Decret of the President of the Republic
of 27 October 1945
on coal and fuel management.
On the proposal of the Government and in agreement with the Slovak National Council, I establish:
(1) In order for the entire territory of the Czechoslovak Republic to be managed uniformly by the coal and fuel management, extracted in the territory or imported there, a central coal division with its registered office in Prague (in the next Division) is established.
(2) The division divides, in particular, coal production, as declared in the provisional estimates of the different regions as well as coal imported into three main consumption groups: rail, industry and other consumption, after hearing the representatives of these groups. The representative of the Railway Group shall be appointed by the Minister of Transport, the Industry Group, the Minister of Industry in agreement with the Minister of Food and the other consumption group, the Minister of Internal Trade in agreement with the Ministers for Labour and Social Welfare and Agriculture.
(3) Coal means all types of coal, stone and brown, and all solid fuels derived therefrom.
(4) Fuel wood means fuel wood of all kinds for heating purposes, except those which are required to produce generator wood.
The division shall be a legal person governed by public law. He is the legal successor to the coal-economy office for Bohemia and Moravia established by the Government Decree of 3 October 1944, No. 223 Coll., on Coal Management.
(1) The division shall be subject directly to the Bureau of the Government.
(2) The division shall be represented both in court and outside the court by its representative.
(3) The Government appoints the priority of the Division and its representative.
(4) The division is subject to control by the Supreme Accounting Audit Office pursuant to the provisions of the Act of 20 March 1919, No 175 Coll., on the establishment and competence of the Supreme Accounting Audit Office.
A commission, composed of representatives of the General Secretariat of the Economic Council and of the ministries of industry, internal trade, external trade, agriculture, finance, nutrition and transport, is hereby established at the Bureau of the Government, which sets out the essential directives for coal management. The committee's meeting is attended by Head of Division with an advisory vote.
The division shall be approved by the Bureau of the Government in the framework of the essential directives laid down in Article 4, the regulations on the treatment and supervision of coal, fuel wood. These regulations will be published in the Official Journal of the Czechoslovak Republic.
The authorities, public authorities and economic interest organisations are obliged, if the Division so requests, to cooperate in the implementation of this decree.
For the reports requested by the Division and its instructions, the provisions of Sections 6, 7 and 10 of the Decree of 26 June 1943, No 175 Coll., on the circulation of goods shall apply only to other provisions of Section 6, 7 and 10.
The Chair of the Division shall issue Rules of Procedure for it, which shall require the approval of the Bureau of the Government.
(1) The budget for the following calendar year shall be drawn up by 1 December each year and submitted to the Bureau of the Government for approval.
(2) By 1 March each year, the Division shall draw up the accounts for the previous financial year and submit them for approval to the Bureau of the Government, which shall discuss them in agreement with the Supreme Audit Office.
(1) The maintenance cost of the Division shall be provided with contributions.
(2) Contributions shall be made:
(a) for domestic fuels supplying coal organisation, after the sales organisation supplying the mine;
(b) for domestic fuels not sold by a coal organisation or by a mine-supplying sales organisation;
(c) the importer for imported fuels.
(3) The amount of the contributions and the conditions for their collection shall be determined by the Minister of Finance after hearing the President of the Supreme Bureau of Price. The contributions not paid in time shall pay 4% interest on late payments.
(4) Payment orders for contributions issued by the Division are an enforceable title; their fulfilment is enforced by political execution.
All legal acts, documents, submissions and official acts which carry out the tasks of this Decree, which shall be distributed, shall be free of fees, stamps and levies.
The hearing and omission, contrary to the rules of this decree or to the rules and instructions issued by the Division within its field of competence, shall be punishable on a proposal from the Division, unless it is a criminal offence by a court, the District National Committee, by a fine of up to CZK 3,000,000 or by a prison of up to one year or both. If a fine has been imposed, a replacement prison sentence shall also be imposed in case of imperfections, according to the rate of guilt within one year.
In the event of the cancellation of the Division, the Bureau of Government shall appoint a liquidator and decide on its assets after hearing the Minister of Industry and the Minister of Internal Trade.
The applicability of Decree-Law No 223 / 1944 Coll. is hereby revoked.
This Decision shall take effect on the day of its publication; it shall be carried out by all members of the Government.
