on costs and savings directly related to the provision of replacement transport for interrupted public passenger rail transport
The Ministry of Transport provides pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 319 / 2016 Coll., to implement § 36 (4) of this Act:
Subject matter
This decree sets out the costs directly related to the provision of replacement services for interrupted public passenger rail transport, the savings associated with the interruption of railway transport and the way in which they are to be identified.
Replacement costs
(1) The costs directly related to the provision of replacement transport shall be the tender price for the provision of replacement transport where the replacement transport has been awarded in the procurement procedure under the Public Procurement Act.
(2) Where replacement transport has not been commissioned in accordance with paragraph 1, the cost of replacement transport shall be the cost of the cost items referred to in Annex 1 to this Decree which are incurred and directly related to the provision of replacement transport, with the exception of costs which cannot be included in the economically justified costs for compensation for public passenger transport compensation under the Order on the procedures for drawing up the financial model and determining the maximum amount of compensation. In this case, the reasonable profit of the replacement carrier shall not exceed 5% of the sum of the values of the other categories of replacement transport costs.
Savings for off-road transport
(1) The savings for uninterrupted rail transport is the difference between the values of the cost items in a situation where the runway would be operated in full according to the timetable established by the rail operator, compared to the situation when the traffic on the runway is interrupted.
(2) The savings for uninterrupted rail transport are the cost items listed in Annex 2 to this Decree.
(3) The total savings related to the cut-off of rail transport are determined as the sum of the differences between the savings categories referred to in paragraphs 1 and 2.
Efficacy
This decree shall take effect on the 15th day following its publication.
