of 10 May 1999
establishing for the purposes of the criminal law what is considered poisons, contagious diseases and pests
The Government orders the implementation of § 195 paragraph 2 of Act No. 140 / 1961 Coll., Criminal Act, as amended by Act No. 167 / 1998 Coll.:
(1) Poison within the meaning of § 187, 187a and 188 of the Criminal Code, if not for medicinal products, 1) shall be regarded as:
(a) chemicals listed in Annex 1 (hereinafter referred to as "substances");
(b) chemical preparations containing at least 7% of the substance.
(2) The diseases listed in Annex 2 shall be considered as contagious human diseases within the meaning of Sections 189 and 190 of the Criminal Code.
(3) The diseases listed in Annex 3 shall be considered as contagious diseases of domestic or other economically important animals within the meaning of Section 191 of the Criminal Code.
(4) The diseases and pests listed in Annex 4 shall be considered as infectious diseases or pests of productive plants within the meaning of Section 192 of the Criminal Code.
Government Regulation No. 10 / 1999 Coll., repealing Government Regulation No. 192 / 1988 Coll., on poisons and certain other harmful health substances, as amended, and laying down for the purposes of the criminal law what is considered to be poisons, is amended as follows:
Article 2 and Annexes 1 and 2 are deleted.
This Regulation shall enter into force on the day of its publication.
