act No. 159 / 1945 Coll., are replaced by the sum of the salaries paid so far. The total of the current salaries shall be calculated in accordance with Decree No. 58 / 1945 Coll., the special allowance provided for in Act No. 159 / 1945 Coll., the compensatory allowance provided for in Article III (7) and the allowance corresponding to the existing provisions of Article III (2) of Decree No. 119 / 1946 Coll.
(4) Paragraph 1 (3) applies mutatis mutandis to gayists of financial guards.
(1) The existing provisions on expensive allowances (exceptional allowance) for retired and survivors shall not apply to members of the financial guard to whom this Regulation applies and who enter the service for its effectiveness and to survivors of those members of the financial guard and to those members of the financial guard who die in active employment for the effectiveness of this Regulation.
(2) However, the total remuneration of the members of the financial guard and their survivors referred to in paragraph 1 shall not be lower than that which they would have been entitled to, in the absence of the applicability of the amendment to the salary law, if this Regulation had not applied to them, except in the case of provisions relating to the reassignment of financial guards into the scales and degrees applicable to the staff; for this purpose, the widow's pension shall be added to the education allowance. Any difference is due as an addition to the rest (provision) salaries.
(3) If the number of beneficiaries changes, a comparison of the resting (provision) salaries referred to in paragraph 2 shall be made again according to the changed status.
(4) The provisions of paragraph 1 shall also apply mutatis mutandis to the recipients of the grace, pension and resting (provision) salaries permitted under free consideration.
The members of the financial guard who were transferred to the service after 31 October 1945, their survivors and the survivors of the financial guards who died in active service after that date, shall be assessed with effect from 1 January 1948 according to the pension bases resulting from Act No. 139 / 1946 Coll.
The title of the officers of the financial services of the guard shall be determined on the basis of the scales as follows:

(1) Where, in the Annex to Paragraph 1 of the Decree of 13 May 1938, No 106 Coll., revising the regulation on uniform financial guards and supervisory officers, it is referred to as civil servants, established or established gendarmerie, i.e. officers of the financial service of the guards and gayists of financial guards outside the service classes, after waiting for the financial guard. The provisions relating to the auxiliaries shall be deleted.
(2) In the Annex to Paragraph 1 of Decree-Law No 106 / 1938 Coll. the provisions of Articles 23 (2) and 25 to 30 are deleted and Articles 2, 3, 5, 1, 9, 12, 13, 1, 17, 19 and 31 are amended or supplemented and read as follows:
Bluza (picture 6).
Blush is made of fine cloth or cloth made of combed yarn of aluminium colour and cut in such length that the sitting is completely covered. Bluza consists of two forearms, two-piece ass, two sleeves, four pockets sewn on top, and a collar. There are seven buttons on the right front; and on the left hand are seven embroidered holes. Each forequarter has one breast pocket (average size 15 cm wide, 16 cm long) with 3 to 3,5 cm wide fold in the middle, and one side pocket, slotted on top (average size 21 to 23 cm wide, 19 cm long). The pockets are covered with heels. One button is attached to each side. The rear is equipped with 30 to 35 cm long gap (depending on the figure). The sleeves are two-piece. On the lower part of the sleeves is 8 cm from the lower edge of the sleeve with a fold and stitching imitation of the wrong panel, equipped with three buttons in the middle of the back. A tab is attached at each end of the collar (Article 5). The collar is fixed with a felt insert, equipped with two hooks to fasten and half-laid. On each shoulder between the sleeve and collar there is a reinforced shoulder band made of a cloth of the colour of the sheets with a 3 mm wide lining of the fabric of the delusion. This tape is 54 mm wide at the shoulder, narrows to the neck up to 44 mm and ends with a tip reaching the upper collar; at a distance of 1,5 cm from the tip, it has a embroidered hole and is fastened to a button. The shoulder band is sewn between the sleeve and the forefront so that its rear edge is covered with the centre of the shoulder.
Coat (picture No 7 and 8) and fur.
(1) The mantle is made of fine cloth or cloth made of combed yarn of aluminium (khaki), lined with lining and stitching in such dimensions that there may be a delusion under it and that the body may be covered from the neck to about 10 cm below the knees. The cloak remains of two forearms, two-piece ass, two sleeves and collar (picture 7). Each forefront is provided with six buttons of the same distance and six holes. When turned on, the distance of two higher buttons is 18 cm, the lower is 14 cm. A pocket is horizontally attached to each front panel on the lower side of the front panel, the cross-section of the pocket is covered with a narrow foot. At the mouth of the two-piece sleeve is attached 15 to 17 cm wide fold. The back of the mantle is equipped with a 60 cm long gap. Six buttons are used on the right-hand rail to turn on the slot. Two vertical feet, 23 cm long, 4 cm wide, are sewn on the upper end with one button on which the buckle is fastened 6 cm wide and 25 cm long. On a velvet half-faced collar, cut in whole, the lining is sewn on each end the same as on a delusion. On the lower left side of the collar is sewn side of neck buckle, on the right button. On each shoulder between the sleeve and the collar is the shoulder band in the same design as in the case of the delusion, but equipped with a lining of the cloth.
(2) In addition, it is permitted to carry as permissible parts:
(a) a waterproof cloak (image No 8) extending under the knees of a waterproof substance, a subtle civil cut, an inconspicuous colour consistent with the color of the aluminium.
b) Leather coat at least reaching to the knees, long, normal shape, brown colour, of sheepskin, fastened inside by a buckle on a wide rigid rubber, the collar is covered with a duvet brown colour. Ancestors are over each other and are pulled down by a waist with a ring buckle. The cloaks of the cloak can be switched to the neck. The pockets are straight with the heel, the sleeve is stuck. On the sleeves of the bottom, the tapes are available for download.
(c) the fur is of the same shape and colour as the mantle (paragraph 1), but a looser cut with a leather lining made of white lamb or other fur and collar made of black lamb's skin.
(3) The same cross-sectional components referred to in paragraph 2 shall be fitted with shoulder bands in the same way as the casing (paragraph 1); However, the lining is made of material of a uniform component. These shoulder straps can be unzipping.
Bills.
(1) The badges are made of dark green cloth and have the shape of figure 14.
The rating (Figure 15 and 17).
(1) The official status of officials is characterised by gilded five-point stars on the shoulder tape:

(2) Shoulders are the 5th salary for officials. the scale starts with a 7 mm wide golden sump, sewn to the inner edge of the shoulder band lining (picture 17).
(3) The stars are pushed from sheet metal, have a dimension of 22 mm and are placed on the longitudinal axis of the shoulder straps so that two pins form a base against the shoulder seam and one pin is directed towards the collar (figure 15).
Bluza.
Bluse is made of semi-fine cloth and is of the same colour, finish and cut as for officials (Article 2; picture 6).
Coat and fur.
(1) The cloak is made of a semi-fine cloth and is of the same colour, finish and cut as for officials (Article 3 (1); image No 7), except that the collar is made of a cloth.
Rank marks.
(1) The seniority of the gayists of the Financial Guard (expectants) is characterised by silver five-pointed stars on the shoulder tape:

(2) The shoulder straps are equipped with a 7 mm wide silver-plated sump, sewn to the inner edge of the shoulder band lining (picture 17).
(3) The stars are pushed from sheet metal, have a dimension of 22 mm and are placed on the longitudinal axis of the shoulder straps so that two pins form a base against the shoulder seam and one pin is directed towards the collar (figure 15).
The same as the officers of the financial services of the guards with the following accessories (perverts), badges and equipment of the supervisory officers:
(a) There is no fold on the sleeve of the mantle; the sleeve ends with an improper cleft and is provided on the lower edge with three buttons.
(b) In the case of an official on the 3rd pl. scale, the official's position on the shoulder tape shall be indicated by four gilded five-pointed stars and a golden skirt, as referred to in Article 9 (2) and (3), by an official on the 2nd pl. scale by two gilded five-pointed stars on the gilded embroidery of the shoulder band (Figure 22).
(c) Supervisors shall have a gold button with a small national emblem on their collar at a distance of 15 mm from the tip of the blank, mantle and capes (figure 11).
d) Around the national emblem placed on the hat (Article 1 (2), picture No 1) is placed on both sides with a gold emblem made of lime leaves.
with a ministerial inspector of three sheets,
two sheets of the earth inspector,
one sheet from the Deputy Regional Inspector (Figures 23, 24, 25).
(e) The edge of the blade of the field cap shall be provided with a 2 mm wide gold trim.
(f) Emblems of lime leaves [(d)], embroidered on a backing of a plaid cloth which exceeds the edge of the emblem by 1.5 mm, are also placed on both sleeves of the blush and the mantle, 2 cm above the wrong outlines of the sleeve of the blush, or 10 cm from the lower edge of the sleeve.
This Regulation shall enter into force on 1 November 1945; to be carried out by the Minister for Finance.
