THE LAW
of 26 May 1995
amending and supplementing certain laws in connection with the adoption of the State Social Support Act
Parliament has decided on this law of the Czech Republic:
Act No. 99 / 1963 Coll., Civil Code, as amended by Act No. 36 / 1967 Coll., Act No. 158 / 1969 Coll., Act No. 49 / 1973 Coll., Act No. 20 / 1975 Coll., Act No. 133 / 1982 Coll., Act No. 180 / 1990 Coll., Act No. 328 / 1991 Coll., Act No. 519 / 1991 Coll., Act No. 263 / 1992 Coll., Act No. 24 / 1993 Coll., Act No. 171 / 1993 Coll., Act No. 117 / 1994 Coll., Act No. 152 / 1994 Coll., Act No. 216 / 1994 Coll., Act No. 84 / 1995 Coll., is amended as follows:
1. In Article 277 (2), the words "child allowance and 'shall be deleted.
2. In Section 301 (2), the words "education, paid for social security pension," shall be deleted.
3. Paragraph 317 (2) is deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
4. in Annex A (§ 248 (3)), the heading Parental allowance is deleted and in the field of Social Security the words "with the exception of the decision on the provision allowance" and the words "Decree No. 76 / 1957 Ú.l., as amended by Decree No. 268 / 1990 Coll., Decree No. 183 / 1991 Coll." shall be replaced by the words "Act of the Czech National Council No. 582 / 1991 Coll., on the organisation and implementation of social security, as amended."
Act No. 2 / 1991 Coll., on collective bargaining, as amended by Act No. 519 / 1991 Coll., is amended as follows:
1. Paragraph 24 (1) is deleted.
Paragraphs 2 to 5 shall be renumbered paragraphs 1 to 4.
2. In Article 24 (2), "paragraph 2 'is replaced by" paragraph 1';
Act of the Czech National Council No. 582 / 1991 Coll., on the organisation and implementation of social security, as amended by the Act of the Czech National Council No. 590 / 1992 Coll., Act of the Czech National Council No. 37 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 307 / 1993 Coll. and Act No. 241 / 1994 Coll., is amended as follows:
1. The following words are added at the end of Paragraph 1: "State Social Support and Social Welfare."
2. in Section 2, point (c), including footnote 5, shall be deleted;
3. in Article 2, point (d), including footnote 6, shall be deleted;
4. In Article 6 (4) (a), points 3 and 4 are deleted and in point 5 the words "and the parental contribution 'are deleted.
5. in Article 6 (4) (a) (11), the words "on the education to him and on the supplement to the education" shall be deleted;
(6) In Article 6 (4) (a), the words "education and supplementary education" and points 14 and 15 shall be deleted from point 12.
7. in Article 6 (4) (a), points 13 and 16 are deleted;
8. in Article 6 (4) (b), the words "and parental contribution" shall be deleted;
9.
"(c) provide financial assistance to jobseekers and arrange for their payment;"
10. in Article 6 (4), points (e) and (f) are deleted.
11. in Paragraph 6 (4) (v), the words "State compensatory allowance 43) or rent allowance 44) 'are replaced by the words" State social aid benefits "and footnote 43) and 44) are deleted."
12. in Article 7 (b), the words "(e), (f)" shall be deleted;
13. in Article 8 (1), the words "State aid" shall be inserted after the words "social security" and the following point (i) shall be added after point (h):
"(i) whether, for the purposes of State social assistance benefits, the citizen is a long-term disabled, a long-term disabled or a long-term sick child."
14. The following words are added at the end of Paragraph 8 (2) (c): "or at the initiative of the district office or capital city of Prague."
15. In Paragraph 16 (1), the following sentence is added at the end: "These facilities have a similar obligation towards the county authorities and the capital city of Prague in connection with the provision of state social aid benefits and to regional authorities and municipalities in connection with the provision of welfare benefits and services."
16. In Article 19 (5), the words "parental contribution or ', the words" (parental contribution)' and the words "(contribution) 'are deleted.
17. in Paragraph 21 (1), the words "and child allowances" shall be deleted.
18. in Paragraph 22, point (c) is deleted.
19. in Paragraph 32, the words "(e) and (f)" are deleted.
20. In Paragraph 49 (2), the words "and survivors' shall be deleted.
21. In Part Six, Title 1, the words "and child allowances' shall be deleted from the heading of Section 1.
22. In § 55, the words "support at the birth of a child, burial," are deleted.
23. In Article 55, the words "and maternity 'are inserted after the words" and' and the words "and child allowances' are deleted.
24. In Paragraph 61, paragraph 3 and the second sentence in paragraph 4 are deleted.
25. Paragraph 66 is deleted.
Section 26, Section 67, is deleted.
27. in Paragraph 86 (1), "(a) to (c)" shall be replaced by "(a) and (b)";
28. Paragraph 86 (4) shall be deleted.
29. Paragraph 113 (1) shall be deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
Part seven is deleted.
31. in Paragraph 116 (1), the second sentence is deleted.
32. in Paragraph 116 (2), the words "except for education," shall be deleted;
33.In Article 127 (1) (b), the words "State aid" shall be inserted after the word "security."
Act of the Czech National Council No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by Act of the Czech National Council No. 10 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 307 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 241 / 1994 Coll. and Act No. 59 / 1995 Coll., is amended as follows:
1. In Paragraph 9 (1), the words "and the parental contribution 'are deleted.
2. In Article 9 (3), the words "and the parental contribution 'and the words" and the parental contribution' are deleted.
3. In Paragraph 9 (4), the words "and the parental contribution 'are deleted.
4. In Paragraph 20 (6), the words "or on a parental contribution 'are deleted.
5. In Paragraph 29, the words "and the parental contribution 'are deleted.
Act No. 153 / 1994 Coll., on News Services of the Czech Republic, is amended as follows:
In Article 20, the following is inserted after the words "income tax,": "reporting of data for the purposes of State social aid."
The Act of the Czech National Council No. 549 / 1991 Coll., on Judicial Charges and Excerpts for Penalties, as amended by the Act of the Czech National Council No. 271 / 1992 Coll. and Act No. 36 / 1995 Coll., is added as follows:
In Article 11 (1) (b), the following is inserted after the words "social security ':" State social aid'.
The Act of the Czech National Council No. 368 / 1992 Coll., on Administrative Charges, as amended by the Act of the Czech National Council No. 10 / 1993 Coll., Act No. 72 / 1994 Coll., Act No. 85 / 1994 Coll., Act No. 273 / 1994 Coll. and Act No. 36 / 1995 Coll., is amended as follows:
In Article 9 (2) (a), the following shall be inserted after the words "on social security ':" on State social aid' and the words "on State benefits' shall be deleted.
Act No. 586 / 1992 Coll., on Income Taxes, as amended by Act No. 35 / 1993 Coll., Act No. 96 / 1993 Coll., Act No. 157 / 1993 Coll., Act No. 196 / 1993 Coll., Act No. 323 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 85 / 1994 Coll., Act No. 114 / 1994 Coll., Act No. 259 / 1994 Coll., Act No. 32 / 1995 Coll. and Act No. 87 / 1995 Coll., is amended as follows:
In Article 4 (1) (i), the following shall be inserted after the words "social welfare ':" State social aid benefits'.
Transitional provisions
(1) Entitlements for the reimbursement of the income of self-employed persons incurred before 1 January 1996 shall be assessed in accordance with the rules in force before that date and the compensation shall be paid by the authorities responsible for the payment in accordance with the rules in force before 1 January 1996.
(2) Entitlements for social welfare benefits conditional on social needs granted on 1 January 1996 under the Social Needs Act (1) shall be assessed as from 1 January 1996, taking into account Article XI thereof.
Efficacy
This Law shall take effect on 1 October 1995, with the exception of Articles I, II (2), 8 to 12, III (3), IV (1) and (2), VI (5), 7, 9, 10, 12 to 15, Article VIII (1), (2), (4), (6), (9), (13) and (14), Article IX (1) and (4), Article XI, Article XIII (2), (5), (6), 11, 17, 18, 21, 23, 26, 27, 30 to 32, Article XVIII (2), Article XXV and Article XXVI, which take effect on 1 January 1996.
