on the scope and manner of keeping of the packaging records and reporting of data from that register
According to § 50 (2) of Act No. 477 / 2001 Coll., on Packaging and on the amendment of certain laws (the Law on Packaging), ("the Law on Packaging '), the Ministry of the Environment provides for the implementation of § 15 (3) of the Law on Packaging:
Basic concepts
For the purposes of this decree:
(a) the accounting document - the accounting document (e.g. invoice, delivery note), which confirms the quantity of packages placed on the market or put into circulation, or the quantity of packages withdrawn, or, where appropriate, the method of loading them;
(b) reusable packaging - reusable reusable packaging for which re-use is organised in accordance with point B.1 or B.2 of Annex 2 to the Packaging Act;
(c) energy recovery - incineration of waste from packaging, where the waste used does not require a support fuel after its own ignition and the resulting heat is used for the use of own or other persons, or where the waste is used as fuel or as an additional fuel in energy or material plants under the conditions laid down by legislation on air protection; energy recovery is not the incineration of waste from packaging contained in mixed municipal waste,
(d) a combined packaging for beverages - a packaging in which the paper content is at least 70% by weight of the packaging and is intended for direct contact with the beverage.
Scope and method of keeping records of packaging
(1) Evidence of the quantities and characteristics of packaging placed on the market or put into circulation and of that quantity of reusable packaging shall be kept to the extent and in the manner set out in Annex No 1 or in any other equally conclusive manner.
(2) The recording of the quantities of packaging withdrawn and of the quantities of reusable packaging and of the manner in which it has been handled with the packaging recovered shall be carried out in the extent and manner laid down in Annex 2 or in any other equally conclusive manner.
Scope and method of reporting packaging records
(1) The declaration of quantities and characteristics of packaging placed on the market or put into circulation and of such quantities of reusable packaging shall be made by completing a statement of the quantities of packaging placed on the market or put into circulation, a model of which is given in Annex 3, and by submitting it to the Ministry of the Environment (hereinafter referred to as the Ministry).
(2) The notification of the quantities of packaging withdrawn and of the quantities of packaging returned and the reporting of the way in which the packaging used has been re-taken shall be carried out by completing the statement of the quantities of packaging recovered and their use, the model of which is set out in Annex 4, and by submitting it to the Ministry.
(3) The notification of the quantities of reusable packaging to be recorded under this Order is carried out by completing the statement of the quantities of repayable packaging, the model of which is set out in Annex 5, and by submitting it to the Ministry.
(4) Statements completed by the data referred to in paragraphs 1 to 3 shall be sent to the Ministry by 15 February at the latest in writing and electronic form or in accordance with specific legislation. 1)
This decree shall take effect on the day of its publication.
