implementing certain provisions of the Arms Act
According to Article 79 (2) and (3) of Act No. 119 / 2002 Coll., on firearms and ammunition (Act on Weapons), as amended by Act No. 228 / 2003 Coll., Act No. 484 / 2008 Coll. and Act No. 170 / 2013 Coll., to implement § 17 (2) (c), § 21 (9), § 21a (8), § 30 (13), § 39 (7), § 39a (4), § 49 (1), § 50 (9), § 50a (3), § 52 (7) and § 73a (10) of the Arms Act:

INTRODUCTORY PROVISIONS
§ 1
Subject matter
This decree provides for:
(a) the requirements of the technical execution of the photograph;
(b) the content of the theoretical and practical part of the proficiency test, the overall assessment of the applicant's proficiency test for the issue of the arms licence and the level of remuneration of the examiner;
(c) the content of the theoretical part of the examination, the method of carrying out the practical part of the examination, the overall evaluation of the examination of the examiner and the method of issuing the test commissioner's certificate;
(d) the content of the theoretical and practical part of the proficiency test and the overall assessment of the applicant's proficiency test for the issue of a group F armaments licence;
(e) requirements for the security of weapons and ammunition during transport;
(f) the mandatory content of the operating order of the shooting range;
(g) how to keep records of weapons and ammunition in the arms and ammunition business and how to carry out training rounds;
(h) the method of keeping documentation of unexploded ammunition and explosives; and
(i) models of cards, applications, applications, certificates, notifications and required electronic form pursuant to Section 73a (7) of the Weapons Act.
§ 2
Photographs of the applicant
[Paragraph 17 (2) (c) of the Arms Act]
(1) The photograph has a smooth surface and is in black and white or colour. The photo is rectangular with dimensions 35 mm x 45 mm, built on a shorter side with straight or rounded corners with R = 3 mm + / - 0,5 mm with thickness from 0,13 mm to 0,27 mm.
(2) The photograph shows the head and shoulders of the person displayed. The person is shown in the front view in such a way that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The view of the person displayed is directed to the lens.
(3) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm.
(4) The background behind the displayed person is white to light blue, allowing for smooth transition of these colors. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. Could not perform retouches and other modifications of the photo.

TRAINING ELEMENTS TESTS

Díl 1

The applicant's proficiency test for the issue of a group armaments licence A to E
§ 3
Duration of the applicant's proficiency test for the issue of a group arms licence A to E provides for other legislation1).
§ 4
Content of the theoretical part of the test
The theoretical part of the test shall be carried out by a written test lasting no more than 40 minutes, consisting of 30 questions, of which 22 are questions of knowledge of the legislation evaluated by 3 points, 5 questions of knowledge of the teaching of weapons and ammunition evaluated by 2 points and 3 questions of knowledge of the medical minimum evaluated by 1 point.
Content of the practical part of the test
§ 5
(1) In the practical part of the test, the applicant shall demonstrate the knowledge of safe handling of the weapon
(a) a inspection of the weapon to determine whether it is in a loaded state;
(b) the partial disassembly and composition of the weapon to the extent necessary for the normal cleaning of the weapon after the shooting; and
(c) the procedure for the preparation of the weapon and the ammunition for the shooting, for the interruption of the shooting, for the detection of a defect in the weapon during the shooting and at the end of the shooting.
(2) Weapon or weapons to demonstrate the activities referred to in paragraph 1 and to shoot a fixed target pursuant to Article 6 shall be designated by the Examination Commissioner to the applicant.
(3) In order to demonstrate the activities referred to in paragraph 1, a weapon or ordinary-type weapon shall be used corresponding to the arms licence group indicated by the applicant in the application.
(4) When performing the activities referred to in paragraph 1, they shall be used as ammunition for cartridges not containing diaphragm, impactor or matchstick.
§ 6
(1) Following the demonstration of the activities referred to in Section 5 (1), the applicant will carry out a fixed target shooting. The use of weapons of the usual type corresponding to the arms licence group indicated by the applicant in the application shall be made for a fixed target shooting. In so doing, it shall always apply to applicants for an arms licence:
(a) Group A and B long ball or short ball gun;
(b) Group C long ball and long shotgun; or
(c) Group D and E short ball gun.
(2) The fixed-target shooting is carried out at the shooting range in accordance with Section 52 of the standing arms law, and the applicant for the issue of an arms licence is obliged to use appropriate protective equipment to be specified by the test commissioner or to be specified by the operating order of the shooting range. Notwithstanding the previous sentence, the applicant is authorised to use medical devices (2) which he normally uses, unless their use prevents the maintenance of the principles of safe handling of arms and ammunition and compliance with the safety rules of the shooting. Only an applicant for the issue of a group A, B or C weapons licence may use the weapon support in the shooting, if it is a long ball gun.
(3) It is possible to use a long or short ball gun of 22 LR, or 5.6 mm, to fire a long or short ball gun; to fire a long and short ball gun, a single bullet bullet shall be used. A long shotgun or combination weapon with a main calibre of 12 or 16 shall be used to fire a long shotgun and a multiple-shot shotgun with a shot size between 2,4 mm and 3,5 mm.
(4) The target shall be a 50 / 20 pistol international target or a 550 x 550 mm white target with an external diameter of 500 mm and a black round centre with a diameter of 200 mm and a small-scale target or a white target with an external diameter of 155 mm and a black circle centre with a diameter of 112 mm fixed in the target area.
(5) Prior to the start of the assessed shooting, the applicant for the issue of an arms licence shall be entitled to verify the accuracy of the shooting of the weapon, in the case of a short ball and long ball gun, by three shots and in the case of a long shotgun with one shot.
§ 7
Evaluation of the theoretical part of the test
(1) In the theoretical part of the test, the applicant shall be assessed as "benefit 'if, without help and aids, he obtains at least the written test
(a) 67 points if there is a request for a group A armaments licence test;
(b) 71 points if there is a request for an examination for the issue of a B and C arms licence; or
(c) 74 points if there is a request for a test to be carried out for the issue of a D and E arms licence.
(2) If an application for a multi-group armaments test is made, the applicant shall be assessed as "benefit 'if he reaches at least the required points in the written test for the group for which the most points are required.
(3) If, in the theoretical part of the test, the applicant is assessed as "non-profit ', the practical part of the test is no longer performed and the overall result is assessed as" non-profit'.
§ 8
Assessment of the practical part of the test
(1) In the practical part of the test, the applicant shall be assessed as "benefit 'if, in addition to the management of the activities referred to in § 5 (1), when shooting at a fixed target in accordance with § 6, it achieves:
(a) at least 2 shots at the target from a long ball gun at a distance of 25 m from 5 possible shots at a time of not more than 5 minutes or at least 2 shots at the target from a short ball gun at a distance of 10 m from 5 possible shots at a time of not more than 5 minutes, if the application for a test to be carried out for the issue of a group A firearms licence is requested,
(b) at least 4 shots at the target from a long ball gun at a distance of 25 m from 5 possible shots at a time of not more than 5 minutes or at least 4 hits at the target from a short ball gun at a distance of 10 m from 5 possible shots at a time of not more than 5 minutes, if the request for a test to be carried out for the issue of a category B weapon pass is requested;
(c) at least 4 shots at the target from a long ball gun at a distance of 25 m out of 5 possible shots at a time of not more than 5 minutes and at least 3 shots at a distance of 25 m out of 2 possible shots at a time of not more than 3 minutes, if the request for a test to be carried out for the issue of a category C weapon pass is requested;
(d) at least 4 hits at the target from a short ball gun at a distance of 15 m from 5 possible shots within a maximum of 2 minutes if the application for a test to be carried out for the issue of a D-category weapon pass is made; or
(e) at least 4 hits on the target from a short ball gun at a distance of 10 m out of 5 possible shots within a maximum of 3 minutes, if a request is made for a test to be carried out for the issue of an E-category weapons licence.
(2) Target contact means contact with the target with a shot or a shotgun into the space of the pictorial circles displayed on it.
(3) If, in the practical part of the test by self-fault, the applicant infringes the principles for the safe handling of arms and ammunition, thereby endangering or endangering the safety of persons in practice, the examiner shall immediately terminate the test and, in the practical part of the test, evaluate the applicant with a "non-profit 'degree.
§ 9
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test shall be assessed by the examiner by the degree "benefit 'or" benefit'. The degree of evaluation shall be indicated in the application form for the proficiency test and the evaluation of the applicant's proficiency test for the issue of an arms licence, a model of which is given in Annex 4 to this Decree.
(2) The examination shall be assessed by the Examination Commissioner by a "benefit" level if the applicant reaches "benefit" from both parts of the evaluation.
§ 10
Repeating the practical part of the test
An applicant who has been assessed in the theoretical part of the test as "benefit 'and in the practical part of the test as" fail' may repeat the practical part of the test at least 15 working days and no later than 2 months from the date on which it was assessed in the practical part of the test as "fail '. The period for repeating the practical part of the test shall be determined by the competent police department without delay, but no later than 15 working days from the date on which the practical part of the test was assessed as" non-profit'. If, in order to repeat the practical part of the examination, the applicant requests the appointment of another examiner, the competent police department shall comply with the request.
§ 11
Remuneration of the Examination Commissioner
A fee shall be paid to the Assistant Commissioner for Participation in the exam or in the repetition of the practical part of the exam of the applicant for an armaments licence. The reward of the exam commissioner for attending the exam or for repeating the practical part of the exam is CZK 600 for each applicant for the issue of an armaments licence.

Test
(Paragraph 30 (13) of the Arms Act)
§ 12
Content of the theoretical part of the test
The theoretical part of the test shall be carried out by a written test of not more than 80 minutes, consisting of 60 questions, 52 questions of knowledge of legislation, 5 questions of knowledge of knowledge of weapons and ammunition and 3 questions of knowledge of the medical minima, and an oral interview of not more than 20 minutes by which the applicant certifies knowledge under Paragraph 30 (7) of the Arms Act.
§ 13
Content of the practical part of the test
(1) In the practical part of the test, the applicant gradually
(a) demonstrate a search of at least two weapons as determined by the Examination Committee in order to determine whether the weapon is in a loaded state;
(b) demonstrate the partial disassembly and composition of at least two different types of weapons, as determined by the Test Panel, to the extent necessary to clean up the weapon after the shooting;
(c) demonstrate the procedure for the preparation of the weapon and ammunition for the shooting, for the interruption of the shooting, for the detection of a defect in the weapon during the shooting and at the end of the shooting; and
(d) demonstrate knowledge from the shooting control procedure.
(2) In order to demonstrate the activities referred to in points (a) to (c) of paragraph 1, the types of weapons corresponding to all arms licence groups shall be used, and ammunition shall be taken as ammunition, not containing bulletins, impactor or match matches.
§ 14
Evaluation of the theoretical part of the test
The theoretical part of the test is evaluated by the "benefit" degree in case the applicant correctly answers without help and aids at least 57 questions from the written test and subsequently certifies knowledge in accordance with Section 30 (7) of the Arms Act during the oral interview.
§ 15
Assessment of the practical part of the test
(1) The practical part of the test is assessed by the "benefit" degree if the applicant demonstrates that the activities referred to in Paragraph 13 (1) are managed.
(2) If, in the practical part of the test, the applicant infringes the principles for the safe handling of arms and ammunition, thereby endangering or endangering the safety of persons in practice, the test committee shall terminate the test and evaluate the test with a "no-good 'degree.
§ 16
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test shall be assessed by the test panel by the degree "benefit 'or" benefit'. The degree of evaluation shall be indicated in the assessment form of the applicant for appointment by the Examination Commissioner, the model of which is set out in Annex 14 to this Decree.
(2) The examination shall be assessed by the Examination Panel by "benefit" if the applicant reaches "benefit" from both parts of the evaluation.
§ 17
Issue of a pilot's licence
The Ministry of the Interior shall issue to the Examination Commissioner after his appointment with a certificate of the Examination Commissioner. The Ministry of the Interior will inform the Police of the Czech Republic about the issue of the licence.

The applicant's proficiency test for the issue of a group F weapons licence
(Paragraph 21a (8) of the Arms Act)
§ 18
Content of the theoretical part of the test
The theoretical part of the test shall be carried out by a written test lasting not more than 60 minutes, consisting of 50 questions, of which 12 are from knowledge of legislation, 10 are from knowledge of regulations governing the handling of ammunition and explosives, 25 are from knowledge of ammunition, explosives and detection techniques, and 3 are from knowledge of medical minima. The correct answer to each question is evaluated by 3 points, except for the correct answers to questions about knowledge of the medical minimum, which are assessed by 1 point. The theoretical examination also includes an oral interview lasting not more than 45 minutes by which the applicant certifies knowledge under Section 21a (3) of the Weapons Act.
§ 19
Content of the practical part of the test
In the practical part of the test, the applicant shall gradually demonstrate all acts referred to in Section 21a (4) of the Weapons Act.
§ 20
Evaluation of the theoretical part of the test
(1) In the theoretical part of the test, the applicant shall be assessed by "benefit 'if, without help and aids, he obtains at least 135 points from the written test and subsequently certifies knowledge in accordance with Section 21a (3) of the Arms Act in the oral interview.
(2) If, in the theoretical part of the test, the applicant is assessed as "non-profit ', the practical part of the test is no longer performed and the overall result is assessed as" non-profit'.
§ 21
Assessment of the practical part of the test
(1) In the practical part of the test, the applicant shall be assessed as "benefit 'if he can handle the activities referred to in § 19.
(2) If, in the practical part of the test, the applicant fails to comply with the principles for the safe handling of ammunition and explosives, thereby endangering or endangering the safety of persons in practice, the test committee shall terminate the test and evaluate the applicant in the practical part of the test with a "no good 'degree.
§ 22
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test shall be assessed by the Trial Panel by a "benefit 'or" benefit' evaluation. The degree of evaluation shall be indicated in the evaluation form of the applicant's proficiency test for the issue of a group F armaments licence, a model of which is given in Annex 7 to this Decree.
(2) The examination shall be assessed by the Examination Panel by "benefit" if the applicant reaches "benefit" from both parts of the evaluation.
§ 23
Repeating the practical part of the test
An applicant who has been evaluated in the theoretical part of the test by "benefit 'and in the practical part by" benefit' may repeat the practical part of the test once on the basis of a written request submitted to the Ministry of Interior within 2 months of the date on which he failed in the practical part of the test.

ČÁST TŘETÍ

TRANSPORT SECURITY
(Articles 50 (9) and 50a (3) of the Arms Act)
§ 24
(1) The provisions of this Part shall not apply to the security of arms or ammunition in air transport.
(2) The provisions of this Part shall not apply where ammunition, including ammunition, is secured during transport in accordance with the requirements of the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) 3.
§ 25
(1) Category B or C weapons of up to 20 pieces or ammunition of up to 20 000 rounds shall be secured during transport by ensuring the continuous control of the arms and ammunition carried by the person transporting them, unless they are secured in accordance with paragraph 2 or 3.
(2) Weapons of category A or category B or C weapons of up to 100 pieces or ammunition of up to 200 000 rounds shall be secured during transport if they are not secured in accordance with paragraph 3,
(a) ensuring constant control of the arms and ammunition transported by at least 2 persons carrying out the transport;
(b) by locking it in a fixed container,
(c) the use of a special locked device which prevents the handling of arms and ammunition and prevents the separation of any essential part of the weapon, unless it is otherwise ensured that the arms or ammunition transported cannot be handled by normal means; or
(d) the equipment of the means of transport by means of a device which allows continuous monitoring of its movement and is registered and registered in the movement monitoring system throughout the period of transport; This method of securing the transported weapons and ammunition can be used in agreement with the Czech Police, and it is necessary to transmit data to the extent of Section 50a (1) of the Arms Act.
(3) Weapons of category A, B or C of more than 100 weapons or ammunition of more than 200,000 rounds of ammunition or any quantity of ammunition are secured
(a) locking in the hold and securing
1. constant controls of the arms and ammunition transported by at least 2 persons carrying out the transport;
2. the protection of the cargo hold or transported arms or ammunition by an electronic security device which, in the event of detection of an event presenting a risk to the arms or ammunition being carried, activates an acoustic warning device or allows the transmission of a message of such an event by an alarm transmission system to a person authorised to take measures to ensure the safety of the arms or ammunition being carried; or
3. such security of the arms or ammunition transported which prevents the normal handling of the cargo and prevents the separation of part of it, such as the attachment of the arms or ammunition transported on the pallet or similar means of transport; or
(b) by locking in a container approved for intermodal transport4).
(4) The person carrying out the transport shall be the person present in the means of transport, in particular the driver, the crew member, the security guard or the accompanying vehicle.
(5) The transported weapon must be in unloaded condition, which means that the weapon is not charged with charge in the container, in the cartridge, in the chamber of the barrel or in the cartridge chambers of the revolver cylinder. Where weapons are transported by the same means of transport as ammunition, the ammunition shall be transported separately from the weapons.
§ 26
In agreement with the relevant police department, a means of securing weapons or ammunition during transport other than that provided for in this Part may also be used, provided that proper security of the arms or ammunition carried is ensured during transport against misuse, loss or theft.

OPERATING RULES OF THE CULTURAL
(K § 52 (7) of the Arms Act)
§ 27
(1) The mandatory content of the shooting range's operating order are:
(a) the name, names, surname and date of birth of the natural person or data identifying the legal person of the shooting gallery operator;
(b) an indication of the location where the shooting range is operated, including an indication of the owner of the property on which the shooting range is operated, unless it is identical to the shooting range operator;
(c) whether the shooting range is used for business purposes;
(d) a statement as to whether the shooting range is open to the public;
(e) the date of termination of the shooting range when the shooting range is for a fixed period;
(f) the definition of the time of day and year during which shooting is permitted at the shooting range and the rules governing the registration of persons using the shooting range;
(g) the name and, where applicable, the name, surname and telephone contact of each designated shooting gallery manager, the model of the designation of the shooting range manager, which includes the indication of the function, the name and surname and the name of the shooting range,
(h) an indication of the privileges and responsibilities of the shooting gallery manager and, where appropriate, of other persons, in particular the shooting range operator, medical services, organizers;
(i) a clear picture of the shooting range showing the permitted direction of the shooting and means to ensure safety during the shooting;
(j) an indication of the types of weapons authorised to fire and the production of ammunition and the highest performance of ammunition, and, where appropriate, of the most powerful permitted ammunition authorised to fire;
(k) permitted means of shooting from individual types of permitted weapons and minimum and maximum range of shooting;
(l) rules on the safety of shooting range operations, in particular the principles of gun handling and shooting range ammunition, safety rules on shooting and movement of persons in the shooting range area;
(m) the emergency procedure; and
(n) other communications relevant to the technical solution of the shooting range and the safety of its operation.
(2) In the event of a change in the mandatory contents of the shooting range operating rules referred to in points (i) to (l) of paragraph 1, a re-verification of the operating rules of the shooting range shall be carried out by the ballistics expert; This is without prejudice to the obligation of the shooting gallery manager pursuant to § 55 (2) (b) of the Weapons Act to ensure the accessibility of the operating order of the shooting range certified by the ballistics expert.

METHOD OF EVIDENCE AND DOCUMENTATION
§ 28
Record Book
(K § 39a (1) of the Arms Act)
(1) The records of weapons of category A, B or C and ammunition in those weapons owned by the holder of the arms licence and for which he has a gun licence (hereinafter referred to as the record book) shall include:
(a) the serial number of the registration;
(b) the date of acquisition or transfer of the weapon or ammunition;
(c) particulars of the weapon or ammunition;
(d) the name and, where applicable, the name, surname and date of birth of the natural person or data identifying the legal person from which the holder of the arms licence acquired the weapon or ammunition;
(e) the name, name, surname and date of birth of the natural person or data identifying the legal person to whom ownership of the weapon or ammunition has been transferred; and
(f) the name or, where appropriate, the name, surname and signature or the recognised electronic signature of the person making the registration.
(2) If the record book is kept using the electronic application of the central weapons register, the data referred to in paragraph 1 (a) and (f) shall not be recorded by the person referred to in Paragraph 32 (1).
§ 29
Registration book
[K § 73a (10) (b) of the Weapons Act]
In the electronic application of the central register of weapons in which the Registration of Category A, B or C weapons and ammunition are maintained in those weapons, black hunting powder, powder and matches which are the subject of the activities referred to in Section 2 (2) (d) of the Arms Act, and black hunting powder, powder and matches (hereinafter referred to as the "Registration Book '), the holder of the arms licence and the authorised persons shall be registered by means of a certificate issued by an accredited certification service provider, by a user name and password.
§ 30
Book of expenditure and income
(Paragraph 39a (2) of the Arms Act)
(1) The records of arms and ammunition issued and received (hereinafter referred to as the "Issue and Receipt Book") are divided into "Issued" and "Returned" sections; the electronic output and income book shall allow for a similar breakdown of entries.
