Act on the increase of pensions in 1992

THE LAW
of 3 March 1992
on the increase in pensions in 1992
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
§ 1
Pensions awarded before 1 January 1992 and pensions awarded in 1992 are increased on the basis of Sections 9 and 10 of Act No. 46 / 1991 Coll., on increasing pensions, by a fixed amount determined according to the year of the award and the type of pension.
§ 2
Increase in pensions awarded before 1 January 1992
(1) Old-age, disabled and aged pensions are increased as follows:

(2) Widows' pensions shall be increased by 60% of the amount which would be due as an increase in the pension from which the widows' pensions were calculated.
(3) Partial invalidity pensions shall be increased by 50% of the amount which would be due as an increase in the invalidity pension awarded in the same year as a partial invalidity pension.
(4) Orphanage pensions for unilaterally orphan children are increased by 30% of the amount and orphan pensions for both sides of orphan children by 50% of the amount which would be due as an increase in the pension from which those pensions were calculated.
(5) Pensions provided for in the context of other income or income from gainful activities shall be increased by half of the amounts referred to in the preceding paragraphs.
(6) The increase in pensions referred to in the preceding paragraphs shall be due from the payment of the pension due after 31 May 1992.
§ 3
Increase in pensions granted in 1992
(1) Old-age, invalidity, in service of the years, partial invalidity, widow's and orphan's pensions granted from 1 January 1992 to 31 December 1992 are increased by a fixed amount, which is monthly
(a) 290 Cčs, if old-age, disabled and in service of years,
b) 174 CZK, if it is a widow's pension,
(c) 145 Cds, if it is a partial invalidity pension or orphan's pension for a two-sided orphan child;
(d) 87 Kčs, if there is an orphan's pension for a unilaterally orphan child;
(e) half of the amounts referred to in points (a) to (d), if it is a pension provided for in connection with another pension.
(2) The increase in pensions referred to in the preceding paragraph shall be due from the date of the pension.
§ 4
Increase in pensions that are the only source of income
(1) The boundaries of pensions, which are the only source of income, are, pursuant to Sections 54 (1) and 68 (1) of Act No. 100 / 1988 Coll., on Social Security, as amended by Act No. 306 / 1991 Coll., on Changes in Social Security ("Social Security Act"), 1760 Kčs per month and under Sections 54 (2) and 68 (2) of the Social Security Act 2920 Kčs per month.
(2) Pensions paid on 31 May 1992, adjusted as a single source of income, will be increased without application from the payment of the pension due after that date.
(3) The pensions of old-age, disabled, widower, widower and orphan children who have not yet been adjusted as a single source of income and which are below the level laid down in paragraph 1 shall be adjusted at the earliest on request from the payment of the pension due after 31 May 1992.
§ 5
Increase in social pensions
(1) The amount of the social pension provided for in Paragraph 52 (2) of the Social Security Act is no more than 1760 CZK per month for an individual and no more than 2920 CZK per month for such a pension if a family member is also referred to.
(2) Social pensions under Section 52 (2) of the Social Security Act may be granted or increased up to the amounts referred to in paragraph 1 at the earliest on request from the payment of the pension due after 31 May 1992.
§ 6
Common provisions
(1) In order to increase pensions pursuant to § 2 to 4, the provisions of § 2 paragraphs 4 and 5, § 5, § 7 paragraph 1 and § 8 of Act No. 46 / 1991 Coll.
(2) Widows' and orphans' pensions are not increased in accordance with Sections 2 and 3 if they have been calculated from pensions raised under this Act.
§ 7
Transitional provision
Old-age, disabled, for the service of years, partial invalidity, widower and orphan pensions awarded in 1992 before the date of application of this Act shall be increased in accordance with Article 3 on request from the date of the pension.
§ 8
Efficacy
This Act shall take effect on the date of its publication, except for Sections 2, 4 and 5, which shall take effect on 1 June 1992.
