THE LAW
of 10 December 1985
on the conditions under which international organisations operate in the Czechoslovak Socialist Republic
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
(1) The Act lays down the conditions under which an international organisation may be established, operated or established in the Czechoslovak Socialist Republic.
(2) For the purposes of this Act, an international organisation shall mean an international non-governmental organisation.
(3) Under this law, a special organisation may also be established for the representation of Czechoslovak interests in an international non-governmental organisation.
(1) An international organisation may be established, operated and established in the Czechoslovak Socialist Republic only on the basis of an authorisation granted under this Act.
(2) An application for authorisation to establish an organisation with an international element or authorisation to operate or have its registered office in the Czechoslovak Socialist Republic shall be submitted to the Federal Ministry of Interior. The applicant for authorisation to establish an international organisation in the Czechoslovak Socialist Republic attaches to the application a draft document governing the organisation's rules and content of the organisation's activities; an international organisation requesting authorisation to pursue an activity or have its seat in the Czechoslovak Socialist Republic shall attach to the application a document governing the organisation's rules and content of the organisation's activities (hereinafter referred to as the "Statutes').
(1) The Federal Ministry of the Interior may, in agreement with the Federal Ministry of Foreign Affairs and after consultation with the competent central authorities of the state administration, authorise the establishment of an organisation with an international element or allow such an organisation to operate or have its seat in the Czechoslovak Socialist Republic,
(a) where its statutes and, where appropriate, their proposals and its activities do not conflict with the Czechoslovak law;
(b) when the organisation is established as a legal person (1); and
(c) unless otherwise serious.
(2) An international organisation may, in addition to its activities, carry out an economic activity in the Czechoslovak Socialist Republic on the basis of an authorisation and under the conditions laid down in specific legislation.2)
(1) Where an international organisation develops an activity which does not comply with the conditions set out in Paragraph 3 (1), the Federal Ministry of the Interior may suspend its activity or withdraw the authorisations granted under Paragraph 3 (1).
(1) The Ministry shall keep records of international non-governmental organisations and their organisational units which are entitled to act on their behalf and of organisations established under Article 6 of this Act.
(2) Organising units authorised to act on their behalf shall notify the Ministry of the name, registered office, date of their establishment and termination, as well as the name of the international non-governmental organisation under whose statutes they have been established. This information shall be notified to the Ministry within 15 days of the date on which it was created or destroyed. The change of name and registered office shall be notified to the Ministry within 15 days of the date on which their competent authorities have decided on the matter.
(3) The name and registered office of an international non-governmental organisation or organisation referred to in Article 6 of this Act, the date of its establishment and termination, as well as the information referred to in paragraph 2, shall be entered by the Ministry in the basic register of legal persons, natural persons and public authorities (hereinafter referred to as the "basic register of persons"), including the legal form. Within the time limits laid down by the Special Act (3), the Ministry shall also enter in the basic register of persons an amendment to those facts.
(4) The Ministry may use reference data from the basic register of the population in the scope of names, names, surnames, addresses of the place of residence and dates of birth to perform the administration on the authorisation section of organisations with an international element.
(1) The Federal Ministry of the Interior, in agreement with the Federal Ministry of Foreign Affairs, may, on a proposal from the competent central government authority, authorise the establishment of special organisations for the representation of Czechoslovak interests in international NGOs.
(2) Special organisations for the representation of Czechoslovak interests in international NGOs are socialist organisations; the rules on voluntary organisations apply mutatis mutandis to their establishment, demise and supervision of their activities.
Organisations covered by this Act which have been granted an authorisation to establish or have their registered office in the Czechoslovak Socialist Republic pursuant to existing regulations shall be deemed to have their registered office in the Czechoslovak Socialist Republic under this Act.
This Act shall take effect on 1 January 1986.
