DECLARATION

on exemption from judicial fees
In agreement with the Ministry of Justice, the Ministry of Finance provides, pursuant to § 16 paragraph 1 of the Act of the Czech National Council No. 549 / 1991 Coll., on judicial fees, as amended by Act No. 36 / 1995 Coll.:
§ 1
(1) The fee shall be exempt from the legal fee:
(a) notable public health insurance operations;
(b) notional acts in respect of fines, periodic penalty payments and premiums for insurance against general health insurance, public health insurance, social security and contribution to national employment policy;
(c) payment of penalties for infringements of sickness and pension insurance and for compensation for damage caused by sickness and pension insurance.
(2) Health insurance undertakings shall be exempt from the legal fee if they are seeking compensation from a third party by harming the health of the insured person for whose treatment the health insurance undertaking has incurred the cost of health insurance care (regressions).
(3) The exemption provided for in paragraphs 1 and 2 also applies to appeals and enforcement proceedings.
§ 2
The Order of the Ministry of Finance No. 263 / 1997 Coll., on the exemption of certain types of liable acts from judicial fees is hereby repealed.
§ 3
This Decree shall take effect on 1 June 1998.
