of 19 March 2008
amending Act No. 95 / 1999 Coll., on the Conditions for the Transfer of Agricultural and Forestry Land from State Property to Other Persons and amending Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended, and Act No. 357 / 1992 Coll., on Inheritable Tax, Donation Tax and Real Estate Transfer Tax, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 95 / 1999 Coll., on the conditions for the transfer of agricultural and forestry land from state ownership to other persons and amending Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended, and Act No. 357 / 1992 Coll., on the Inheritable Tax, Donation Tax and Real Estate Transfer Tax, as amended, as amended, Act No. 253 / 2001 Coll., Act No. 253 / 2003 Coll., Act No. 354 / 2004 Coll., Act No. 94 / 2005 Coll., Act No. 179 / 2005 Coll., Act No. 342 / 2005 Coll., Act No. 178 / 2006 Coll., and Act No. 186 / 2006 Coll., is amended as follows:
1. In the third sentence of Article 7 (4), the words "the Land Fund shall gradually call for the conclusion of a purchase contract of a person in other places in order 'shall be replaced by the words" sales under this provision shall cease'.
2. In the third sentence of Article 7 (9), the words "the Land Fund will gradually call for the conclusion of a purchase contract of a person in other places in the order" shall be replaced by the words "the sale under this provision ends."
3. In Article 7, paragraphs 11 and 12 are added:
"(11) Persons participating in the sale of agricultural parcels referred to in paragraph 1 shall be required to deposit bail under the conditions published when the sale of agricultural parcels is made. The amount of the deposit is 5% of the minimum price of agricultural parcels, which is announced when the sale of agricultural land is announced, but at least CZK 5,000.
(12) A person entitled to a purchase contract shall be credited with a deposit to cover the purchase price if it is concluded. Any person who has the right to conclude a purchase contract and has not exercised that right within the time limit laid down in Paragraph 11 (3) shall forfeit the deposit lodged. This bail is the income of the Land Fund. In the event of the conclusion of the purchase contract, the Land Fund shall be obliged to return the deposit lodged no later than 10 days after the date of conclusion of the purchase contract to the other persons involved in the sale. '
4. In Paragraph 8 (1), the last sentence is deleted.
5. Paragraph 8 (3) reads as follows:
"(3) An obligation to deposit bail may be provided for to participate in a commercial tender under the conditions published at the time of the call for tenders. Paragraph 7 (12) shall apply mutatis mutandis. ';
Transitional provision
The declared sale of agricultural parcels carried out prior to the application of this Act shall be completed in accordance with existing legislation.
Efficacy
This Act shall take effect on the day of its publication.
