on company archives
The Ministry of Interior of the Czech Socialist Republic provides pursuant to § 31 paragraph 1 (g) of the Act of the Czech National Council No. 97 / 1974 Coll., on archiving (hereinafter referred to as "the Act"):
§ 1
(1) An organisation which has set up a company archive (§ 23 (1) and (2) of the Act) is obliged to manage the archive, i.e. to provide its activities in terms of personnel, financial, material technical and investment, and to develop its activities in general.
(2) The organisation may set up branches of its company archive for its lower organisational units, if an urgent need so requires, in particular taking into account the importance of archives for the activities of lower organisational units or their distance from the company archive.
§ 2
(1) Organisations may conclude an economic contract to deposit archives in a common archive (a joint enterprise archive) to be set up with one of them. In order to establish this archive, the consent of the Ministry of the Interior of the Czech Socialist Republic (hereinafter referred to as the "Ministry of Interior"), which may be withdrawn in the event of non-compliance with the conditions imposed, is necessary.
(2) The economic contract must specify how the costs associated with the establishment and management of the combined business archive and the procedure for its possible division must be met.
§ 3
(1) The archives in the company archives are recorded separately and stored separately from the documents in the file (1) and in the accountancy archives (2).
(2) If the organisations designated by the Ministry of the Interior pursuant to Article 23 (3) of the archival Act hand over to the appropriate archive, they shall pay the costs associated with this by their means.
§ 4
(1) If the organisation that manages the farm archive is cancelled and does not have a legal successor, the Ministry of the Interior will decide, after consultation with the authority that ordered the cancellation of the organisation or, where appropriate, the cancelled organisation, in which the archive or archive of the national committee will be stored, or how it will be handled with archives, if the combined business archive is used.
(2) If the organisation is divided, the company archive will also be decided upon in the delimitation; This requires the approval of the Ministry of the Interior, which also decides to dispose of the archives stored in this company's archive, if no agreement is reached.
§ 5
(1) The head (Director) of the organisation shall entrust the management of the farm archive to a worker of an organisation eligible for professional archiving work (hereinafter referred to as "the manager of the archive").
(2) The management of the archive may be associated with other activities in the organisation only exceptionally, unless the other activity makes it difficult to carry out all the work related to the management of the farm archive.
(3) The head of the archive manages the activities of subordinate staff of the company archive (its branches) and is responsible for the correct storage, clarity and processing of archives. He shall in particular:
(a) ensure the acceptance, registration, accessibility and use of archives and their universal protection;
(b) ensure that the organisation and, where appropriate, its organisational components are properly excluded. (3)
§ 6
(1) The implementation of legislation governing the professional archival activities of the company archives shall be supervised by the Ministry of the Interior, which shall propose to the competent authorities measures to address the deficiencies identified.
(2) Authorised officials of the Ministry of the Interior and, where appropriate, authorised personnel of the State Archives (Section 13 (2) of the Act) are entitled to enter the premises where they are located for the purpose of checking the state of the company archives and files.
§ 7
The organisation which is obliged to establish a company archive (Section 23 (1) of the Act) shall establish it no later than five years after its establishment; However, if, in whole or in part, the archives of its legal predecessor are carried out, they shall set up a company archive at the same time, unless the company archive established by its legal predecessor has been transferred to it.
§ 8
The Order of the Ministry of Interior of the Czech Socialist Republic No. 96 / 1972 Coll., on Business Archives is hereby repealed.
§ 9
This Decree shall take effect on 1 January 1975.
