on the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance
On 14 December 1959, the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance were signed in Sofia.
The National Assembly agreed to these documents on 8 February 1960 and ratified them by the President of the Republic on 21 March 1960.
The Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance entered into force on 13 April 1960.
The Czech version of the Statute of the Council of mutual economic assistance and the Convention on the legal capacity, privileges and immunities of the Council of mutual economic assistance shall be published at the same time.

STATUT
Mutual Economic Assistance Councils
the Governments of the People's Republic of Albania, the People's Republic of Bulgaria, the People's Republic of Hungary, the German Democratic Republic, the People's Republic of Poland, the People's Republic of Romania, the Union of Soviet Socialist Republics and the Czechoslovak Republic,
taking into account the fact that economic cooperation successfully implemented between their States helps the most rational development of the national economy, the increase in the standard of living of the population and the consolidation of the unity and unity of those States,
determined to continue to develop all-round economic cooperation on the basis of the consistent implementation of the international socialist division of labour in order to build socialism and communism in their states and to ensure lasting peace throughout the world,
convinced that the development of economic cooperation between their states helps to achieve the objectives set out by the Charter of the United Nations,
reaffirming its will to develop economic relations with all countries on the principles of equality, mutual advantages and non-interference in internal affairs, independently of their social and state establishment,
conferring on the Council ever-increasing importance for the organisation of economic cooperation between their states,
agree to adopt the following Statute:
Objectives and principles
1. The objective of the Council of mutual economic assistance is to unify and coordinate the efforts of the Member States of the Council to contribute to the planned development of the national economy and to accelerate the economic and technical progress of those States, to increase the level of industrialisation of countries with less developed industries, to continuous growth in labour productivity and to the continuous rise in the standard of living of the people of the Council Member States.
2. The Council of Mutual Economic Assistance shall be based on the principle of sovereign equality in all Council Member States.
Economic and scientific and technical cooperation of the Member States The Council shall be implemented in accordance with the principles of full equality, respect for sovereignty and national interests, mutual advantages and cooperative mutual assistance.
Composition
1. The States which signed and ratified this Statute are the original members of the Mutual Economic Assistance Council.
2. Other European States which identify with the Council's objectives and principles and which have expressed their agreement to take over the obligations contained in this Statute may also be adopted as members of the Council.
The new members shall be adopted by decision of the Council meetings on the basis of official requests from States to join the Council.
3. Any Member State of the Council may withdraw from the Council by notifying its resignation to the depositary of this Statute. The notification shall take effect six months after the date on which the depositary received it. Upon receipt of such notification, the depositary shall inform the Council Member States thereof.
4. There is agreement between the Member States of the Council that they will
(a) ensure compliance with the recommendations of the Council institutions which they have adopted;
(b) provide the Council and its officials with the necessary assistance in the performance of their functions under this Statute;
(c) to provide the Council with the materials and information necessary for the performance of its tasks;
(d) inform the Council how its recommendations are implemented.
Scope and authorisation
1. In accordance with the objectives and principles set out in Article I of this Statute, the Council of Mutual Economic Assistance
(a) organise:
the comprehensive economic and scientific and technical cooperation of the Council Member States on the most rational use of their natural resources and on speeding up the development of production forces,
preparing recommendations on the most important issues of economic relations arising from the development plans for the national economy of the Member States of the Council, in order to coordinate those plans,
examining the economic problems that the Council Member States are interested in;
(b) assist the Council Member States in developing and implementing common measures;
on the development of industry and agriculture by the Council Member States on the basis of the consistent implementation of the international socialist division of labour, specialisation and cooperation of production,
to develop transport in order primarily to ensure the increasing transport of export, import and transit costs of the Council Member States;
the most efficient use of investments made by Council Member States in the construction of buildings built with joint participation,
to develop the exchange of goods and services between and between Council Member States and other States;
exchange of scientific and technical knowledge and advanced production experience;
(c) take further action to achieve the objectives of the Council.
2. The Council of Mutual Economic Assistance shall be entitled to act by its institutions acting within the limits of its competence, recommendations and decisions in accordance with this Statute.
Recommendations and decisions
1. The recommendations concern matters of economic and scientific and technological cooperation. They shall be communicated to the Member States of the Council for consideration.
The Council Member States shall implement the recommendations they have adopted on the basis of the resolutions of their governments or competent authorities in accordance with their legislation.
2. The decisions relate to organisational and procedural issues. Unless otherwise provided for in the Decisions, they shall take effect on the date of signature of the Protocol on the meeting of the competent authority of the Council.
3. All recommendations and decisions shall be made by the Council only with the agreement of the relevant Council Member States; Any Member State of the Council may declare an interest in any of the matters discussed by the Council.
Recommendations and decisions shall not apply to States which have declared that they are not interested in the question. However, each of these States may at a later date join the recommendations and decisions adopted by the other Council Member States.
Authorities
1. In order to exercise its competence and powers under Article III of this Statute, the Council shall have the following main bodies:
Council meetings,
The opinion of the Heads of State in the Council,
the Standing Committee,
Secretariat.
2. Other bodies which would prove necessary shall be established in accordance with this Statute.
Council meetings
1. The Council meeting shall be the highest body of the Council for mutual economic assistance. It is for him to discuss all matters within the competence of the Council and make recommendations and decisions in accordance with this Statute.
2. Council meetings shall consist of delegations from all the Member States of the Council. The composition of the delegation of each State shall be determined by its government.
3. The ordinary Council meetings shall be held twice a year, gradually in the capitals of the Member States of the Council; they shall be chaired by the Head of Delegation of the State on whose territory the meeting is held.
4. Extraordinary Council meetings may be held at the request or with the agreement of at least one third of the Council Member States.

(a)
the proposals for economic and scientific and technological cooperation submitted by the Member States of the Council, the advice of the Heads of State in the Council, the standing committees or the Secretariat of the Council,
a report to the Council Secretariat on the activities of the Council;
(b) determine the focus of the activities of the other Council institutions and the main items of the agenda of the next Council meeting;
(c) perform other functions which prove necessary to achieve the objectives of the Council.
6. The Council meetings may be set up by the bodies it finds necessary for the performance of the functions of the Council.
7. The Council meetings shall lay down its rules of procedure.
Council meeting of the Heads of State
(1) The deliberations of the representatives of the States in the Council of Mutual Economic Assistance shall consist of representatives of all the Member States of the Council; Each state has one representative in the Council.
The representative of the State in the Council shall have his deputy at the place where the Council Secretariat is based and the necessary number of advisers and other staff. Under the authority of the representative, his deputy shall perform the functions of representative in the Advisory Board.
2. The meeting shall meet as necessary.
3. The panel may, within the limits of its competence, make recommendations and decisions in accordance with this Statute. It may also submit proposals to Council meetings for consideration.
4. Meeting
(a) discuss the proposals of the Council Member States, standing commissions and the Council Secretariat to ensure compliance with the recommendations and decisions of the Council meetings and discuss other issues of economic and scientific and technological cooperation to be addressed in the period between Council meetings;
(b) examine provisionally, where necessary, the proposals of the Member States of the Council, standing commissions and the Council Secretariat on the agenda of the next Council meeting;
(c) coordinate the work of the permanent Council commissions and discuss their reports on work and other activities carried out;
(d) approve:
the staffing and budget of the Council Secretariat, as well as the report of the Council Secretariat on the implementation of the budget,
the status of standing commissions and the Council Secretariat;
(e) establish financial management control bodies for the Council Secretariat;
(f) perform other functions resulting from this Statute and from recommendations and decisions of the Council meetings.
5. The panel may set up auxiliary bodies for the preliminary processing of questions.
6. The panel shall establish its rules of procedure.
Standing commissions
1. The Standing Commission of the Council of the Common Economic Assistance shall set up a Council meeting to facilitate the further development of economic relations between the Member States of the Council and to organise multilateral economic and scientific and technical cooperation in the various areas of the national economy of those States.
Statutes of standing committees shall be approved by the Council of Heads of State.
2. Each Member State of the Council shall appoint its representatives in standing committees.
3. Standing commissions may, within the limits of their jurisdiction, make recommendations and decisions in accordance with this Statute. They may also submit proposals for consideration to Council meetings and to the Councils of States in the Council.
4. Standing commissions shall draw up the measures and prepare proposals for economic and scientific and technological cooperation referred to in point 1 of this Article; carry out other functions resulting from this Statute and from the recommendations and decisions of the Council and the Council of State Councils.
5. Standing commissions shall, as a general rule, meet at the place of their permanent seat designated by the Council.
6. Standing commissions may, where necessary, establish auxiliary bodies. The composition and competence of these bodies and the place of their meetings shall be determined by the Standing Committee.
7. Each permanent committee shall have a secretariat headed by the committee secretary. The Secretariat of the Commission shall be part of the Council Secretariat and shall be financed by its budget.
8. Standing commissions shall lay down their rules of procedure.
Secretariat
1. The Secretariat of the Council of Mutual Economic Assistance shall be composed of the Secretary of the Council, its Deputy and the staff required to perform the functions of the Secretariat.
The Secretary and Deputy Directors shall manage the work of the Council Secretariat; shall be appointed by the Council. Secretariat staff shall be composed of citizens of the Council Member States according to the Statute of the Council Secretariat.
The Council Secretary is the main Council official. It shall represent the Council vis-à-vis the official persons and organisations of the Member States of the Council and other States as well as international organisations. The Council Secretariat may empower its Deputy and Secretariat staff to speak on its behalf.
The Secretary and his Deputy Members may attend all meetings of the Council institutions.
2. Council Secretariat
(a) submit to the ordinary Council meetings a report on the activities of the Council;
(b) assist in the preparation and during the Council and Council meetings of the Heads of State in the Council, meetings of the Council's standing committees and meetings convened by the Council's decisions;
(c) draw up economic summaries and studies on the basis of Council Member States' documents and publish materials on the economic and scientific and technological cooperation of those States at the order of the Council or of the Council's Councils of Representatives;
(d) produce:
proposals concerning the work of the Council for the competent Council bodies,
information and reports on economic and scientific and technological cooperation issues of the Council Member States;
(e) organise, together with the Council's standing committees, the preparation of proposals for multilateral agreements on economic and scientific and technological cooperation, on the basis of recommendations and decisions of the Council and the Council of Representatives of the States in the Council;
(f) carry out other activities arising from this Statute, from the recommendations and decisions of the Council as well as from the Statute of the Council Secretariat.
3. The Council Secretariat, its Deputy and Secretariat staff shall have the same status in the performance of their duties as those of other international organisations.
4. Moscow is the seat of the Council Secretariat.
Participation of other countries in the Council's work
The Council of Economic Assistance may invite non-member countries to participate in the work of the Council institutions.
The conditions under which representatives of those countries may participate in the work of the Council institutions shall be determined by the Council in accordance with the agreement with the countries concerned.
Relations with international organisations
The Council of Economic Assistance may establish and maintain contacts with economic organisations. The United Nations and other international organisations.
The nature and form of such contacts shall be determined by the Council in agreement with the relevant international organisations.
Financial matters
Member States of the Council of mutual economic assistance shall bear the costs of maintaining and financing the Council Secretariat. The share of each Council Member State in this remuneration shall be determined by the Council meeting; the Council shall decide on other financial matters.
2. The Council Secretariat shall present a report on the implementation of the budget to the Council's national representatives for each calendar year.
3. The costs of the stay of the participants of the Council meetings, the meetings of the Heads of State in the Council, the meetings of the Council's standing committees and the deliberations held within the Council shall be borne by the State sending a representative to such meetings and meetings.
4. The costs of organising the meetings and meetings referred to in point 3 of this Article shall be borne by the State in whose territory these meetings and consultations shall take place.
Miscellaneous provisions
1. The Council of mutual economic assistance shall have in the territory of the Member States of the Council the legal capacity necessary for the exercise of its competence and for the achievement of its objectives.
(2) The Council, the representatives of the Member States of the Council and the officials of the Council shall enjoy in the territory of each of those States the privileges and immunities necessary for the performance of their duties and for the achievement of the objectives set out in this Statute.
3. The legal capacity, privileges and immunities referred to in this Article shall be determined by a specific convention.
4. The provisions of this Statute shall not affect the rights and obligations of the Council Member States resulting from their membership of other international organisations and from international agreements which they have concluded.
Language
The official languages of the Council of Economic Assistance are those of all the Council Member States.
The language of the Council is Russian.
Ratification and validity of the Statute
1. This Statute requires ratification by the signatory States in accordance with their constitutional requirements.
2. The instruments of ratification shall be deposited with the depositary of this Statute.
3. The Statute shall enter into force as soon as the instruments of ratification have been deposited by all States which have signed the Statute; the depositary shall inform those States accordingly.
4. For a State which, pursuant to Article II (2) of this Statute, will be admitted to the Council of Mutual Economic Assistance and ratify the Statute, the Statute shall become valid on the date on which that State deposits the instrument of ratification; the depositary shall inform the other Council Member States accordingly.
Amendments to the Statute
Any Member State of the Council of mutual economic assistance may propose to amend this Statute.
Amendments to the Statute approved by the Council meeting shall enter into force as soon as all the Council Member States have deposited with the depositary the instruments of ratification of those amendments.
Final provisions
This Statute was drawn up in one copy in Russian. The Statute will be deposited with the Government of the Union of Soviet Socialist Republics, which will circulate certified copies of the Statute to the governments of all the other Member States of the Council and will notify these governments and Council Secretaries that the instruments of ratification have been deposited with the Government of the Union of Soviet Socialist Republics.
This Statute has been signed by the representatives of the governments of the Member States of the Council of mutual economic assistance.

CONVENTION
on the legal capacity, privileges and immunities of the Council for mutual economic assistance
the Governments of the People's Republic of Albania, the People's Republic of Bulgaria, the People's Republic of Hungary, the German Democratic Republic, the People's Republic of Poland, the People's Republic of Romania, the Union of Soviet Socialist Republics and the Czechoslovak Republic,
having regard to Article XIII of the Statute of the Council of mutual economic assistance which it provides for,
that the Council has in the territory of each Member State of the Council the legal capacity necessary for the exercise of its competence and for the achievement of its objectives,
that the Council, the representatives of the Member States of the Council and the officials of the Council enjoy in the territory of each of those States the privileges and immunities necessary for the performance of their duties and for the achievement of the objectives set out in this Statute; and
that the said legal capacity, privileges and immunities will be determined by a specific convention,
they have agreed as follows:
Legal capacity
The Council of Economic Assistance shall be a legal person and shall be entitled to:
(a) conclude agreements;
(b) acquire property, dispose of property, hire and lease;
(c) act before a court.
