DECLARATION
of 26 April 2019
amending Decree No 373 / 2016 Coll., on the transmission of data to the National Health Information System
The Ministry of Health provides, pursuant to Section 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended by Act No. 147 / 2016 Coll. and Act No. 111 / 2019 Coll., for the implementation of § 74 paragraph 1 (o) and § 78 of the Health Services Act:
Decree No 373 / 2016 Coll., on the transmission of data to the National Health Information System, is amended as follows:
1. In Section 3, the text "No 1 'is inserted after the word" Annex'.
2. In Article 3, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The list of groups of medical devices used by providers in the provision of health services and relevant to the availability of health services (" significant medical device ') and the scope of their data to be transmitted to the National Register of Providers is set out in Annex 2 to this Decree.';
3. In Annex No 1, Part 1, point 1.1 (b), the words "and cervical dysplasia 'are inserted after the words" nebulous neoplasms' and the words "N87 'are inserted after the words" D10-D36'.
4. Point 7.1 of Part 7 of Annex 1, including footnotes 4, 5 and 8, reads as follows:
"7.1. Heading of providers and other persons transmitting data:
7.1.1. Any health service provider providing professional care under Section 27 of the Law on Health Protection against the harmful effects of addictive substances (4), if it is for health services.
7.1.2 Each provider of social services (8) providing professional care under Section 27 of the Law on Health Protection from the harmful effects of addictive substances (4), if it is about social services5).
4) Act No. 65 / 2017 Coll., on the protection of health against harmful effects of addictive substances, as amended.
5) Act No. 108 / 2006 Coll., on Social Services, as amended.
8) Paragraph 70 (4) (f) of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended. '
5. In Annex 1, Part 13, point 13.1, the text reads:
"Each body referred to in Section 75 (1) of the Health Services Act; where significant medical devices are involved, the data shall be transmitted by each provider using them in the provision of health services. ';
6. In Annex No 1, Part 13, point 13.2, the following point 13.2.3 is added:
"13.2.3. Data on major medical devices used in the period 1 January to 30 June and from 1 July to 31 December of the calendar year shall be transmitted by the end of each calendar month following that period. ';
7. The Annex is renumbered Annex 1 and Annex 2 is added, including footnote 9:

List of groups of major medical devices and the scope of data transmitted to the National Register of Health Service Providers
1. List of groups of major medical devices
Groups D.1.1 - D.1.3, D.1.4.1, D.3.1, D.4.1.4., D.5.3.1.2, T.1.1 - T.1.4, T.2.2.2.1, T.3.1.1.2., T.3.2.1., T.3.3.1, T.3.4, T.5.6.4, T.5.9., T6.1 and O.3. according to the classification of categorisation of medical technicy9).
2. Scope of data transmitted on major medical devices
Name, additional description, alphanumeric code according to the classification of the medical technology categorisation, date of acquisition of the significant medical device and address of the medical facility where the significant medical device is used.
9) Communication from the Czech Statistical Office No. 105 / 2018 Coll., on the introduction of the classification of medical technology categorisation (KZT). "
Efficacy
This Regulation shall enter into force on 1 July 2019.
