amending and supplementing Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries, as amended by Act No. 158 / 1973 Coll., the statutory measure of the Bureau of the Federal Assembly No. 17 / 1976 Coll. and Act No. 149 / 1979 Coll. is amended as follows:
Paragraph 51 to 54, including the title, reads:
"State Commission for Scientific, Technical and Investment Development
The State Commission on Scientific, Technical and Investment Development ("the State Commission ') is a federal central body of the State Administration for Scientific, Technical and Investment Development.
State Commission
(a) elaborates proposals for the content and focus of the single state scientific and technological policy, its guidelines, including the principles of its comprehensive security and implementation, and presents them to the Government of the Czechoslovak Socialist Republic; cooperate with the State Planning Commission in the preparation of the draft concept of a single State Investment Policy and prepare comprehensive technical and economic documentation for it;
(b) cooperate in the processing of state programmes and compile them in the Government of the Czechoslovak Socialist Republic in specified cases, organise their security, monitor and evaluate their implementation;
(c) in accordance with the principles approved by the Government of the Czechoslovak Socialist Republic, participate in the work on summary forecasts of the scientific, technological, economic and social development of the Czechoslovak Socialist Republic;
(d) according to the principles established for the preparation of the State Plan for the Development of the National Economy of the Czechoslovak Socialist Republic and under the Specific Guidelines of the Government of the Czechoslovak Socialist Republic, it directs the preparation, elaboration and presentation to the Government of the Czechoslovak Socialist Republic of the draft State Plan for the Development of Science and Technology *) and manages the preparation and processing of the State Plan for Design and Typical Works, *) working closely with the State Planning Commission; discuss the draft basic research plan before submitting it to the Government of the Czechoslovak Socialist Republic; * *)
(e) proposes to be included in the investment construction plan after consultation with the competent authorities of the State, ensuring the implementation of the State Science and Technology Development Plan;
(f) establish, on the basis of the uniform state scientific and technological policy and its guidelines approved by the Government of the Czechoslovak Socialist Republic, the use of financial, foreign exchange and other resources allocated to the State's development plan of the Czechoslovak Socialist Republic, the State Budget of the Federation and the Monetary Plan of the Czechoslovak Socialist Republic to ensure the tasks of the Science and Technology Development Plan and to ensure the activities of the organisations of the single research and development base in the Czechoslovak Socialist Republic; establishing, within the framework of these appropriations, the reserves applicable to speed up innovation processes. In cooperation, the State Planning Commission shall provide for the use of additional funds allocated to the State programmes for which it organises its security;
(g) it shall, together with the State Planning Commission, the Federal Ministry of Finance and the relevant central authorities of the Republic, develop proposals for the concept of state housing policy, including proposals for its securing; The draft drafts are submitted together with the State Planning Commission and the Federal Ministry of Finance to the Government of the Czechoslovak Socialist Republic;
(h) develop, together with the State Planning Commission and other federal central authorities and central authorities of the Republic, a national concept of environmental creation and protection; the proposal submitted after discussion in the Government of the Czech Socialist Republic and in the Government of the Slovak Socialist Republic to the Government of the Czechoslovak Socialist Republic;
(ch) develop, together with the relevant federal central authorities and central authorities of the Republic, the concept of international cooperation in the field of scientific and technological development, including licensing policy and technical assistance, the environment, investment development and their provision; organise such cooperation; the processed proposals are submitted to the Government of the Czechoslovak Socialist Republic;
(i) propose to the Government of the Czechoslovak Socialist Republic the principles of managing a single research and development base in the Czechoslovak Socialist Republic; Is expressed on the integration of organisations into and the exclusion from the single research and development base;
(j) ensure the formation and operation of workplaces of the scientific, technical and economic information system and process the concept of building automated management systems;
(k) carry out, in accordance with the intentions of the State Technical and Investment Policy, State expertise on investments in sectors managed by federal authorities and investments of federal importance, as determined by the Government of the Czechoslovak Socialist Republic; monitor the implementation of investments of federal importance in federally managed sectors and propose to the Government of the Czechoslovak Socialist Republic the necessary measures or implement such measures;
(l) coordinate control activities in the field of scientific, technological and investment development; controls the implementation of the Single State Plan for the Development of Science and Technology and the implementation of investments selected in accordance with principles approved by the Government of the Czechoslovak Socialist Republic and proposes the necessary measures;
(m) coordinate the provision of a single state-owned scientific, technological, investment and housing policy and the concept of creating and protecting the environment, international cooperation [point (ch)] and the development of automated management systems.
(1) Under this Act, the State Commission issues generally binding legislation on the section
(a) planning for scientific and technological development;
(b) research and development bases, scientific, technical and economic information and automated management systems;
(c) the use of financial, foreign exchange and other funds earmarked under Paragraph 52 (f);
(d) the management of investment, project, engineering and characterisation activities;
(e) the preparation, implementation and evaluation of investments;
(f) determining the economic effectiveness of scientific and technological development and investment;
(g) budgeting in investment construction.
(2) The general binding legislation issued by the competent federal central authorities on the financing sections of scientific and technological development, the prices of research and development work, the wage forms and remuneration of pre-production personnel and other generally binding legislation of federal central bodies affecting scientific and technological development, its application in practice and investment development shall be issued after consultation with the State Commission.
(1) The Chairman of the State Commission shall be under the authority of the Office for Inventions and Discoveries and the Office for Standardisation and Measurement; their status and scope shall be laid down in specific provisions.
(2) The Chairman of the State Commission is subordinate to the Czechoslovak Atomic Energy Commission ("the Commission '). The Commission is a federal body of state administration. Its President, Vice-President and other members are appointed and dismissed by the Government of the Czechoslovak Socialist Republic.
(3) The Commission is responsible for:
(a) to process the proposal for a Czechoslovak nuclear programme and to propose the scope and distribution of the means of securing it and, in cooperation with the federal authorities and the authorities of the Republics, to ensure its implementation;
(b) approve and register the use of fissile materials;
(c) issue, pursuant to this Act, in cooperation with the Federal Ministry of Fuel and Energy, generally binding nuclear safety legislation in the design, construction and operation of nuclear installations, ensure records of radioactive substances and fissile materials and monitor the disposal of radioactive waste;
(d) to fulfil, to the extent specified, the tasks of international cooperation in the field of nuclear technology. "
(1) The rights and obligations of employment and other relationships are transferred from the former Federal Ministry of Technical and Investment Development to the State Commission.
(2) Where the legislation refers to the Federal Ministry of Technical and Investment Development, this means the State Commission, which refers to the Minister of the Czechoslovak Socialist Republic for Technical and Investment Development, the President of the State Commission.
(1) The State Commission shall decide in the College on fundamental matters within its competence.
(2) Other matters falling within the competence of the State Commission shall be decided by its chairman and senior staff on the basis of the division of management functions provided for by the Statute of the State Commission.
This Act shall take effect on 1 November 1983.
