Slovak Socialist Republic
of 30 August 1976
on the Slovak Water Inspection
The Ministry of Forestry and Water Management of the Slovak Socialist Republic provides according to § 12 paragraph 1 of the Slovak National Council Act No. 135 / 1974 Coll., on State Administration in the Water Economy:
Basic provisions
(1) A Slovak Water Control Inspection ("Inspection") is hereby established as the expert inspection body of the Ministry of Forestry and Water Management of the Slovak Socialist Republic ("Ministry") in matters of water quality protection and water management.
(2) The inspection shall be managed and carried out by the Chief Inspector appointed and dismissed by the Minister for Forestry and Water of the Slovak Socialist Republic ("the Minister").
(3) Details of the organisation of the inspection shall be laid down by the Minister.
Tasks of inspection in the framework of top water surveillance
The inspection shall supervise:
(a) discharges waste or special waters into surface or groundwater;
(b) the construction, operation and maintenance of waste water treatment plants and other facilities to reduce or eliminate pollution of water discharged into surface or groundwater;
(c) the protection of surface and groundwater from pollution by other substances such as waste water;
(d) protecting the natural accumulation of water and water resources from pollution;
(e) the general use of surface walls and the use of water for navigation and for the swimming of wood, so that such use does not jeopardise the purity of waters;
(f) compliance with the essential obligations in the management of water, where they relate to the protection of waters from pollution, and to the economic and nationwide efficient use of water and compliance with the conditions of agreement of the water authorities concerning the protection of waters;
(g) the cost-effective and efficient management of water, including in the context of the development and application of standards of water needs and consumption, in so far as it is not a general use of surface water or its use for navigation and for the swimming of wood, the use of mining waters and water induction;
(h) carrying out the duties of water management organisations and those handling water and, where appropriate, managing water works, in particular as regards:
1. monitoring the quantity and quality of surface, groundwater, special and waste water;
2. monitoring of substances other than waste water, including radioactivity;
3. preparing preventive measures to protect water from pollution;
(i) compliance with the provisions on payment on water management where they relate to the protection of waters from pollution and to the economical and efficient management of water.
If the inspection finds shortcomings in the activities of the controlled organisations, it shall propose to the water authority the necessary measures to eliminate it and, where appropriate, impose fines. If the inspection considers that a decision of a water operator has been taken in breach of law or other generally binding legislation, it shall initiate its examination outside the appeal procedure.
Cooperation and assistance for inspections of national committees
(1) In carrying out its tasks under this Decree, the inspection shall cooperate with the national committees, in particular as regards the exercise of water-management supervision by the national committees of organisations and the interaction with other bodies and organisations on the water quality protection sector; in these matters, the inspections shall also provide the national committees with proposals and suggestions for their use in the exercise, their water management.
(2) The inspection provides technical assistance to the national committees in particular in expressing their views on the investment activity, preparing changes in the production process or in the scope of the production of organisations, and amending and adapting water-based works which are relevant to the protection of water purity. provide them with technical assistance in preventive action, in particular in the development, implementation and evaluation of measures to prevent and manage pollution of water.
Other inspection tasks
(1) To carry out the tasks of the Ministry in the field of water purity protection inspection:
(a) prepare supporting documents for annual and five-year plans for the construction of waste water treatment plants and other measures to protect water from pollution, including monitoring the preparation and construction of waste water treatment plants and other measures to reduce pollution and statistical evaluation of such construction;
(b) prepare documentation for the opinion of the Ministry on centrally assessed structures affecting water quality;
c) Proceeds from the processing of documents for the conduct of agents of the Government of the Czechoslovak Socialist Republic on border flows in terms of water purity protection and ensures that the measures taken are implemented;
d) keeps an overview of the fines imposed pursuant to the Decree of the Slovak Socialist Republic No. 31 / 1975 Coll., on fines for infringement of obligations imposed on the water sector;
(e) evaluate and keep records of emergency water deterioration;
(f) ensure that the tasks assigned by the Ministry are carried out as a result of the deliberations of the Board of Directors of the water management authorities of the Member States of the Council of mutual economic assistance;
(g) it shall process analyses on the water resources protection section and, on the basis of the surveillance results, propose measures for the long-term development of improved water purity;
(h) it shall develop and ensure compliance with the measures resulting from the resolutions of the State authorities on the protection of the purity of waters against pollution, including the protection of the groundwater of the Rye Island and other protected areas of natural water accumulation; it shall coordinate the implementation of the measures taken by the participating departments;
(i) monitor the allocation of investment limits and capacity coverage of waste water treatment plant buildings at the relevant central authorities;
(j) methodically directs water management services in flow management enterprises;
(k) participate in the development of technical standards on water quality protection and water management and supervise compliance with technical standards in its field of competence.
(2) In addition, the inspections carry out tasks arising from specific provisions. 1)
Authorisation of inspection staff
The provisions of Section 13 of the Slovak National Council Act No. 135 / 1974 Coll., on State Administration in the Water Economy, apply to the right of inspection staff related to the exercise of the main water and supervision under specific regulations.
Cooperation with other institutions and organisations
(1) The inspection in the performance of its tasks shall, in particular, cooperate with the central authorities and their organisations and with the people's control bodies, the health service authorities, the conservation and conservation bodies and social organisations.
(2) In carrying out its tasks, the inspection shall also cooperate with organisations which handle waters and are obliged to designate water operators and provide them with professional assistance.
This decree shall take effect on the day of its publication.
