Order of the Minister for Finance
of 28 December 1951
about notarial fees.
In an agreement with the Minister of Justice pursuant to § 26 (3) of Act No. 116 / 1951 Coll., on State notaries:
Fees and tariff items.
(1) Notary fees shall be levied for the activities of state notaries (hereinafter referred to as "fees').
(2) The items and rates of charges are set out in the annexed tariff which forms part of this Regulation.
Spare expenses.
In addition to the charges, the taxpayer is obliged to pay compensation for the actual costs incurred for the operation outside the office of the State notaries ("notaries').
Fees base.
(1) Where the fee is determined according to the price of the subject-matter of the transaction, it shall be charged by the taxpayer.
(2) If the taxpayer does not specify the price of the object of the act or if the price appears to be low, the notary State (hereinafter the notary) shall determine the price of the object of the act according to the content of the notarial registration or the content of the written submission or other document, if the aggregate price of the object of the act of the content is obvious, or the price shall be determined according to earlier budgets, proposals, testimonies and other documents requested from the taxpayer.
(3) As a rule, the price of buildings is not lower than their insurance price.
(4) If the transaction returnees, the price of the transaction shall be set at three times the annual price of the transaction for an indefinite period, for a life period or for a period of more than three years. In the same way, the price of rights corresponding to material burdens shall be determined, in particular rights of consumption, use for their own needs and exchange.
(5) Where the price of the object of the act is determined by the lowest and highest amounts, the basis of the charge shall be the highest amount.
(6) In exchange contracts, the basis of the fee is the price of the exchanged assets at a higher price.
(7) If the price of the object cannot be determined, the price of 15 000 CZK is assumed.
(8) The basis of the percentage fee shall be rounded down to an amount divisible by 100; The basis not exceeding 100 Ccs shall not be rounded. Fees and refunds provided for in Section 2 shall be rounded down to the whole of the Kčs.
(9) The determination of the fee base under this Regulation shall be without prejudice to the provisions on the basis of other charges.
The taxpayer.
(1) The fee shall be payable by whoever requests the action or, if the action is carried out under the authority of the court, by the person in whose interest the action is carried out. If there are several taxpayers, they shall be obliged to pay the fee by hand in common and indiscriminate form; a referee who is not liable for the obligations of the deceased (Section 537 of the Order), but is obliged to pay the inheritance fee only on the basis of the ratio of the price of the item remaining to the price of the whole property left behind.
(2) If one of the participants or applicants is exempt in whole or in part from the fee (Section 5), the other shall be obliged to pay the full fee or the remainder thereof. However, if the heir or the referee is a person exempt from the fee or if part of the State's inheritance, in particular as death, is required to pay the inheritance fee only on the basis of the cost of the inheritance they have acquired.
Exemption from charges.
(1) The Czechoslovak State represented by the national committees and other public authorities, as well as public administration facilities, state institutes and state funds, are fully exempt from the fees and reimbursement of the expenses referred to in Article 2. The exemption for single agricultural cooperatives and its scope shall be determined by the Ministry of Finance.
(2) The Ministry of Finance may, for specific reasons, in particular for the general interest, exempt from fees or charges, reduce or grant other concessions to groups of persons or individuals. For the same reasons and to the same extent, the Ministry of Finance may provide for temporary exemption from fees or other relief, or take appropriate measures to mitigate hardships.
Time of charging.
(1) The fee fixed by the fixed amount shall be charged by the notary before the act is carried out, other charges immediately after the act has been carried out.
(2) If several acts are relevant to each other, the notary shall charge the total fee after the end of the last act, even if one of the successive acts is subject to a fixed fee; the aggregate fee shall be equal to the sum of the charges for each operation.
(3) The bill of lading referred to in § 2 is to be charged by the notary.
Method of charging.
(1) The fee fixed at a fixed amount of up to 1.000 CZK shall be measured orally by the notary and, if not possible, by a written call for payment of the fee; a fee fixed at a fixed amount exceeding 1 000 CZK, a fee determined according to the price of the object of the act and an aggregate fee (Paragraph 6 (2)) shall be charged by the notary with a payment period.
(2) The bill of lading provided for in Section 2 is always measured by the notary with a payment order.
(3) Exceptionally, the notary shall issue a payment notice for a fee set at a fixed amount of up to 1 000 Kčs if he carries out an act of general interest or for a risk of default before the payment of the fee.
Maturity and method of payment of fees.
(1) Fees, measured orally or in writing, are payable before the act is carried out. Fees and compensation for actually incurred expenses, as measured by the payment scale, shall be payable within 15 days of delivery of the notice.
(2) Fees measured orally or in writing shall be paid by stamp. The fees and refunds actually incurred by the payment period shall be paid to the checking account of the district court in whose district the notarial office is situated; if the fee payer is present to pay the amount immediately in the notary, the notary shall confirm it at the payment notice.
(3) The stamp shall be affixed to a notarial registration or to a document remaining in the notarial. The notary shall indicate on the copy of the notarial registration, on the notarial certificate or on other documents issued that the fee has been paid and what amount. Only when the copy (photocopy) of the document or the consent of several originals is verified shall the stamp of the stamp be affixed to the certified copy or to each original. The stamp stamp is degraded by printing a notarial seal.
(4) If there is an aggregate fee (Paragraph 6 (2)) or if the fee has been paid at a written invitation, the notary shall indicate that fact by means of a note on the documents issued; If the document is a certified copy (photocopy) of the document, this note shall be affixed instead of the stamp.
The consequences of failure to fulfil a fee obligation.
If the fee fixed by the fixed amount has not been paid, the notary shall not act unless he so requires a general interest or there is a danger of delay.
Silence.
(1) The right of the State to charge the fee shall be limited by the expiry of three years calculated from the beginning of the calendar year following the year in which the fee was to be charged.
(2) The right of the State to measure the supplement on a fee that has been wrongly assessed by a lower amount shall be limited to three years calculated from the beginning of the calendar year following the year in which the original fee was charged.
(3) The right of the State to enforce the fee (its Appendix) shall be limited to three years from the beginning of the calendar year following the year in which the fee (its Appendix) was due.
(4) If the district court carries out the enforcement action (its supplement) and informs the taxpayer thereof, the new limitation period shall begin to run from the beginning of the calendar year following the year in which such action was carried out.
Repayment of fees.
(1) The District Court shall return the payers from the official office of:
1. the full fee paid,
(a) if the notary refuses to perform a notary act,
(b) if the fee has been written off as a result of a court ruling on a request under Article 26 (2) of the Law on State notaries,
(c) where an exemption has been granted to the taxpayer retrospectively;
2. part of the fee paid, provided that the fee has been reduced retrospectively by a court decision or at the request of the court.
(2) If the taxpayer has paid more than the tariff rate rate set or if the fee has been paid without being obliged to do so, the excess payment shall be refunded at his request if it exceeds 20 CZK.
(3) The amounts recovered are rounded down to the whole of the Kčs.
(4) The right to reimbursement of the fee (excess) shall expire three years after the beginning of the calendar year following the year in which the facts referred to in paragraphs 1 and 2 occurred.
Notary duties and oversight.
(1) Notaries are required to ensure that fees are correctly and in a timely manner assessed and paid.
(2) The judicial authorities are required to ensure that fees are levied in due time.
(3) The judicial authorities shall check by regular supervision that fees are levied and enforced in accordance with the applicable rules. The Ministry of Finance and, according to its directives, the authorities entrusted with it are satisfied by the occasional supervision of the implementation of this Regulation.
Transitional and final provisions.
(1) For claims for remuneration for the activities of an existing notary and for compensation for the missed time which, pursuant to Article 29 (2) of the Law on State notaries, have been transferred to the State, the notary who takes the place of an existing notary shall issue a payment notice.
(2) Where a notary has performed another interlinked act after 31 December 1951, he shall issue a single payment notice after the end of the last act for the entitlements referred to in paragraph 1 and for the fees for the acts carried out after that date.
(3) The provisions of paragraphs 1 and 2 shall not be used if the succession in which the notary continues after 31 December 1951 is discussed.
This Regulation shall enter into force on 1 January 1952.
