supplementing Act No. 403 / 1990 Coll., on the mitigation of the consequences of certain property injustices, as amended by Act No. 458 / 1990 Coll., Act No. 528 / 1990 Coll., Act No. 137 / 1991 Coll. and Act No. 264 / 1992 Coll., and amending Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, as amended by Act No. 264 / 1992 Coll., Act No. 267 / 1992 Coll. and Act No. 133 / 1993 Coll.

Parliament has decided on this law of the Czech Republic:

Čl. I

Act No. 403 / 1990 Coll., on the mitigation of the consequences of certain property injustices, as amended by Act No. 458 / 1990 Coll., Act No. 528 / 1990 Coll., Act No. 137 / 1991 Coll. and Act No. 264 / 1992 Coll., is added as follows:

In Article 19, the following paragraph 5 is added:

"(5) If the Ministry of National Property Administration and its privatisation fails to comply with the obligation within the time limit referred to in paragraph 4, the refund shall be increased by 1% for each month beginning from the date of expiry of that period until the date of granting of the refund."

Čl. II

1. Compensation claims pursuant to Act No. 403 / 1990 Coll., on the mitigation of the consequences of certain property injustices applied within the period of Paragraph 19 (1) and (3) and not satisfied within the period of Paragraph 19 (4), and the increase in compensation pursuant to Paragraph 19 (5) shall be due within three years of the date of application of this Act. This does not apply to claims for compensation which have been brought before the courts to the effect of this law.

2. Refunds granted to the effectiveness of this Act shall be adjusted in accordance with Paragraph 19 (5) and the relevant amounts shall be paid by the Ministry of Administration of National Property and its privatisation no later than three years after the effectiveness of this Act.

Čl. III

Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, as amended by Act No. 264 / 1992 Coll., Act No. 267 / 1992 Coll. and Act No. 133 / 1993 Coll., is amended as follows:

Paragraph 13 (4) is deleted.

Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.

Čl. IV

1. Entitlement to financial compensation under Act No. 87 / 1991 Coll., on out-of-court rehabilitation, applied until the effective date of this Act within the period referred to in Paragraph 13 (3) and not satisfied within six months of the date of receipt of the request, shall be payable within three years of the date of application. This does not apply to the right to a financial refund which has been brought into force by the court.

2. At the request of a financial compensation pursuant to § 13 (3) of Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, submitted after the effectiveness of that Act, the competent central government authority shall provide financial compensation no later than one year after the date of receipt of the application.
