on the legality of negotiations related to the fight to restore freedom of Czechs and Slovaks.
The Provisional National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
The negotiations which took place between 30 September 1938 and 28 October 1945 and which were intended to contribute to the fight for the re-establishment of the freedom of the Czechs and Slovaks, or which aimed at a fair retaliation for the actions of the occupants or their helpers, are not justified even if it would otherwise be criminal under the applicable rules.
§ 2.
(1) If someone has already been convicted of such an offence, it should be treated in accordance with the rules on the renewal of criminal proceedings.
(2) The jurisdiction shall lie with the court seised in the first chair or, if it is not, the court which would now have jurisdiction in the first chair if the lawlessness of the act had not been ruled out under Paragraph 1.
(3) If the offence referred to in § 1 is brought together by an offence for which the defendant has been sentenced by the same judgment, the court shall give a new sentence for that other act by judgment, taking account of the plea of guilt already made.
§ 3.
This Act shall take effect on the day of its publication; It shall be carried out by the Ministers for Justice and National Defence.
