DECLARATION
of 18 March 2005
amending Decree No. 245 / 2001 Coll., on the details of granting state authorisation for the construction of selected gas installations, its amendment, extension or cancellation
The Ministry of Industry and Trade provides pursuant to § 98 (6) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 670 / 2004 Coll., for the implementation of § 67 (14) of the Act:
Decree No. 245 / 2001 Coll., on the details of the granting of state authorisation for the construction of selected gas installations, its amendment, extension or cancellation, is amended as follows:
1. In Article 2, the following paragraph 2 is inserted after paragraph 1:
"(2) An application for authorisation for the construction of selected gas installations shall be submitted to all new installations, including pipelines, connected to the distribution system of the control station and, in cases of reconstruction of existing selected gas installations, if the replacement of the installation involves a change in the pipeline path or an increase in the capacity of the selected gas facilities. Transfers of selected gas installations shall not be subject to this obligation. ';
Paragraph 2 shall become paragraph 3.
2. In Article 2 (3), after the words "Annex 3 ', the word" a' is replaced by a comma and at the end of the paragraph, the dot is deleted and the words "and the model application for authorisation for the construction of a liquefied natural gas storage tank of more than 10 m3 is added to Annex 7 '.

Notification of amendments
(1) Changes to the information specified in the decision granting authorisation for construction or other relevant data, which are changes to the investor, whether before or during the construction, relating to the authorisation granted for construction, are notified to the Ministry in writing, without delay. The Ministry records these changes to the data.
(2) The change in the date of completion, extension or shortening of the pipeline route, the change in capacity parameters and the change in operating pressure of the selected gas installations shall be considered as changes to the data specified in the decision granting authorisation for construction. ';
4. Paragraph 6 (d), including footnote 1, reads as follows:
"(d) for the protection of the environment where specific legislation on environmental protection so provides (1),
1) Act No. 244 / 1992 Coll., on Environmental Impact Assessment of Development Concepts and Programmes, as amended. Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended. '
5. Annexes 1 to 6 shall read as follows:

2. Characteristics of the purpose of the construction of the direct pipeline.
3. Deadline for the start and termination of construction and the date for direct entry into service.

5. Basic data on direct pipeline
- length (km),
- nominal luminous intensity of the pipeline (in mm),
- max. and min. operating pressure at the connection point (in MPa),
- designed maximum power (1000 m3 / hour),
- transport capacity (million m3 / year),
- estimated annual capacity utilisation (%),
- the place of connection to the transmission system on the territory of the Czech Republic or to the foreign gas system,
- the expected investment costs of the direct pipeline, including connection costs,
- the expected return on investment costs.

An integral part of this application within the meaning of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended, is:
1) A certified extract from the Commercial Register or a certified copy of the contract or instrument of establishment or establishment of a legal person not more than six months old.
(2) Proof of refusal of access to the distribution system.
(3) The opinion of the Ministry of the Environment that the direct pipeline will comply with the environmental regulations, if provided for in specific legislation1).
(4) Agreement between the applicant and the transmission system operator for which the direct pipeline is connected.
5) Documents proving the applicant's financial assumptions for the construction of a direct pipeline.
In case of extension of the application for temporary exemption pursuant to § 67 (7) of Act No. 458 / 2000 Coll. it is necessary to add:
6) A detailed description of the contribution of the selected gas equipment to increasing the safety and reliability of gas supply,
7) Specifications of economic or financial problems arising for the applicant from the construction of the selected gas plant,
8) Duration and scope of temporary removal,
9) Expression of the Energy Regulatory Authority and the Competition Authority.

7. Basic data on gas pipelines connecting an underground gas container with a transmission system or distribution system or other gas installations, with the possibility to remove gas from the gas container

(4) Evidence showing the applicant's financial assumptions to ensure the construction and launch of the underground container, including connecting pipelines, at the expected dates.
5) Expression of the competent authority or zoning authorities according to the scope of the proposed construction on compliance of the proposed construction with the zoning documentation.
In case of extension of the application for temporary exemption pursuant to § 67 (7) of Act No. 458 / 2000 Coll. it is necessary to add:
6) A detailed description of the contribution of the selected gas equipment to increasing the safety and reliability of gas supply,
7) Specifications of economic or financial problems arising for the applicant from the construction of the selected gas plant,
8) Duration and scope of temporary removal,

2. Characteristics of the gas pipeline - including technological and building objects that are part of it - connecting the gas system with foreign gas systems with a detailed justification for the purpose of the construction and its transport function.
3. Start and end of construction and start of the pipeline.
4. Required validity of authorization from - to.
5. Basic data on direct pipeline
- length (km),
- rated clearance (in mm),
- service pressures at input and output (in MPa),
- the planned annual transport capacity (million m3),
- the location of the connection to the transmission system or to the relevant distribution system,

In case the operator and the applicant are one and the same natural or legal person, this Agreement replaces the expression with a justification for interconnection and an assessment of the impact on the existing gas system of the Czech Republic.
4) Method of commercial gas measurement in accordance with Act No. 505 / 1990 Coll., on Metrology, as amended, allowing cross-border gas flow measurement.
5) Evidence showing the applicant's financial assumptions that it is capable of ensuring the construction of a gas pipeline connecting the gas system with foreign gas systems at the expected dates.
6) Expression of the competent authority or zoning authorities according to the scope of the proposed construction on compliance of the proposed construction with the zoning documentation.
In case of extension of the application for temporary exemption pursuant to § 67 (7) of Act No. 458 / 2000 Coll. it is necessary to add:
7) A detailed description of the contribution of the selected gas plant to increasing the safety and reliability of gas supply,
