DECLARATION
Ministry of Finance and State Planning Commission
of 30 July 1960
providing means for the maintenance, repair, reconstruction and modernisation of rental homes
The Ministry of Finance and the State Planning Commission, in agreement with the participating central authorities and after consulting the Regional National Committees and certain District and Local National Committees and with the staff of nationwide significant enterprises, shall determine, pursuant to Article 6 of Act No. 41 / 1959 Coll., on the State Planning Commission, pursuant to § 20 (1) (a) of Act No. 8 / 1959 Coll., laying down the basic rules on the State Budget and on the management of budgetary resources, and under § 9 of Act No. 71 / 1959 Coll., on measures concerning certain private property:
I. Preliminary provisions
The housing fund that took over our popular democratic state after the war contained the vast majority of old and unequipped flats. Even though the housing fund has improved since 1948 by building new houses and modifications, it still does not satisfy our needs. Particularly unsatisfactory is the condition of privately owned residential rental houses and their maintenance care.
In order to address the current shortcomings in the care of the rental housing fund and to ensure the maintenance of private rental houses, it is necessary to create favourable conditions for the systematic and planned implementation of modifications to all rental homes with a wide participation of the population. That is why national committees should also take care of planning and implementing modifications to private rental houses to preserve them with timely care and provide their residents with comfortable homes.
(1) Rentals under this Decree are housing houses which are in socialist ownership, as well as rental homes which are subject to the provisions on measures relating to private property. *)
(2) The provisions of this decree do not apply to houses and apartments administered by the Administration of Services to the Diplomatic Choir in Prague.
Modifications under this decree are common and general repairs which are required by the lessor, *) building modifications (modernization), changes in buildings (adaptation, reconstruction) and connections to public facilities. The superstructures and superstructures which give rise to new flats are not included in the modifications under this decree. * *)
II. Planning of adjustments
(1) The organisation of the housing economy of national committees, folk housing cooperatives, construction housing cooperatives, social organisations, national enterprises and other organisations of the socialist sector, which are owned (under the administration) by rental housing houses, shall, in cooperation with the home committees and / or home confidants, draw up a five-year plan and annual plans for the modification of rental homes. If a Revolutionary Trade Union Movement Racing Committee is set up in the organisation, the draft adjustment plan shall also be drawn up in agreement with that Committee; This agreement is not required when it comes to organising the housing economy of national committees.
(2) Owners of private residential rental houses shall draw up forward-looking (five-year) and annual proposals for modifications of their homes in cooperation with the home commissions and / or home confidants, including the requirements of tenants. The proposals will be examined by local national committees in their own investigation. If the owner does not submit the proposal within the prescribed time limit, he or she shall, with the participation of the tenants (the home confidant), draw it up by the local national committee or by drawing it up, with the responsibility of the local organisation of the housing holding.
(3) The overall draft adjustment plan for the municipality (local adjustment plan) is drawn up and provided by local national committees within the framework of the five-year and annual national economic development plans.
The draft adjustment plan (Section 4) shall include in particular:
(a) the type and extent (in Kčs) of the adjustments planned by name (in the case of routine repairs, indicating what craft work normally requires) and the method of its documentation security;
(b) an estimate of the total volume of routine repairs which are not, by name, predictable (random corrections), in the Kčs;
(c) the method of implementation (self-help, supplier, etc.) and the date by which the adjustment is to be made;
(d) the source of the financial compensation;
(e) the material (type and quantity) required for the adjustments to be made to be made to the own staff of the housing organisations of the national committees and to assist themselves in the promotion of cities and communities with civil assistance (hereinafter referred to as "Z"),
(f) requirements for public investment related to house modification;
(g) in the case of private rental houses, the owner's statement as to whether the adjustment will be carried out by his own cost or whether he agrees to make adjustments to the local national committee under the rules on measures relating to certain private property.
(1) The organisation of the socialist sector, which is in the management (ownership) of residential rental houses, will submit draft adjustment plans to the local national committee by the end of May of the current year. The owners of private rental homes shall submit to the local national committee proposals for adjustments within the same period. Local National Committee Proposals of the Plan (Modifications) with stakeholders
(a) examine and determine the degree of urgency of the individual modifications, taking into account the effectiveness of their implementation;
(b) discuss with the District National Committee the volume of proposed modifications to be made by the district (urban) construction company;
(c) propose the widest possible amount of adjustments to be made from local material, production, work and financial resources and identify actions that can be carried out by organised self-help of citizens in Action Z;
(d) discuss the proposed modifications plan with citizens (MNV commissions, street committees, tenants' meetings, houses with business apartments and the relevant organisations and racing committees of the Revolutionary Trade Union Movement, etc.), ensuring their broad assistance and supervision in implementing the proposed modifications.
(2) The local national committee shall, after consulting the proposal for a local adjustment plan to the district national committee, submit a request for production and material security adjustments which it could not provide itself and shall ask it to supplement any missing funds.
(3) The adjustment plan shall be drawn up in accordance with the Committee's economic development plan. If it is not fully secured from the resources of local national committees, it shall be established taking into account the possibilities of national committees of higher degrees.
(1) The District National Committee shall draw up a draft production and material adjustment plan for the district containing:
(a) a comprehensive production plan to ensure the adjustments made by suppliers;
(b) a material security plan to be implemented by the own staff or self-employed tenants of the housing organisation of the national committees;
(c) a plan of public investment and adjustments under the Z-action, which underpin the modernisation of flats (e.g. sewerage, water pipeline), and a plan of modifications to rental houses to be implemented under the Z-action;
(d) a plan for the production of materials for the modification of rental homes from local sources and at the premises of local national committees;
(e) a plan for the financial security of modifications to the rental housing fund.
(2) The District National Committee will ensure that the material and production capacity specified in the rental house modification plan are not used for other purposes. In particular, it shall ensure that the production capacity of a district (urban) construction undertaking is not used for non-agricultural investment construction if the planned modifications of rental homes are not ensured in the district.
(1) After approval of the production and material adjustment plan for the district, the local national committee shall adjust the local adjustment plan and notify the socialist sector organisations and the owners concerned of the private rental housing, who have expressed in the draft adjustment plan (Section 5) that the adjustment will carry out its own costs, that the required adjustments and materials have been included in the plan in order to arrange for them to be executed or delivered by orders from suppliers which they also communicate to them. At the same time, private owners shall be invited to communicate in writing within 8 days, unless they have made an adjustment in their proposal to agree that the arrangements included in the plan should be implemented by the local national committee in accordance with the provisions on measures relating to certain private property. If it is not possible to obtain the consent of the owner of a private rental house, the local national committee shall, pursuant to these regulations, propose that the district national committee decide that an adjustment may be made without such consent. *)
(2) The approved local adjustment plans will be published by the local national committees in an appropriate manner to ensure the widest assistance and control of citizens in their implementation.
III. Production and material security adjustments
(1) The nominally planned modifications to residential rental houses provide production as their main task in addition to the work for the single agricultural cooperatives of district (urban) construction companies as well as production building cooperatives. Regional (urban) construction undertakings must use their production capacity for non-agricultural construction as a priority for the adaptation, while increasing the volume of these works gradually from the annual increase in capacity so that the planned requirements for the modification of the housing stock are covered by production. However, the volume of work on modifications to the housing fund must not go at the expense of the necessary construction of the JZD.
(2) In order to increase the economy and productivity of work, the National Committee, in particular in large cities, will set up specialised facilities for the current repair of facades and roofs for urban construction companies.
(3) Small and routine repairs to the housing fund managed by the housing organisations of the national committees (home administrations), which cannot be foreseen (accidental repairs), and minor repairs to the population, if the needs of the population cannot be met by the district (urban) construction company, the housing organisations of the national committees are provided by their maintenance teams.
(4) Small and routine repairs of other rental homes, in particular privately owned, and small repairs for the population, provided that they cannot be secured by district (urban) construction companies or production building cooperatives, the local national committees provide for them by their unplanned small establishments in accordance with specific regulations. *) In order to increase the interest in making adjustments to private rental houses paid for by national committees, these works are assessed in small-scale establishments of national committees as jobs for the population.
(5) In order to rapidly improve the level of housing (modernisation), the local national committees organise modifications to rental homes and dwellings of civil assistance and use citizens' initiatives and active assistance in particular to develop the extraction and production of the necessary building materials and to implement adjustments that can be made by means of the professional qualifications of citizens (e.g. pensioners). The national committees shall also use the assistance and active participation of citizens in the modification of rental homes to check the quality, scale and prices of repairs made by suppliers and ensure that repairs are not overpriced, reducing the resources to improve the housing fund.
(6) The materials required for the self-help work in the modification of rental dwellings which cannot be obtained from local sources are provided by the district national committees on the basis of the production and material adjustment plan for the district.
(7) Adjustments not covered by this Decree, as well as minor repairs to the dwellings paid by the tenant, * *) are provided by the materials in the market funds, the production of self-help and the district (urban) construction companies and financially from their own resources or by loans to state savings banks.
In order to ensure the performance of the tasks arising from the adjustment plan, the county national committees may increase the number of workers and wage funds in the annual plans of regional (urban) construction enterprises, municipal services and housing organisations and regional associations of production cooperatives under the following conditions:
(a) the improvement of the plan must not jeopardise the implementation of the plan of the number of employees of other enterprises, in particular those managed by ministries (central authorities), and will therefore be covered mainly by recruitment of persons with altered working capacity, domestic women and, where appropriate, young workers;
(b) in proportion to the increase in the planned number of workers, the volume of output and sales from the population must be increased while maintaining the level of labour productivity and the average wage of the sector concerned;
(c) increases can only be made to an organisation that fulfils the staff plans, increases in women's employment and the location of persons with altered working capacity;
(d) the increase may only be made after the reserve has been exhausted in the staff plan and the wage funds of the relevant district national committee or regional national committee or regional association of production cooperatives.
IV. Financial arrangements
(1) Adjustments to rental houses in the management of housing organisations of national committees, folk housing cooperatives, construction housing cooperatives, social organisations, national enterprises and other socialist sector organisations are financed from the resources of these organisations, provided for in their financial plans or budgets established under specific regulations. * * *)
(2) The owner shall be obliged to pay compensation under special rules for the modification of the private rental house by the local national committee. *)
(1) The following shall apply to the financial security of the increased volume of the modification of rental homes:
(a) income from the local housing charge, * *)
(b) the proceeds from the sale of family houses for the housing of national committees;
(c) payments by owners of private rental houses to claims by the local national committee for adjustments made and payments to interest-free loans, †)
(d) the balances in the repair sub-account set up for the special lease account † †) of a private rental house which has become State-owned;
(e) the funds retained by the National Committee in a comprehensive economic analysis as well as the funds deserved.
(2) The resources obtained from the resources referred to in paragraph 1 are mainly intended to finance the modification of rental homes in the direct management of national committees and to finance the modification of private rental homes (Section 11 (2)). Unspent funds are not forfeited at the end of the year and can be used for the intended purpose in the coming years.
(3) In agreement with the national committees to which the resources obtained from the resources referred to in paragraph 1 exceed the resources referred to in paragraph 1, the national higher-level committees may centralise the surplus resources and use them to allocate them to the national committees which lack them.
V. Final provisions
The guidelines of the Ministry of the Local Economy and Finance No. 198 / 1957 Ú. l are hereby repealed on loans for the maintenance of private residential property.
This decree shall take effect from the date of its publication.
