on the basic conditions of supply to ensure State defence
The Ministry of National Defence, in agreement with the participating central authorities and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides for Article 392 of Economic Code No. 109 / 1964 Coll. ("the law '):
Preliminary provisions
(1) This Decree regulates supplies
1. products, works and performance intended to ensure State defence or security,
(a) articles of an arms nature;
(b) special products which cannot be replaced by products of a civil nature (products manufactured under special technical conditions);
(c) other products inspected by the customer with the supplier;
if collected by the Federal Ministry of National Defence, the Federal Ministry of Interior, the Federal Ministry of Transport and Communications, the Ministry of Interior and Environment of the Czech Socialist Republic and the Slovak Socialist Republic, the Administration of the Department of Correctional Education of the Ministry of Justice of the Czech Socialist Republic and the Ministry of Justice of the Slovak Socialist Republic,
2. in providing the tasks included in the development plan for the products referred to in points 1 (a) and (b) for the Federal Ministry of National Defence, the Federal Ministry of Interior, the Federal Ministry of Transport and Communications, the headquarters of the railway forces, the Ministry of Interior and the Environment of the Czech Socialist Republic and the Slovak Socialist Republic, the Administration of the Department of Correctional Education of the Ministry of Justice of the Czech Socialist Republic and the Ministry of Justice of the Slovak Socialist Republic.
(2) This Order shall apply mutatis mutandis to the supply of repairs to products supplied under this Decree.
(3) This decree does not apply to imports.
Liability for defects (guarantee)
(1) If the guarantee period is not longer or the supplier's unilateral action is not extended, the guarantee period shall be at least 12 months after delivery.
(2) For machinery, apparatus, equipment and their long-term preserved spare parts delivered to the customer's warehouse, the guarantee period shall be at least 36 months after delivery.
(3) Where the supplier makes general repairs to the products, he shall be responsible for the defects of such repairs in the range of at least 60% of the extended warranty period but for at least 6 months.
Efficacy
This Decree shall take effect on 1 July 1964.
