THE LAW
of 29 April 1994
amending and supplementing Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, as amended by Act No. 264 / 1992 Coll., Act No. 267 / 1992 Coll. and Act No. 133 / 1993 Coll., is amended as follows:
1. In Article 3, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) The person entitled shall also be a natural person who fulfils the conditions laid down in paragraph 1 and who, on the date of the transition to the State pursuant to Article 6, has been entitled to it under Decree of the President of the Republic No 5 / 1945 Coll., on the nullity of certain property-law acts from the period of non-freedom and on the national management of the assets of the Germans, Hungarians, traitors and collaborators and certain organisations and institutes, or under Law No. 128 / 1946 Coll., on the nullity of certain property-law acts from the period of non-freedom and on claims arising from this invalidity and from other provisions of Article 2 (1) (c) of the Act, where the transfer or transfer of property law has been declared invalid under these special provisions, and this claim was not met after 25 February 1948 for the reasons referred to in Article 2 (c).
(3) On the date on which the case was referred to the State of the authorised persons referred to in paragraph 2, any of them shall be entitled to do so. "
Paragraphs 2 and 3 shall be renumbered paragraphs 4 and 5.
2. In Article 3, paragraph 2, the words "before the expiry of the period referred to in Article 5 (2) or, if it was declared dead before the expiry of that period," shall be replaced by the words "or the person who was entitled to the case referred to in paragraph 2 before the expiry of the period within which she was entitled to issue the case, or, if she was declared dead before the date preceding the expiry of that period."
3. In Paragraph 13 (6), the words "or 2 'shall be inserted after the words" paragraph 1' and the words "paragraph 2 'shall be replaced by the words" paragraph 4'.
4. In Paragraph 19 (1), the words "or 2 'shall be inserted after the words" paragraph 1' and the words "paragraph 2 'shall be replaced by the words" paragraph 4'.
Čl. II
1. The rights established by this Act in Article I may be exercised by the beneficiaries within six months of the date of application of this Act, the period of 30 days referred to in Article 5 (3) beginning to run from the date of application of the proposal.
2. A case may not be issued if, after 1 October 1991, it has been acquired by a person other than the State or has been approved in respect of such a case by a privatisation project or a decision on its privatisation.
3. The period of one year for the exercise of claims before the court referred to in paragraphs 4 and 5 of Section 5 of the Act for cases referred to in point 1 shall begin to run from the date of application of that law.
4. A period of one year under Paragraph 13 (3) of the Act to claim financial compensation by a person authorised under Article 13 (3) of the Act. Even this law begins to run from the date of its effectiveness. This shall be without prejudice to the period of one year for the entitlement to financial compensation by the person authorised under Article 5 (1). Even this law from the date of the legal power of the judgment rejecting the application for a case.

This Act shall take effect on 1 July 1994.
